Chapter I General Provisions
Article 1
With a view to ensuring that deputies to the People's Congresses at various levels of this Municipality exercise and fulfill their rights and duties as deputies and play their roles thereof in accordance with law, these Measures are formulated in accordance with the provisions of the Law of the People's Republic of China on Deputies to the National People's Congress and the Local People's Congresses at Various Levels, and in the light of the actual circumstances of this Municipality.
Article 2
Deputies to the People's Congresses at various levels of this Municipality shall be elected in accordance with law and shall be constituent members of organs of state power at various levels.
Deputies to the People's Congresses at various levels of this Municipality shall serve a term of five years. Their term of office shall begin at the first session of the corresponding People's Congress and end at the first session of the succeeding People's Congress at the same level.
Article 3
Deputies to the People's Congresses at various levels of this Municipality shall uphold the leadership of the Communist Party of China, take Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the Theory of Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as their guide, unswervingly follow the path of socialist political development with Chinese characteristics, act in accordance with the functions and powers of the People's Congresses at the corresponding levels as vested in them by the Constitution and laws, adhere to the principle of democratic centralism, and participate in the exercise of state power.
Article 4
Deputies to the People's Congresses at various levels of this Municipality shall take effectively upholding, improving, and operating well the system of People's Congresses as their bounden duty. They shall be politically firm, serve the people, uphold the rule of law, promote democracy, and be diligent and responsible. They shall actively perform their duties to build the People's Congresses and their Standing Committees at various levels into political organs that consciously uphold the leadership of the Communist Party of China, organs of state power that ensure the people are masters of the country, working organs that fully perform all functions and duties vested in them by the Constitution and laws, and representative organs that always maintain close ties with the people.
Article 5
Deputies to the People's Congresses at various levels of this Municipality shall adhere to the people-centered principle, practice whole-process people's democracy, maintain close ties with the people at all times, faithfully represent the interests and will of the people, and willingly accept the oversight of the people.
Article 6
Deputies to the People's Congresses at various all levels of this Municipality shall be loyal to the Constitution, champion the spirit of the Constitution, safeguard the authority of the Constitution, uphold the unity and dignity of the socialist legal system, and contribute to advancing comprehensive law-based governance on all fronts and building a higher-level socialist country under the rule of law.
Article 7
Deputies shall be entitled to the following rights:
1. attending sessions of their respective Congress, participating in the deliberation of various bills, reports and other topics, and expressing opinions thereon;
2. submitting jointly signed bills, and proposing inquiries and removals in accordance with law;
3. making suggestions, raising criticisms and expressing opinions with regard to different aspects of the work;
4. participating in the various elections of their respective Congress;
5. voting on various matters submitted by their respective Congress;
6. participating in unified activities for the performance of their duties organized during the intersessional period of the People's Congress at the corresponding level;
7. accessing information necessary for the due performance of their duties as deputies, and enjoying the various protections in connection therewith; and
8. other rights provided by laws and regulations.
Article 8
Deputies shall perform the following duties:
1. abiding by the Constitution, laws and regulations in an exemplary manner, keeping state secrets, and helping implement the Constitution, laws and regulations in their production-related, professional and social activities.
2. attending sessions of the People's Congresses at the corresponding levels on time, earnestly deliberating on all bills and proposals, reports and other issues, putting forward opinions, participating in elections and voting, observing meeting discipline, and accomplishing all work during the sessions;
3. taking the lead in publicizing and implementing the spirit of the sessions of the People's Congresses at the corresponding levels;
4. actively participating in uniformly organized duty performance activities such as inspections, special research and law-enforcement inspections;
5. strengthening study and research for duty performance, and constantly improving the ability to perform their duties;
6. maintaining close contact with voters of their original electoral districts or units and the people, listening to and conveying their opinions and demands, and striving to serve the people;
7. taking the lead in practicing the Core Socialist Values, forging a strong sense of community for the Chinese nation, conscientiously observing social ethics, practicing integrity and self-discipline, being fair and upright, and diligent and responsible; and
8. other duties as prescribed by laws and regulations.
