Procedures of Shanghai Municipality on the Administration of Standard Metrological Apparatus for Public Use in Society

(Promulgated by Shanghai Municipal People's Government on June 6, 1997; amended for the first time in accordance with Decree No. 52 of Shanghai Municipal People's Government on December 20, 2010; amended for the second time in accordance with Decree No. 62 of Shanghai Municipal People's Government on January 4, 2018; amended for the third time in accordance with Decree No.7 of Shanghai Municipal People's Government on December 5, 2023)

Article 1 (Purpose and Basis)

With a view to strengthening the administration of standard metrological apparatuses for public use in society and guaranteeing the accuracy and reliability of metrological values, these Procedures are formulated in accordance with the Provisions of the Metrology Law of the People's Republic of China and the implementation rules thereof, and in light of the actual circumstances in this Municipality.

Article 2 (Definition)

The "standard metrological apparatuses for public use in society" referred to in these Procedures mean the standard metrological apparatuses, the establishment of which is organized by the administrative departments of metrologies, and which is used as a basis for unifying the metrological value within the administrative region of this Municipality, and has the function of authenticating the weighing and measuring in the society.

Article 3 (Application Scope)

These Procedures apply to the establishment, maintenance, use, and abolishment of standard metrological apparatuses for public in society within the scope of this Municipality.

Article 4 (Competent Authority)

Shanghai municipal metrology administrative department (hereinafter referred to as the municipal metrology administrative department) is the department in charge of the administration of metrologies, and is responsible for the administration and supervision of the standard metrological apparatuses for public use in society in this Municipality.

The metrology administrative departments at district level of this Municipality are responsible for the administration and supervision of the standard metrological apparatuses for public use in society in their respective administrative region according to their division of duties under the guidance of the municipal mechology administrative department.

Article 5 (Formulation of Plan)

The municipal mechology administrative department shall make a unified plan for the establishment of standard metrological apparatuses for public use in society according to the needs of economic construction, social development and technology progress in this Municipality. The plan shall be implemented after being approved by the Municipal People's Government.

Article 6 (Establishment of Standard Metrological Apparatuses for Public Use in Society)

The establishment of the standard metrological apparatuses shall comply with the requirements of the plan of this Municipality for establishing standard metrological apparatuses for public use in society.

All standard metrological apparatuses for public use in society of a basic nature and for general purpose use which serve different trades and industries shall be set up in the legal organs for metrological examination and determination. Special standard metrological apparatuses for public use in society that are of high specialty nature and are only needed by an individual trade or industry or that require special working condition shall, with the approval of the metrology administrative department that has organized and established such standard metrological apparatuses of public use in society, be set up in other metrologies examining and determining or metrologies technical organs.

Article 7 (Check of Stand and Metrological Apparatuses for Public Use in Society)

A standard metrological apparatus for public use in society shall only be allowed to provide metrological testing and calibration services after being check and found to be qualified.

Standard metrological apparatuses for public use in society, which are organized and established by the metrology administrative department at district level, and which are of the highest class in the administrative region, shall be checked under the direction of the municipal metrology administrative department. Standard metrological apparatuses for public use in society, which are organized and established by the municipal metrology administrative department, and which are of the highest class in its administrative region, shall be checked under the direction of the national metrology administrative department. Standard metrological apparatuses for public use in society of other classes shall be check under the direction of the metrology administrative departments that have organized and established the said standard metrological apparatuses for public use in society.

Article 8 (Mandatory Examination and Determination of Standard Metrological Apparatuses for Public Use in Society)

Mandatory examination and determination shall be carried out regularly on the standard metrological apparatuses for public use in society.

The mandatory examination and determination of standard metrological apparatuses for public use in society shall be conducted in accordance with the provisions of laws and rules.

Article 9 (Use of the Standard Metrological Apparatuses for Public Use in Society)

When using the standard metrological apparatuses for public use in society to provide metrological testing or calibration service, the organs for the examination and determination of the metrologies or the metrologies technical organs must have met the requirements specified by the table of the National System of Metrological Examination and Determination and the requirements related to metrological technical norms, and issue corresponding certificates of examination and determination or calibration reports.

Article 10 (Suspension of the Use of Standard Metrological Apparatuses for Public Use in Society)

The organs for the examination and determination of the metrologies or the metrologies technical organs shall regularly check the technical conditions of the standard metrological apparatuses for public use in society to guarantee that they function formally.

The organs for the examination and determination of the metrologies or the metrologies technical organs shall not suspend the examination and determination of the metrologies and calibration service of their own accord. If it is necessary for them to suspend the service for some reason, they shall report the matter to the metrology administrative department that has organized and established the standard metrological apparatuses for public use in society :

Article 11 (Disassembly and Refit of Standard Metrological Apparatuses for Public Use in Society)

In case the standard metrological apparatuses for public use in society need to be disassembled or refitted because of damage of because of the revision of the originally executed table of the Notional System of Metrological Examination and Determination and metrological technical norms, a report shall be submitted to the metrology administrative department that has organized and established the standard metrological apparatuses for public use in society.

Article 12 (Situations Leading to the Abolishment of A Standard Metrological Apparatus for Public Use in Society)

If any of the situations occur during the use of the standard metrological apparatuses for public use in society, the municipal metrology administrative department shall abolish them:

1. when a standard metrological apparatus for public use in society is replaced by another one; 

2. or when the organ that has established the standard metrological apparatuses for public use in society has been revoked.

Article 13 (Application for Abolishing the Standard Metrological Apparatuses for Public Use in Society)

When a standard metrological apparatus for public use in society is to be abolished, an application shall be submitted to the municipal metrology administrative department:

1. To abolish various standard metrological apparatuses for public use in society that are organized and established by the metrology administrative department at district level, the application shall be made by the same metrology administrative department;

2. To abolish various standard metrological apparatuses for public us in society that are organized and established by the municipal metrology administrate department, the application shall be made by the organ that installs the apparatus to be abolished.

The municipal metrology administrative department shall make a re-verification decision within 10 days after the receipt of the application. The re-verification decision approving the abolishment shall be notified to the applicant department or organ, and be announced publicly.

No department or organ shall be allowed to use the standard metrological apparatuses that have already been abolished.

Article 14 (System and Operating Norms of Storage, Maintenance, and Use)

Organs for examination and determination of metrologies or metrologies technical organs that have installed standard metrological apparatuses for public use in society shall have a perfect system and operating norms for the preservation, maintenance and use of the standard metrological apparatuses for public use in society.

The environmental temperature and humidity, and the degree of being dustproof, shockproof, corrosion resistant and jamproof at the place where the standard metrological apparatuses for public use in society are kept shall meet the needs of the normal operation of the apparatuses.

Article 15 (Personnel Taking Care of the Standard Metrological Apparatuses for Public Use in Society)

The standard metrological apparatuses for public use in society shall be kept, maintained and used under the charge of specially assigned personnel.

Article 16 (Legal Liability)

If the organ for the examination and determination of the metrologies or the metrologies technical organ violates Article 10 and Article 11 of these Procedures and fails to fulfil the relevant reporting system, the metrology administrative department shall order it to make corrections within a prescribed time limit.

Article 17 (Effective Date)

These Procedures shall be effective as of July 1, 1997.
