Administrative Measures for Shanghai Municipal Counterpart Funding for the National Major Science and Technology Projects

Article 1 (Purposes and Basis)

With a view to accelerating the development of Shanghai as an international science and technology innovation center, encouraging the Shanghai-based units to actively undertake the national science and technology projects, regulating the management of the municipal counterpart funding, and ensuring their smooth implementation, these Measures are formulated in accordance with the relevant national provisions governing the management of the national major science and technology projects and the relevant provisions of this Municipality on the fiscal funds for the science and technology project.

Article 2 (Source of Counterpart Funds)

The municipal counterpart funds for the national major science and technology projects (hereinafter referred to as the "counterpart funds") shall be appropriated from the municipal fiscal budget.

The counterpart funds shall be primarily used to support the Shanghai-based units that lead the undertaking of the national major science and technology projects (hereinafter referred to as the "leading project undertaking units").

Article 3 (Application Scope of Counterpart Funds)

The national major science and technology projects applicable under these Measures include the national science and technology major projects, national key R&D projects, and the major and key projects of the national natural science foundation of China, and the others.

Article 4 (Mechanism of Counterpart Funds)

This Municipality shall establish a promotion mechanism for reviewing the counterpart funds for the national major science and technology projects, which shall be jointly advanced by the Municipal Commission of Science and Technology with the Municipal Bureau of Finance, and the Municipal Development and Reform Commission. The Municipal Commission of Science and Technology shall be responsible for the routine acceptance work.

The municipal departments responsible for the national major science and technology projects (hereinafter referred to as the "municipal responsible departments") refers to the municipal governmental departments that issue the recommendation letters for the Shanghai-based units applying for such projects in accordance with the national application guidelines or the relevant documents. These departments include the Municipal Commission of Science and Technology, the Municipal Development and Reform Commission, the Municipal Commission of Economy and Informatization, the Municipal Bureau of Ecology and Environment, the Municipal Commission of Housing and Urban-Rural Development, the Municipal Commission of Transport, the Municipal Commission of Agriculture and Rural Affairs, the Municipal Water Authority (Shanghai Municipal Oceanic Bureau), the Municipal Administration of Culture and Tourism, the Municipal Commission of Health (the Municipal Administration of Traditional Chinese Medicine), the Municipal Bureau of Emergency Management, the Municipal Administration for Market Regulation, the Municipal Center for Disease Control and Prevention, and the others.

For the national projects applied for independently by the Shanghai-based units or recommended by the units in the other provinces or municipalities, the Municipal Commission of Science and Technology may serve as the municipal responsible department.

Article 5 (Administrative Responsibilities for Counterpart Funds)

The Municipal Commission of Science and Technology shall be responsible for formulating the annual budgets for the counterpart funds, conducting daily supervision of their utilization, and evaluation of their performance.

The Municipal Bureau of Finance shall be responsible for the budget review, funds allocation, and oversight over the use of the counterpart funds.

The municipal responsible departments shall be responsible for the application management and daily implementation of the counterpart funds for the national major science and technology projects undertaken by the Shanghai-based units.

Article 6 (Supporting Methods of Counterpart Funding)

The methods of counterpart funding such as the pre-funding and results-based funding shall be adopted in accordance with the requirements for the organization and implementation of the national major science and technology projects and the specific features of such projects. The counterpart funds shall be subject to the method of a one-time approval, with disbursements made in phases.

Article 7 (Counterpart Funding Principles)

The counterpart funds shall be allocated to the leading project undertaking units in accordance with the following principles:

1. For the leading project undertaking units of the national major science and technology projects, etc., where the national application guidelines or the relevant documents do not specify the counterpart funding requirements or ratios for the local governments, the counterpart funds shall be allocated to them at the ratio of 20% of the actual national funding received (after deducting the portions transferred to the non-Shanghai units). For the leading project undertaking units of the national key R&D projects, major and key projects of the national natural science foundation of China, etc., the counterpart funds shall be allocated to them at the ratio of 10% of the actual national funding received (after deducting the portions transferred to the non-Shanghai units).

2. For the projects requiring the financial support beyond the existing ratios due to their special circumstances, or for the projects where the national application guidelines or the relevant instruments specify the explicit counterpart funding requirements or ratios for the local governments, the counterpart funds shall be determined on a case-by-case basis. The municipal responsible departments shall propose the counterpart funding plans, which shall be implemented upon review by the Municipal Commission of Science and Technology together with the Municipal Bureau of Finance and the Municipal Development and Reform Commission, and the subsequent approval by the Municipal People's Government .

