Administrative Procedures of Shanghai Municipality for Residence Card Points

(December 28, 2017)

Chapter I  General Provisions

Article 1(Purposes and Basis)

With a view to safeguarding the legitimate rights and interests of migrants to Shanghai from other parts of the Chinese mainland, regulating population services and administration, improving the government services, and promoting the coordinated development of economy, society, resources and environment in Shanghai, these Procedures are formulated in accordance with the Procedures of Shanghai Municipality for the Administration of the Residence Card.

Article 2(Applicable Targets)

These Procedures apply to mainland migrants who work or reside in this Municipality with the Shanghai Residence Card (hereinafter referred to as the residence card), and have been enrolled in the social insurance for the employees herein for six months.

Article 3 (Points-Based System of Residence Card)

The points-based system of the residence card is established to award points to holders of the residence card (hereinafter referred to as the card holders) who have a legal and stable residence and job in this Municipality. Points are awarded based on certain conditions and contribution of the card holder. The card holder scoring the pass mark may enjoy relevant social services.

Article 4(Division of Duties)

Shanghai Municipal Human Resources and Social Security Bureau shall be responsible for the administration of the residence card points.

The people’s governments of all districts shall be responsible for the practical implementation of these Procedures within their respective administrative jurisdictions.

Such departments as public security, education, health and family planning, science and technology, industry and commerce, taxation, housing and urban-rural development, civil affairs, and economy and informatization shall be responsible for providing services and administrating related to these Procedures according to their respective functions.

Chapter II  Point Indicators and Awarding of Points

Article 5(Point Indicator System)

The system of the residence card point indicators consists of basic indicators, deduction indicators, bonus indicators and veto indicators.

Article 6 (Basic Indicators and Awarding of Points)

The basic indicators include age, educational background, professional and technical title and skill level, and years of working and paying the employee social insurance premiums in Shanghai.

1. Age

The maximum points for age is 30 points. The criteria for earning points are as follows:

The card holder between 56 and 60 earns 5 points, with 2 points added for each year less.

2. Educational background

The maximum points awarded for the educational background is 110 points. The card holder with a Chinese or overseas educational qualification and degree accredited by the State under the regulation of the state competent educational authorities may claim points. The criteria for earning points are as follows:

(1) The card holder with a junior college (or higher vocational) qualification earns 50 points.

(2) The card holder with an undergraduate qualification earns 60 points.

(3) The card holder with an undergraduate qualification and a bachelor’s degree earns 90 points.

(4) The card holder with a postgraduate qualification and a master’s degree earns 100 points.

(5) The card holder with a doctorate qualification and a doctoral degree earns 110 points.

3. Professional/technical title and skill level

The maximum points awarded for a professional/technical title or a skill level is 140 points. Where the card holder has obtained a qualification certificate of the professional/technical title, an occupational qualification certificate of the professional/technical type, or a national occupational qualification certificate of the skill type during his/her work in this Municipality, he/she may claim points under this indicator, provided that the profession or occupation of his/her certificate matches his/her current post. The criteria for earning points are as follows:

(1) The card holder with a national level-5 occupational qualification of the skill type earns 15 points.

(2) The card holder with a national level-4 occupational qualification of the skill type earns 30 points.

(3) The card holder with a national level-3 occupational qualification of the skill type earns 60 points.

(4) The card holder earns 100 points if he/she possesses a national level-2 occupational qualification of the skill type, a qualification of an intermediate professional/technical title, or other professional/technical qualifications of an equivalent level.

(5) The card holder with a national level-1 occupational qualification of the skill type, or a qualification of a senior professional/technical title earns 140 points.

Where a card holder applies for points based on a qualification of an intermediate or senior professional/technical title or a national level-2 or level-1 occupational qualification of the skill type, his/her social insurance payment base in a cumulative total of six months in the past year shall be not less than the average salary of Shanghai employees in the previous calendar year.

Where the occupational qualification of the professional/technical title is required to be registered under relevant state rules and regulations, points shall not be awarded until after the registration.