Article 9
Deputies' work during sessions of the People's Congresses at the corresponding levels and their activities during the intersessional period thereof, when carried out in accordance with law, shall constitute the performance of their duties as deputies.
State organs, social organizations, enterprises and public institutions in this Municipality shall provide necessary support and institutional guarantees for deputies to execute their official duties.
Deputies shall not be divorced from their respective production endeavors or work. When attending sessions of the People's Congress at their corresponding level and participating in duty performance activities organized uniformly during the intersessional period, deputies shall make proper arrangements for their own production and work, and give priority to performing their duties as deputies.
Article 10
Deputies shall be subject to the supervision of the voters of the original electoral districts or units.
Article 11
The Standing Committees of the Municipal and District People's Congresses as well as the Presidium of the Township and Town People's Congresses shall maintain close contact with their deputies, enrich the content and forms of deputies' contact with the people, strengthen deputies' working capacity building, support and guarantee deputies' performance of their duties in accordance with law, and give full play to the role of deputies.
The People's Governments, Supervision Commissions, People's Courts, and People's Procuratorates at various levels of this Municipality shall strengthen their contact with deputies, listen to their opinions and suggestions, and strengthen and improve work in all areas.
Article 12
The Standing Committees of the Municipal and District People's Congresses shall establish deputy work committees as their working bodies.
Chapter II Deputies' Work During Sessions of the People's Congress at the Corresponding Level
Article 13
Deputies shall attend sessions of the People's Congress at the corresponding level on time. Where a deputy is unable to attend a session due to special reasons such as health problems, the deputy shall ask for leave in accordance with relevant provisions.
Article 14
Before attending a session of their respective People's Congress, the deputies shall listen to the opinions and demands of the voters of their original electoral districts or units and the people through various ways, and shall, in accordance with the arrangements, carefully study the bills, proposals and reports to be submitted to the session for deliberation and be well prepared for the performance of their duties during the session.
Article 15
Deputies to the Municipal and District People's Congresses shall form delegations according to electoral units and administrative regions, among others. Deputies to Township and Town People's Congresses may form delegations in light of actual needs.
Under the organization and arrangement of the Presidium of the Congresses and the delegations, deputies shall attend plenary sessions of the Congress, plenary sessions of their delegations, group meetings, and specific-subject deliberations, and shall deliberate on the various bills, reports and other items listed on the agenda.
Deputies may be elected or invited to attend, as non-voting members, the meetings of the Presidium, the meetings of special committees, and to give opinions.
Deputies shall present their opinions on the subject matters of the meetings and abide by the rules of procedure.
Article 16
Deputies to the Municipal and District People's Congresses shall have the right, through a joint proposal signed by 10 or more deputies, to submit to the People's Congress at the corresponding level bills that fall within the scope of its functions and powers. Deputies to Township and Town People's Congresses shall have the right, through a joint proposal signed by five or more deputies, to submit bills that fall within the scope of the functions and powers of the People's Congress at the corresponding level. The bills submitted by the deputies shall be handled in accordance with relevant provisions.
Article 17
Deputies to the Municipal or District People's Congresses shall, through a joint proposal signed by 10 or more deputies, and deputies to Township or Town People's Congresses shall, through a joint proposal signed by five or more deputies, have the right to submit in writing amendments to bills listed on the agenda of the session or to draft resolutions ready to be submitted to the Congress for a vote, in accordance with relevant provisions. The Presidium shall decide whether to submit the amendments to the delegations for deliberation and to the Congress for a vote.
Article 18
Deputies who seek permission to speak at a plenary meeting of deliberation shall submit a request to the Secretariat of the Congress before deliberation begins. The Executive Chairman of the Congress shall decide who will speak and in what sequence.
Deputies who seek permission to make an impromptu speech at a plenary meeting of deliberation may speak only upon the approval by the Executive Chairman of the Congress.
Article 19
Deputies shall have the right to duly express their opinions about the candidates when they participate in the various elections of their respective People's Congress.
