Notice of Shanghai Municipal Bureau of Ecology and Environment on Issuance of the Directory of Key Industries under Classified Management of Environmental Impact Assessment for Construction Projects in Shanghai Municipality (2019 Edition)

Attention: All District Ecology and Environment Bureaus, Bonded Zone Management Bureau of China (Shanghai) Pilot Free Trade Zone Administrative Committee, Development and Construction Administrative Committee of Shanghai Lingang Area, Shanghai International Tourism Resort Management Committee, and all Relevant Units:

With a view to optimizing the business environment, improving the efficiency of examination and approval of environment impact assessment for construction projects, putting the environmental impact assessment system functions to better play, we shall implement classified management for municipal construction projects, differentiate the key projects from general projects, implement classified management for examination and approval of environment impact assessment, strengthen supervision on projects with high pollution, high risk (hereinafter referred to as the "double high") in accordance with the relevant provisions of the Implementation Opinions on the Reform of Environmental Impact Assessment System in This Municipality (SMPG D [2019] No. 24) issued by the Municipal People's Government. The Directory of Key Industries under Classified Management of Environmental Impact Assessment for Construction Projects in Shanghai Municipality (2019 edition) (hereinafter referred to as the directory of key industries) is formulated by our Bureau in accordance with the relevant provisions of the State and this Municipality on the classified management of environmental impact assessment for construction projects, combined with the actual situation of this Municipality. We hereby distribute them to you and request you to implement them conscientiously.

For the "double-high" industries and projects included in the directory of key industries (only refer to those construction projects that are required to compile the environmental impact reports or forms), competent departments of ecology and environment at all levels shall exercise key supervision, examine and approve them strictly, and strengthen the supervision during and after the work. For industries and projects not included in the directory of key industries, simplified and optimized measures for environmental impact assessment may be implemented in accordance with the relevant provisions of Implementation Opinions on the Reform of Environmental Impact Assessment System in this Municipality as well as the relevant supporting policy documents.

This Notice shall be effective as of July 1, 2019 and remain valid until June 30, 2021.

Directory of Key Industries under Classified Management of Environmental Impact Assessment for Construction Projects in Shanghai Municipality

(2019 edition)

I. Petrochemical, pharmaceutical, chemical fiber industry

Petroleum processing and coking industry; manufacturing of chemical raw materials and chemical products (all except the simple mixing and sub-packing of toxic and hazardous chemicals); pharmaceutical manufacturing (chemical manufacturing only); chemical fiber manufacturing.

II. Non-metallic mineral products, ferrous metals, non-ferrous metals industry

Non-metallic mineral products; ferrous metal smelting (all except calendering); non-ferrous metal smelting (all except calendering).

III. Environmental infrastructure industry

Comprehensive utilization of waste resources (only refers to the processing and recycling of waste electrical and electronic products, waste batteries, waste cars, waste machinery, waste hardware, waste plastics, waste oil, waste ships, waste tires, etc.); biomass power generation; coal gas production and supply (coal gas production only);water production and supply (only refers to the centralized treatment of domestic sewage and industrial waste water);environmental management industry (only refers to the utilization and disposal of hazardous waste (including medical waste));public facilities management (only refers to the centralized disposal of urban household garbage and urban excrement disposal projects).

IV. Research and experimental development industry

P3, P4 biosafety laboratory; Research and development bases involving items of medical and chemical pilot-scale test; Transgenic laboratory.

V. Transportation, pipeline transportation and storage industry

Large-scale railway hubs; new and relocated airports and expansion of airfields; oil, gas and liquid chemical terminals; special container terminals involving dangerous goods and chemicals; oil and natural gas (all except urban natural gas pipelines), shale gas and refined oil pipelines; chemicals delivery pipeline (all except nitrogen, compressed air and inert gas);oil depot (all except gas station and oil depot);gas storage (all except the gas storage and filling station);toxic, hazardous and dangerous goods storage, logistics distribution (all except oil storage, gas storage, coal storage).

VI. Nuclear and radiation

Production of radioisotopes and their decommissioning; using Ⅰray devices and their retirement; sites where unsealed radioactive substances are used and their decommissioning; using Ⅰ, Ⅱ, Ⅲradioactive source; new 500 kv and above power transmission and transformation projects.

VII. Other projects

1. Projects involving the following process. The items related to the pollutant discharge in Table 1 of Comprehensive Sewage Discharge Standard in Shanghai Municipality (DB31/199-2018);tire manufacturing and rubber products with refining and vulcanization processes; manufacturing of artificial leather, foamed rubber and other plastic products involving toxic raw materials or using recycled plastics as raw materials; projects with electroplating process; projects using painting technology with annual oil paint volume (including diluent) 50 tons and above; projects with pickling or organic solvent cleaning processes; food and feed processing containing fermentation processes, production of starch or starch sugar, monosodium glutamate, citric acid, lysine, alcoholic beverages and liquor; production of biological and biochemical products containing fermentation, extraction processes or highly pathogenic microorganisms; workshops with wool washing, dyeing and finishing, degumming, textile manufacturing producing filature waste water, refining waste water; tanning, leather, fur, feather (woolen) products production; pulp, dissolved pulp, fiber pulp manufacturing; paper making (including waste paper);garment manufacturing with wet printing, dyeing and washing processes; Chinese patent medicine manufacturing with extract process, Chinese herbal decoction pieces processing; hot dip galvanizing with passivation process; lead battery manufacturing; solar cell production; ship breaking and repairing yards; reclamation works, offshore dykes and dams.

2. Projects with the following production scale. Annual live pigs of 5000 (other sorts of livestock and poultry equivalent to the breeding scale of pigs) or above or livestock and poultry farms or breeding site in environmentally sensitive areas; Annual slaughter of 100,000 pigs, 10,000 beef cattle, 150,000 meat sheep, and 10 million poultry or above; Annual production of 200,000 cubic meters and above artificial panel manufacturing.

VIII. Construction projects within the ecological red line of this Municipality.