The catalogue of the occupational qualifications of the professional/technical type and the catalogue of the national occupational qualifications of the skill type shall be published by Shanghai Municipal Human Resources and Social Security Bureau.

4. Years of working and paying the employee social insurance premiums in Shanghai

The card holder who works in this Municipality and pays the employee social insurance premiums every month under relevant rules and regulations of the State and the Municipality earns 3 points for each completed year of full payment

If the card holder fails to make regular payment of his/her employee social insurance premiums though making good the due amount later, or if the entity paying the employee social insurance premiums is not the same employer that signs the labor or employment contract, these two cases shall not be taken as the basis for awarding points.

Article 7(Bonus Indicators and Awarding of Points)

The bonus indicators include startup entrepreneurs, innovative and entrepreneurial talents in intermediary service, professions in acute need, investment and tax payment or contribution to local employment, the employee social insurance payment base, specific fields in public service, key suburban areas, fresh graduates with a full-time university education, awards and honors, and spouse of a citizen of Shanghai household registration.

1. Startup entrepreneurs

A startup entrepreneur who meets specific conditions earns 120 points.

The specific conditions for startup entrepreneurs to earn points shall be made public after being formulated by Shanghai Municipal Science and Technology Commission in collaboration with other relevant departments.

2. Innovative and entrepreneurial talents in intermediary service

An innovative and entrepreneurial talent in intermediary service who meet certain conditions earns 120 points.

The specific conditions for innovative and entrepreneurial talents in intermediary service to earn points shall be made public after being formulated by Shanghai Municipal Science and Technology Commission in collaboration with other relevant departments.

3. Professions in acute need

Thecard holderearns 30 points if his/her profession is in acute need in this Municipality and matches his/her current post.

The listof professions in acute need in the Municipality shall be made public after being formulated by the Municipal Human Resources and Social Security Bureau in collaboration with other relevant departments.

4. Investment and tax payment or contribution to local employment

Where a card holder makes investment,calculated by his/her individual share of the investment,to create an enterprise in this Municipality, if he/she has paid an average annual tax of 100,000 yuan or above for the recent three consecutive years or has employed an average of 10 employees (or above) of Shanghai household registration, then each tax payment of 100,000 yuan or every 10 employees of Shanghai household registration earns 10 points. The maximum points awarded is 120 points.

5. The employee social insurance payment base

The maximum points awarded for the employee social insurance payment baseis 120 points. The criteria for earning pointsare as follows:

(1) The card holder earns 25 points if his/her social insurance payment basehas, for a cumulative period of 36 months in the past 4 years, been equal to (or above) 80% and lower than 100% of the previous year’s average salary of Shanghai employees.

(2) The card holder earns 50 points if his/her social insurancepayment basehas, for a cumulative period of 36 months in the past 4 years, been equal to (or above) 100% and lower than 200% of the previous year’s average salary of Shanghai employees.

(3) The card holder earns 100 points if his/her social insurancepayment basehas, for a cumulative period of 36 months in the past 4 years, been equal to (or above) 200% and lower than 300% of the previous year’s average salary of Shanghai employees.

(4) The card holder earns 120 points if his/her social insurance payment basehas, for a cumulative period of 24 months in the past 3 years, been equal to (or above) 100% and lower than 300% of the previous year’s average salary of Shanghai employees.

The following circumstances shall not be taken as the basis for awarding points:

(1) The card holder fails to make regular payment of social insurance though he/she makes good the due amount later;

(2) The card holder’s social insurance payment base does not reasonably match his/her personal income tax payment base; and

(3) The entity paying the employee social insurance premiums is not the same employer that signs the labor or employment contract.

6. Specific fields in public service

The card holder employed in a specific field of public service in Shanghai earns 4 points each year, and upon 5 full years, these points shall be added into his/her total score.

7. Key suburban areas

The card holder working and living in a key suburban area of Shanghai earns 2 points each year, and upon 5 full years, these points shall be added into his/her total score. The maximum points awarded for this indicator is 20 points.

