Procedures of Shanghai Municipality on Residence Registration for the Residents with Separated Registered and Actual Residences

Article 1 (Purposes)

These Procedures are formulated for the purpose of further promoting the construction of a service-oriented government, better facilitating development, safeguarding people's livelihood and standardizing residence registration for the residents in this Municipality with separated registered and actual residences to enjoy related livelihood services.

Article 2 (Scope of Application)

These Procedures shall apply to the residence registration and related public services, and the management activities for the residences with separated registered and actual residences in this Municipality within the administrative region of this Municipality.

Article 3 (Definition)

The term "residence" mentioned in these Procedures refers to the regular and legal place of daily life other than the registered household domicile.

The actual address for residence registration shall be subject to the standardized name of place, road name as well as the house number approved by public security department.

Article 4 (Residence Registration)

Residents whose actual residence is not in conformity with the household registration address in this Municipality shall apply for residence registration; if there are more than one residence, a habitual residence shall be chosen as the actual place for residence registration.

The residents with separated registered and actual residences in this Municipality that have applied for the residence registration and are in conformity with the related policy conditions may enjoy relevant public services in the place of residence.

Article 5 (Conditions for Residential Tenancy)

Where residents with separated registered and actual residences living in a rental house apply for residence registration, they shall conform to the relevant provisions of the Regulation of Shanghai Municipality on House Leasing and the Procedures of Shanghai Municipality on the Administration of Residential Tenancy.

Article 6 (Departmental Responsibilities)

The Municipal Development and Reform Commission shall be responsible for the comprehensive coordination of the implementation of these Procedures.

The Municipal Public Security Department shall be responsible for the residence registration and related management of the residents with separated registered and actual residences.

The Municipal Finance Bureau shall be responsible for studying and formulating financial allocation and safeguard mechanisms that match the population-oriented policies.

The Municipal Housing Administration shall be responsible for the supervision and administration of the residential tenancy of the residents with separated registered and actual residences in this Municipality.

Human resources, social security, health, education, civil affairs and other relevant municipal departments shall, in accordance with their respective functions and duties, study and formulate policies for residential registration to provide relevant public services, and do a good job in the relevant services and management.

Article 7 (Governmental Responsibilities)

District people's governments shall be responsible for the specific implementation of these Procedures within their administrative regions.

Sub-district offices and town/township people's governments shall be responsible for the implementation of the specific corresponding service issues within their administrative regions after the completion of residence registration of the residents with separated registered and actual residences in this Municipality.

Article 8 (Application)

Residents with separated registered and actual residences in this Municipality shall go to the sub-district, towns/township community affairs service center or through the platform of "Government Online-Offline Shanghai" of this Municipality to apply for a residence registration.

Article 9 (Required Materials)

The following materials shall be provided for residence registration of the residents with separated registered and actual residences in this Municipality:

1. Application Form for Residence Registration of the Residents with Separated Registered and Actual Residences in this Municipality;

2. Identity Card, Household Registration Book, Personal Household Registration Card or copy of the Individual Information Page of Collective Household Registration stamped with the seal of the personnel (or security) department of the unit, and other valid identity certificates;

3. Certificate of ownership of residential property, certificate of rental of public housing, and other valid property certificates, the house leasing registration certificate issued by the housing administrative department or collective dormitory certificate issued by the personnel (or security) department of the unit.

All kinds of application materials for residence registration provided by the residents with separated registered and actual residences in this Municipality shall be genuine and valid. Those who resort to deceit shall not be registered. Materials that can be obtained through data mutual recognition and sharing shall not be required to be provided repeatedly when the residents with separated registered and actual residences in this Municipality apply for residence registration.

Article 10 (Acceptance and Processing)

Community affairs service center shall, after receiving the application for residence registration, accept and process it on site as long as the materials are complete; if the materials are incomplete, the community affairs service center shall inform the applicant of the materials that need to be filled up and return the application materials to the applicant.

Article 11 (Certificate and the Period of Validity)

Community affairs service center shall, after receiving the application for residence registration, issue the "Residence registration certificate for residents with separated registered and actual residences in this Municipality" stamped with official seal for household registration when application is conformed to the requirements upon examination and verification.

The period of validity of the certificate is one year.

Article 12 (Electronic Certificate)

The Municipal Public Security Department shall be responsible for collecting the electronic certificate information of the "Residence registration certificate for residents with separated registered and actual residences in this Municipality" onto the platform of "Government Online-Offline Shanghai" of this Municipality. The residents with separated registered and actual residences have the right to use electronic certificates through the platform of "Government Online-Offline Shanghai" of this Municipality. The legal effect of electronic certificates is equivalent to that of physical certificates.

Article 13 (Replacement of Certificate)

If the "Residence registration certificate for residents with separated registered and actual residences in this Municipality" is damaged, illegible or lost within the period of validity, the residents with separated registered and actual residences in this Municipality shall apply for the replacement of certificate in the sub-district, town/township community affairs service center. Community affairs service center shall reissue the "Residence registration certificate for residents with separated registered and actual residences in this Municipality" stamped with official seal for household registration on site after identity verification. The period of validity shall start from the filing date of the original application.