Article 8 (Counterpart Funding Commitment)

Where local counterpart funding commitment letters are required by the national application guidelines or the relevant documents, the municipal responsible departments shall review the counterpart funding plans proposed by the leading project undertaking units, and draft the counterpart funding commitment letters. These commitment letters shall be filed with the Municipal Commission of Science and Technology, and subsequently, the counterpart funding commitment letters shall be issued to the relevant national departments (or agencies).

Article 9 (Filing of Counterpart Funds)

Upon receiving the official project establishment approval from the relevant national departments (or agencies), the municipal responsible departments shall file the project approval status to the Municipal Commission of Science and Technology. The counterpart funds shall be incorporated into the unified management of the Shanghai Science and Technology Management Information System.

Article 10 (Annual Budget for Counterpart Funds)

The Municipal Commission of Science and Technology shall formulate an annual fund allocation plan on the basis of the actual national funding received by the leading project undertaking units, and submit it to the Municipal Bureau of Finance. Upon review and approval by the Municipal Bureau of Finance, the fund allocation plan shall be incorporated into the annual budget in accordance with the prescribed procedures.

Article 11 (Application for Counterpart Funds)

Applications for Counterpart Funds shall be accepted throughout the year. The Municipal Commission of Science and Technology shall entrust the third-party institutions with the acceptance of these applications.

1. For the projects that meet the provision of Item 1 of Article 7 of these Measures, the leading project undertaking units shall, after the national projects are approved and in accordance with the national fund disbursement schedule, submit the following documents online via the Municipal Science and Technology Information Management System: the project approval documents issued by the relevant national departments or agencies, contracts, task statements (including the budget tables and detailed expenditure budgets), fund disbursement notices, bank receipt confirmations, project implementation progress reports, and the reports of significant achievements.

2. For the projects approved on a case-by-case basis by the Municipal People's Government, the leading project undertaking units shall submit the application materials to the municipal responsible departments, which shall, after review, submit the relevant materials to the Municipal Commission of Science and Technology.

Article 12 (Review and Allocation of Counterpart Funds)

The Municipal Science and Technology Commission shall entrust the third-party institutions to conduct preliminary reviews of the application materials submitted online and determine the proposed counterpart funds. For the projects approved on a case-by-case basis, the municipal responsible departments shall review the application materials. On the basis of the preliminary reviews by the third-party institutions, and of the review results from the municipal responsible departments, the Municipal Commission of Science and Technology, together with the Municipal Bureau of Finance and the Municipal Development and Reform Commission, shall finalize the total budget amounts for the counterpart funds.

The Municipal Bureau of Finance shall allocate the counterpart funds on the basis of the review results and in accordance with the relevant provisions on the fiscal funds payment management.

Article 13 (Utilization of Counterpart Funds)

The counterpart funds shall be allocated and utilized strictly in accordance with the relevant national and municipal provisions on the budget and fiscal funding management. These funds shall be subject to separate accounting and utilized exclusively for the designated purposes, thereby enhancing the fund utilization efficiency. The counterpart funds shall be primarily utilized for the research activity expenditures incurred during the projects' implementation in Shanghai. The leading project undertaking units shall be responsible for reviewing the budgets of the counterpart funds to ensure that the scopes and standards of expenses align with the contracts and the task statements. Any expenditure beyond the stipulated scopes or standards shall be strictly prohibited.

Article 14 (Management of Outcomes from Counterpart Funds)

To enhance the efficiency of the fiscal funding, the leading project undertaking units shall be responsible for the collection and aggregation, management, application and transformation of the projects-based scientific and technological achievements. They shall report regularly to the municipal responsible departments on the acquisition of the intellectual property rights and the status of the transformation and application of such achievements. The municipal responsible departments shall strengthen the tracking and management for the projects-based scientific and technological achievements, and conduct evaluations of the effectiveness of the transformation and application within three years after completion of the projects.

Article 15 (Regulation of Counterpart Funds)

In the event of projects modification, termination, or cancellation, the leading project undertaking units shall follow the procedures in accordance with the relevant national provisions and report promptly to the municipal responsible departments. The municipal responsible departments shall be responsible for the daily supervision and inspection of the counterpart funds. The Municipal Commission of Science and Technology shall provide guidance and conduct evaluations regarding project implementation and the utilization of the counterpart funds.

In the event that the leading project undertaking units are found to have engaged in falsification or violation of the provisions in the application, utilization, or management of the counterpart funds, the fund disbursement shall be terminated upon verification. The municipal responsible departments shall be responsible for recovering the allocated funds. In cases of severe violations, the personnel involved shall be liable in accordance with the relevant national provisions.

Article 16 (Implementation Date)

These Measures shall be effective as of November 1, 2025, and remain valid until October 31, 2030.