8. Fresh graduates with a full-time university education

The card holder earns 10 points if he/she is a fresh graduate with a full-time university education.

9. Awards and honors

A maximum of 110 points is awarded to the card holder who has received awards and honors during his/her work in Shanghai. The criteria for earning pointsare as follows:

(1) The card holder earns 30 points for having received a specific-area award or honor conferred by a municipal department, commission, office, bureau (administration), etc. of this Municipality.

(2) The card holder earns 60 points for having received an all-area award or honor conferred by a municipal department, commission, office, bureau (administration), etc. of this Municipality.

(3) The card holder earns 110 points for having received an award or honor by a provincial or ministerial government or above.

The catalogue of awards and honors by municipal departments, commissions, offices, bureaus (administrations), etc. of this Municipality shall follow the catalogue of awards and honors approved and published by Shanghai Municipal People’s Government.

10. Spouse of a citizen of Shanghai household registration.

The card holder marrying a citizen of Shanghai household registration earns 4 points for each full year of the marriage, withthe maximum points being 40 points.

Article 8 (Deduction Indicatorsand Awarding of Points)

Deductionindicators include submitting false documents, records of administrative detention, and records of ordinary crimes.

1. Submitting false documents in application for points

150 points shall be deducted each time a card holder is found making a false statement of his/her identity, educational background, employment, professional/technical title or occupational qualification, marriage, awards, honors, or other facts over the past three years.

2. Records of administrative detention

Where the card holder has a record of administrative detention over the past five years, 50 points shall be deducted for each record.

3. Records of ordinary crimes

Where the card holder has a record of ordinary crimes over the past five years, 150 points shall be deducted for each record.

Article 9(Veto Indicators)

The card holder shall be disqualified from application for points if he/she has a record of violating the family planning policies of the State and this Municipality or has been convicted of a serious crime.

Chapter III  Rules for Point Accumulation and Pass Mark

Article 10(Point Accumulation Rules under a Single Indicator)

Under the basic indicators and the bonus indicators, points for various indicators shall not be accumulated, and only the highest points for an indicator shall be accepted.

Under the deduction indicators, the points for various indicators shall be deducted on an accumulative basis.

Article 11(Formula for Total Score Calculation)

The total points of a card holder shall be calculated under the following formula:

Basic points bonus points -points deducted = total score.

The minimum total score is zero. Of the two indicators of “educational background” and “professional/technical title and skill level” under the basic indicators, a card holder can claim points from one indicator only. Of the two indicators of “investment and tax payment” and “contribution to local employment” under the bonus indicators, a card holder can claim points from one indicator only.

Article 12 (Pass Mark for the Total Score)

The pass mark for the total score of the residence card is 120.

Chapter IV Application Process and Administration

Article 13(Application for Points)

The card holder who applies for points may first take the simulated point calculation online via the Shanghai Information System of Residence Card Administration. The card holder scoring the pass mark may request and entrust his/her employer to file an application for points with the human resources service center in the administrative district where the employer registered.

Article 14 (Documents Required for Application)

The basic documents the card holder and the entrusted employer must submit include:

1. valid residence card of the card holder;

2. application Form of Shanghai Residence Card Points;

3. labor (Employment) contract;

4. statement of compliance with the family planning policies of this Municipality and the State.

5. statement of no criminal offense; and

6. business license (the registration form of a public institution as a legal person, the certificate of a social organization as a legal person, or the certificate of a non-governmental non-enterprise as a legal person and the certificate of the organization code or the certificate and IC card of the unified social credit code.

Apart from the above-mentioned basic application documents, the card holder shall also provide documents in support of various individual indicators under the residence card indicators.

Article 15(Acceptance of Documents)

The human resources service center, upon receiving all the documents required for an application, shall issue a receipt to the applicant. If any further documents are needed, the human resources service center shall inform the applicant on the spot to provide further documents.