Deputies to the Municipal People's Congress shall, through a joint proposal signed by 30 or more deputies, and deputies to the District People's Congress may, through a joint proposal signed by 10 or more deputies, have the right to propose candidates for the composition of the Standing Committee of the People's Congress at the corresponding level, leading members of the People's Government, the Director of the Supervision Commission, the President of the People's Court, and the Chief Procurator of the People's Procuratorate.
Deputies to the Municipal and District People's Congresses shall have the right, through a joint proposal signed by 10 or more deputies, to propose candidates for the deputies to the People's Congresses at the next higher level.
Deputies to the Township and Town People's Congresses shall have the right to, through a joint proposal signed by 10 or more deputies, to propose candidates for the Chairman and Vice-chairman of their respective People's Congress and candidates for leaders of their respective People's Government.
Deputies to the People's Congresses at various levels in this Municipality shall have the right to express their opinions about the candidates for the Presidium of their respective People's Congress.
Before the election day, at the request of the deputies, the Presidium may arrange a meeting or a panel discussion between the deputies and the officially recommended candidates for leading positions of the respective state organs.
A deputy may vote for, vote against, or abstain from voting for the officially recommended candidates; those who vote against may vote for another candidate.
Article 20
Deputies to the Municipal or District People's Congresses shall participate in voting to elect members of all special committees of their respective People's Congress.
Article 21
Deputies may present questions orally or in writing to the respective relevant state organs when they deliberate on bills and reports. Such state organs shall send persons in charge or other persons responsible authorized thereby to answer the questions when the Congress is in session. If a question involves complicated problems, upon request from the state organ in question and approval thereof by the Presidium or relevant delegation, it may be answered within two months after the adjournment of the session.
Article 22
Deputies to the Municipal or District People's Congresses shall have the right, through a joint proposal signed by 10 or more deputies, to submit written inquiries against the People's Government at the corresponding level and its constituent departments, the Supervision Commission, the People's Court and the People's Procuratorate. Deputies to the Township or Town People's Congress shall have the right, through a joint proposal signed by 10 or more deputies, to submit written inquiries against the People's Government at the corresponding level. The written inquiries shall clearly specify the objects to be inquired, and the issues and contents of the inquiries.
The person-in-charge of the questioned organ shall, in accordance with the decision of the Presidium, respond to the inquiry orally or in writing at a presidium or plenary meeting, or at a meeting of the relevant special committee.
In the event that, prior to the Presidium's decision on an inquiry, a written request to withdraw the inquiry is submitted by deputies who proposed it, creating a shortfall from the required quorum, deliberation on the said inquiry at the meeting shall be terminated upon approval by the Presidium. When the person in charge of the questioned organ responds to the inquiry questions at a presidium or special committee meeting, the deputies who submitted such an inquiry shall have the right to attend the meeting and express their opinions as non-voting members.
When a majority of the deputies who proposed such an inquiry are dissatisfied with the response, they may request a further response, and the Presidium shall forward such a request to the relevant state organ for an additional reply.
With respect to an inquiry submitted by deputies to the Municipal or District People's Congresses, if the targeted state organ thinks that the questions raised in the inquiry are too complex to be adequately addressed during the session, or if the majority of those who proposed the inquiry remain dissatisfied with the subsequent reply, upon the decision of the Presidium, the person in charge of the questioned organ may provide a reply within two months after the adjournment of the session, at a meeting of the Standing Committee or the relevant special committee of the People's Congress. The deputies who submitted such an inquiry shall have the right to attend such a meeting and express their opinions as non-voting members. The Standing Committee of the People's Congress may, based on the response and the opinions of the deputies, make a decision when necessary.
Article 23
Deputies to the Municipal or District People's Congresses shall have the right, through a joint proposal signed by more than onetenth of the deputies, to submit requests for the removal of members of the Standing Committee of the People's Congress, members of the People's Government, the Chairperson of the Supervision Commission, President of People's Court, Prosecutor-general of the People's Procuratorate at the corresponding levels, and deputies to the People's Congress at the next higher level elected by the People's Congress at the corresponding level, in accordance with the procedures prescribed by law.
