Procedures of Shanghai Municipality for the Administration of the Development and Construction of Changxing Island

(Promulgated by Decree No.12 of Shanghai Municipal People's Government on April 2, 2024; effective as of May 6, 2024)

Article 1 (Purposes and Basis)

With a view to promoting and standardizing the development and construction of Changxing Island, enhancing its marine economic strength and marine scientific and innovative capacity, and boosting the construction of a modern marine city and the high-quality marine economic development in this Municipality, these Procedures are formulated in accordance with relevant laws and rules, and in the light of the actual circumstances of this Municipality.

Article 2 (Basic Principals and Development Goals)

For the development and construction of Changxing Island, it is necessary to implement the national maritime power policy, follow the principles of harmonized development of key industries, infrastructure, urban construction, social amenities, and ecological protection, and promote the integrated construction of a marine economy development demonstration zone, Low-Carbon Changxing Island, and an internationally competitive manufacturing base of shipbuilding and marine engineering equipment.

Article 3 (Responsibilities of the Administrative Committee)

The Municipal People's Government shall establish the Administrative Committee for the Development and Construction of Changxing Island (hereinafter referred to as the Committee) as its dispatched agency, which shall coordinate and promote the various tasks required in the development and construction of Changxing Island, and shall perform the following specific duties:

1. organizing the preparation and implementation of the development planning and scheme for Changxing Island;

2. organizing the preparation of the overall territorial space planning for Changxing Town, and of the detailed regulatory planning, relevant special planning, and annual planning for the utilization of territorial resources for Changxing Island.

3. coordinating to promote the construction of major investment projects on Changxing Island;

4. taking charge of the examination and approval, verification and authorization, energy-saving review, and record-filing of relevant investment projects, and of the examination and approval of land reserve projects on Changxing Island;

5. accepting the entrustment of relevant departments, taking charge of the administrative license, filing for records, and other management work related to the development and construction of Changxing Island;

6. coordinating the utilization and management of funds for the development and construction of Changxing Island;

7. preparing the industrial development planning and industry catalogue of Changxing Island, providing overall guidance on the industrial layout and functional cultivation of Changxing Island, and promoting the integrated development of industries and the town;

8. coordinating to implement various construction tasks assigned to Changxing Island by the State; 

9. and other duties assigned by the Municipal People's Government.

Article 4 (Responsibilities of Departments and Regions)

Relevant municipal administrative departments of development and reform, economy and informatization, housing and urban-rural development management, transport, planning and natural resources, ecology and environment, water affairs (marine), science and technology, and finance shall, in accordance with their respective responsibilities, support and guide the development and construction of Changxing Island.

The Chongming District People's Government, its relevant departments, and Changxing Town People’s Government shall strengthen cooperation with the Administrative Committee, and undertake other administrative affairs according to their respective responsibilities.

Article 5 (Planning Preparation)

The Committee, jointly with Chongming District People's Government and the municipal administrative department of planning and natural resources, shall, in accordance with the national economic and social development planning and the overall territorial space planning, prepare an overall territorial space planning for Changxing Town and organize its implementation upon its submission to and approval by the Municipal People's Government.

The Committee, jointly with the municipal administrative department of planning and natural resources, shall, in accordance with the overall territorial space planning for Changxing Town and in light of the actual circumstances of the economic and social development in this region, prepare a detailed regulatory planning for Changxing Island and organize its implementation upon its submission to and approval by the Municipal People's Government.

The Committee shall, jointly with Chongming District People's Government and competent administrative departments in charge, prepare special planning for ecological space, comprehensive transportation, and urban landscape of Changxing Island, and organize its implementation upon its submission to and approval by the Municipal People's Government.

Changxing Town People's Government shall, jointly with relevant departments of Chongming District, organize the preparation of rural unit village planning for Changxing Town, and organize its implementation upon its submission to and approval by Chongming District People’s Government, which shall solicit opinions from the Committee when approving the rural unit village planning for Changxing Town.

Article 6 (Directions and Priorities of Industrial Development)

The Committee, jointly with Chongming District People's Government, and municipal administrative departments of economy and informatization, and development and reform, shall, in accordance with relevant industrial development planning of the State and this Municipality and requirements for green and low-carbon development, study and determine the directions and priorities of industrial development of Changxing Island, and establish specific access standards for industrial projects.

Chongming District shall provide industrial projects that meet the access standards with support in aspects of planning and construction, land use quota, favorable policies, and social programs.

Article 7 (The Development of the Marine Economy)

This Municipality shall accelerate the construction of a modern marine city, support the construction of the marine economy demonstration zone of Changxing Island, and shall innovate the development model of the marine engineering equipment industry and the investment and financing system for the marine industry.

The Committee shall, jointly with the municipal administrative department of economy and informatization and other departments, etc., raise the level of integrated industries, promote the development of advanced marine manufacturing industries on Changxing Island, including high-tech ships, high-end marine engineering equipment, and their core supporting facilities, and guide the innovative development of the entire industrial chain for the research and development, supporting assembly, and operation and maintenance services of the ship and marine engineering equipment.

The municipal development & reform department shall, jointly with relevant departments of the Municipal People's Government, explore the establishment of marine industrial funds to support Changxing Island's construction of a marine economy development demonstration zone and an internationally competitive manufacturing base of shipbuilding and marine engineering equipment.

Article 8 (The Improvement of the Marine Science and Technology Innovation Capacity)

The Committee shall coordinate and guarantee the construction and operation of major scientific and technological infrastructures of Changxing Island, strengthen collaborative innovation in science and technology, and promote the establishment of a national technology innovation center for marine equipment.