Article 14 (Reissuance)

If the residents with separated registered and actual residences in this Municipality change residence after registration or the certificate expires, they shall go to the sub-district, town/township community affairs service center or through the platform of "Government Online-Offline Shanghai"of this Municipality to apply for a reissuance.

Article 15 (Cancellation)

Residents with separated registered and actual residences in this Municipality who move back to the household registration domicile, transfer their household registration to the place of residence or  cease to live in this Municipality shall go to the sub-district or town/township community affairs service center or through the platform of "Government Online-Offline Shanghai" of this Municipality, submit the Cancellation Application Form for Residence Registration of the Residents with Separated Registered and Actual Residences in this Municipality with valid identity documents for canceling the residence registration.

Where relevant departments discover and identify one of the following circumstances in the process of the work, they shall, within 5 working days, deliver report in writing to the police station at the locality of the residents with separated registered and actual residences in this Municipality, which shall request the community affairs service center to cancel the residence registration information:

1. The residents do not actually live in the registered residence after registration;

2. The residents provide false materials to obtain the residence registration;

3. The circumstances of the registrant have changed and no longer meet the registration requirements;

4. Or other circumstances as prescribed by laws, rules and regulations.

Article 16 (Remedies)

If there is any objection to the cancellation, the applicant may apply to relevant departments for review, which shall exercise a re-check If the residence status of the applicant is verified after re-check, the relevant departments shall, within 10 working days, deliver report to the police station at the locality of the resident, which shall request the community affairs service center to restore the canceled residence registration information.

Article 17 (Delegated Processing)

Residents with separated registered and actual residences in this Municipality can entrust others to apply for the registration, reissuance or cancellation of the "Residence registration certificate for residents with separated registered and actual residences in this Municipality". If the resident with separated registered and actual residences in this Municipality is a minor, it shall be handled by his or her legal guardian. When entrusting others to handle the process, a valid identification of the entrusted person and a letter of authorization should be provided. When the legal guardian handles the process, a valid identification of the legal guardian and a certificate of guardianship should be provided.

Article 18 (Obligations of Leaser)

The house leaser shall urge and cooperate with the residents with separated registered and actual residences in this Municipality in applying for the residence registration.

Article 19 (Responsibility of Integrated Community Management Team)

In carrying out the daily collection of basic information on the actual population and houses in the community, the integrated community management team shall inform the residents with separated registered and actual residences in this Municipality who have not registered for residence to go through with registration.

Article 20 (Information Sharing and Confidentiality)

This Municipality shall rely on the actual municipal population information management system, improve the mechanism of "Professional Collection, One-Stop Integration, Professional Maintenance, and Resource Sharing" and standardize the residence information management for the residents with separated registered and actual residences in this Municipality based on their ID numbers. Any unit or personnel who can get access to the information during the process of conducting residence registration or service management for residents with separated registered and actual residences in this Municipality shall keep it confidential and shall not illegally inquire, use, or disclose it.

Article 21 (Penalties for Violation)

Residents with separated registered and actual residences in this Municipality who provide false application materials or register for residence in non-actual dwelling place and defraud the public service items in the corresponding dwelling locality, shall be given administrative punishment by the relevant departments in accordance with provisions; where a crime is constituted, the offender shall be investigated for criminal liability according to law.

If the leaser rents the house to a person without identity documents, or fails to register the tenant’s name, type and number of identity documents as required, the public security department shall impose a punishment in accordance with relevant provisions of the Public Security Administration Punishment Law of the PRC.

If any violation of the Regulation of Shanghai Municipality on House Leasing and the Procedures of Shanghai Municipality on the Administration of Residential Tenancy is found in the process of residence registration, the housing administrative department shall impose punishment. State functionaries who, in violation of these Procedures, abuse their powers, neglect their duties, resort to deceit, engage in malpractices for selfish ends without constituting a crime shall be given administrative punishment; where a crime is constituted, the offender shall be investigated for criminal liability according to law.

Article 22 (Transition Provision)

"Receipt of residence registration for residents with separated registered and actual residences in this Municipality" issued prior to these Procedures shall remain valid till February 19, 2025. Residents with separated registered and actual residences in this Municipality shall apply for the exchange of "Residence registration certificate for residents with separated registered and actual residences in this Municipality" with "Receipt of residence registration for residents with separated registered and actual residences in this Municipality" or a valid identification at the sub-district, town/township community affairs service center. The validity of the exchanged certificate shall be until February 19, 2025.

Article 23 (Effective Date)

These Procedures shall be effective as of February 20, 2024. Notice of Shanghai Municipal People's Government on Issuing the Procedures of Shanghai Municipality on Residence Registration for the Residents with Separated Registered and Actual Residences (SMPG D [2019] No. 11) shall be annulled as of the same date.