Article 16 (Verification and Checks)

The human resources service center, upon acceptance of the application documents, shall review the card holder’s personnel file and check relevant documents in accordance with relevant rules and regulations on the personnel file administration of migrant population.

The application documents the card holder submits for verification include: academic certificate, degree certificate, qualification certificate of the professional/technical title, occupational qualification certificate of the professional/technical title, national occupational qualification certificate of the skill type, certificate of award, marriage certificate, residence booklet, capital contribution verification report, schedule of tax payment, and documentary evidence of recruitingemployees of Shanghai household registration. Where the human resources service center has reasonable doubts on any document submitted, it may forward it to the competent department or a specialized agency for further verification.

Article 17(Evaluation of Points)

The Municipal Human Resources and Social Security Department, upon checks and verification of the application documents, shall determine the applicant’s points under the system of residence card point indicators within 20 working days, and inform the card holder of the result.

Article 18(Query Score)

The card holder may check his/her total score either online or by going to the community affairs service center or the human resources service center with his/her residence card.

Chapter V  Supplementary Provisions

Article 19(Confirmation and Adjustment of Points)

The card holder’s points shall be confirmed upon renewal of his/her residence card.

Where the card holder needs to adjust his/her points based on a changed situation, he/she shall entrust his/her employer to submit relevant documents to the human resources service center in the administrative district where the employer registered.

Where there is a change resulting in the point decrease or deduction, the municipal human resources and social security department shall deduct the points and inform the card holder of the result.

Article 20(Invalidation of Points)

The card holder’s points become invalid upon the cancellation of his/her residence card.

Article 21(Supervision and Enquiry on Results)

Shanghai Municipal Human Resources and Social Security Bureau shall be responsible for the supervision on the application for and verification of points within the Municipality, and shall correct the points wrongfully obtained.

Where the card holder or the employer is dissatisfied with the points, he/she/it may file an application with the human resources and social security department for re-evaluation.

The supervision over information of the applicants during and after the application process shall be strengthened through the Shanghai Public Credit Information Service Platform.

Article 22(Legal Liability for Providing False Documents)

Any individual applicant who forges or alters application documents, or uses forged or altered application documents in the process of points application shall be punished by the public security departments in accordance with the relevant provisions of the Law of the People’s Republic of China on Public Security Administration and Imposition of Penalties, and the dishonest behaviors shall be recorded in the Municipal Public Credit Information Service Platform. In serious cases, the applicant shall be banned from application for points within three years. Where the applicant’s behavior constitutes a crime, he/she shall be investigated for criminal liability pursuant to law.

Any employer that applies for points on behalf of the applicant which forges or alters application documents or uses forged or altered application documents shall be imposed a penalty of not less than 30,000 yuan but not more than 50,000 yuan, and the dishonest behavior shall be recorded in the Municipal Public Credit Information Service Platform. Where the circumstances are serious, the employer shall be banned from application for points within three years. The person directly in charge and other persons directly liable shall be punished by the public security department in accordance with the relevant provisions of the Law of the People’s Republic of China on Public Security Administration and Imposition of Penalties. Where the employer’s behavior constitutes a crime, he/she shall be investigated for criminal liability pursuant to law.

Article 23(Dynamic Adjustment)

In light of the need of economic and social development of this Municipality, Shanghai Municipal Human Resources and Social Security Bureau shall work in collaboration with the municipal departments of development & reform, public security, education, health and family planning, science and technology, industry and commerce administration, housing and urban-rural development, and economy and informatization to formulate a plan for adjustment in the point indicator system and the pass mark. The adjustment plan shall be made public after being approved by Shanghai Municipal People’s Government.

Article 24(Effective Date)

These Procedures shall be effective as of January 1, 2018. The Procedures of Shanghai Municipality for the Administration of Residence Permit Points (SMPG G [2015] No. 31) Shanghai Municipal People’s Government Document) printed and distributed by the Municipal People’s Government in July, 2015 shall be repealed at the same time.