The Committee shall, jointly with the municipal departments of science and technology and education, support higher-learning institutions and scientific research institutes in establishing branches and laboratories on Changxing Island, guide higher-learning institutions, scientific research institutes, and relevant corporations on Changxing Island to carry out technical capacity cooperation in research and development, application, and service in fields of shipbuilding and marine engineering so as to promote the transformation of marine science and technology achievements.

The Committee shall, jointly with the municipal departments of economy and informatization and science and technology, support the construction of marine industry incubators on Changxing Island to promote the development of small and medium-sized marine technology enterprises.

Article 9 (The Construction of Green Urban Areas)

The Committee shall, jointly with the Chongming District People's Government, the municipal housing and urban-rural development management department, and other relevant departments, coordinate to promote the construction of green ecological urban areas, sponge cities, and green buildings to raise green levels of municipal infrastructure, commercial service facilities, and cultural and sports facilities on Changxing Island.

Article 10 (Ecological Environment Protection)

The development and construction of Changxing Island shall strictly comply with the controlling requirements of the ecological protection red line, and shall, in accordance with the laws, rules, and relevant provisions on environmental protection, prevent and control various types of pollution caused by industrial and agricultural production and daily life, and protect the drinking water sources and ecological safety of Changxing Island.

Article 11 (Integration of Industry and City)

The Committee shall strengthen communication with relevant departments of the Municipal People's Government and Chongming District People's Government, and with Changxing Town People's Government to coordinate the construction of facilities for education, medical care, culture, sports, and elderly care, raise the level of public services, facilitate the high-quality and balanced development of public services, and promote the integration of production, ecology, and living.

Article 12 (Preliminary Development and Land Acquisition)

The Committee shall, in accordance with the overall territorial space planning for Changxing Town and the detailed regulatory planning for Changxing Island, formulate an annual planning for the utilization of territorial resources, implement the planning after authorization, and simultaneously organize the preliminary construction of supporting infrastructure.

The house and land acquisition involved in the development and construction of Changxing Island shall be carried out by the Chongming District People's Government.

Article 13 (Entrustment and Implementation of Administrative Permits)

Entrusted by relevant departments of the Municipal People's Government and Chongming District People's Government, the Committee shall implement the following items that require administrative permits:

1. permits for the land use, planning, and acceptance check of resource distribution of the construction project commissioned by the planning and natural resources department;

2. building permits for construction projects commissioned by the housing and urban-rural development administrative department;

3. permits for the construction of municipal facilities commissioned by the transportation department;

4. permits for tree relocation and felling commissioned by the landscaping and city appearance department;

5. relevant permits for the hydraulic infrastructure construction projects of hydraulic engineering commissioned by the water affairs department;

6. permits for the delivery and use of newly-built residential housing commissioned by the housing management department; 

7. and permits for civil building projects that require the construction of air-defense basements commissioned by the national defense mobilization department.

When entrusting the Committee to provide the administrative permits prescribed in the preceding subparagraphs, the relevant departments shall make it clear in the form of an entrustment letter. The entrusting department and the Committee shall make the entrusted matters public.

Article 14 (Construction Project Management)

For construction projects initiated by the Committee, the Committee is responsible for their information submission, bidding, quality and safety supervision, record-filing for the acceptance check upon completion, and the acceptance check or record-filing for the fire protection examination.

In accordance with the principle of hierarchical and categorized management, relevant departments of the Municipal People's Government and Chongming District People's Governments shall be responsible for the aforesaid work of other construction projects on Changxing Island.

Article 15 (Fund Support)

Where financial funds are needed to support the development and construction of Changxing Island, the Municipal Development & Reform Department shall, jointly with the municipal finance department and the Committee, put forward a fund use scheme and organize its implementation upon its submission to and approval by the Municipal People's Government.

The Committee and the municipal departments of development and reform, and finance shall leverage the role of government investment funds to guide and stimulate investment, and encourage the participation of social funds in the development and construction of Changxing Island.

Article 16 (Personnel Support)

Higher-learning institutions and scientific research institutes shall be encouraged to cooperate with relevant enterprises in Changxing Island to develop higher vocational education, establish demonstration bases for the integration of industry and education, and to cooperate in advancing personnel training in marine engineering equipment and other fields.

For urgently needed talented personnel who meet the functional positioning and industrial development direction of Changxing Island, the municipal departments of human resources, development and reform, public security, education, and housing management shall, in accordance with relevant provisions, provide them with services and conveniences including residence, exit and entry, work permits in China, permanent residence, and housing services.

Article 17 (Communication and Collaboration in Law Enforcement Cooperation)

Any illegal acts discovered by the Committed in its performance of duties shall be promptly reported to the relevant competent departments, which shall handle the matter in accordance with the law.

When taking administrative actions such as administrative permits and administrative punishment related to the development and construction of Changxing Island, relevant departments of the Municipal People's Government, Chongming District People's Government and its relevant departments, and Changxing Town People's Government shall strengthen the sharing of relevant law enforcement information with the Committee.

Where relevant departments of the Municipal People's Government, Chongming District People's Government and its relevant departments, and Changxing Town People's Government need the cooperation of the Committee while conducting administrative law enforcement on Changxing Island according to law, the Committee shall cooperate.

Article 18 (Effective Date)

These Procedures shall be effective as of May 6, 2024. The Procedures of Shanghai Municipality on the Administration of the Development and Construction of Changxing Island promulgated by Decree No. 7 of Shanghai Municipal People's Government on September 23, 2008 shall be abolished simultaneously.