Deputies to the Township or Town People's Congress shall have the right, through a joint proposal signed by more than onefifth of the deputies, to submit requests for the removal of the Chairman and Vice-chairman of the respective People's Congress and the leaders of the respective People's Government, in accordance with the procedures prescribed by law.
In proposing a request for removal, the deputies shall state the reasons therefor and provide relevant materials.
The request for removal submitted to the Municipal or District People's Congresses, after being presented by the Presidium to the meetings for deliberation, shall be subjected to a voting at a plenary meeting of the Congress. Or, as an alternative, upon the proposal of the Presidium and by the decision of a plenary meeting of the Congress, an investigation committee shall be set up, and the request shall be submitted to the next session of the respective People's Congress for deliberation on the basis of the report of the investigation committee.
Article 24
Deputies to the Municipal or District People's Congress shall have the right, through a joint proposal in writing signed by more than one-tenth of the deputies, to propose to the People's Congress at the corresponding level the establishment of an investigation committee on a specific issue in accordance with law. Such proposals shall then be submitted by the Presidium to the plenary session of the Congress for decision.
Members of the investigation committees shall be nominated by the Presidium from among the deputies to the respective People's Congress, and be approved at a plenary meeting of the Congress.
Article 25
Deputies may express approval, opposition, or abstention when participating in voting at the People's Congress at the corresponding level.
Article 26
Deputies shall have the right to give suggestions, criticisms and opinions to their respective People's Congress with regard to different aspects of the work. Such suggestions, criticisms and opinions shall be handled in accordance with relevant provisions.
Chapter III Deputy Activities During the Intersessional Period of the People's Congress at the Corresponding Level
Article 27
The Standing Committees of the Municipal and District People's Congresses shall organize activities of their respective deputies between sessions.
When authorized by the Standing Committee of a People's Congress at the next higher level, the Standing Committees of the Municipal and District People's Congresses shall arrange intersessional activities for the deputies elected to that higher-level Congress.
The Chairmen and Vice-chairmen of the Township and Town People's Congresses shall, as arranged by their respective Presidium, organize the intersessional activities for deputies to the People's Congresses at the corresponding level.
Article 28
Deputies' intersessional activities shall be carried out mainly on a collective basis, with group activities as the basic form. Deputies may listen to and convey the opinions and demands of the voters of their original electoral districts or units through various ways.
Deputies to the Municipal or District People's Congresses may, under the organization or assistance of the Standing Committees of the People's Congresses at the corresponding level, form deputy groups in accordance with the principle of facilitating organization and activities, based on geographic location, field of work, or other criteria.
Deputies to the Township and Town People's Congresses shall, under the organization or assistance of the Presidium of the People's Congress at the corresponding level, form deputy groups to maintain contact with voters on the basis of a division of responsibilities, listening to and conveying the opinions and demands of the people.
A deputy shall join deputy groups that consist of deputies to the same People's Congress and participate in its activities, and deputies to the Municipal or District People's Congresses may also participate in the group activities of the subordinate-level People's Congress.
Each deputy group shall elect one to three deputies as its conveners. The conveners of the groups shall be responsible for preparing the annual activity plans and for carrying out group activities.
The annual activity plan of a deputy group shall specify the frequency, form, and content of its activities in accordance with the arrangements made by the relevant deputy affairs department of the Standing Committee of the People's Congress at the corresponding level or by the Presidium of the Township or Town People's Congress.
Article 29
Deputy groups may carry out the following activities:
1. studying the Constitution, laws, and regulations, as well as resolutions and decisions of the respective and the superior-level People's Congresses and of their Standing Committees;
2. investigating and researching the economic and social development as well as the implementation of laws and regulations in their respective administrative region;
3. collecting, researching and reporting the opinions and demands of the people;
4. discussing and improving the bills, suggestions, criticisms and opinions to be proposed by the deputies, and following up on the handling and implementing thereof;
5. comparing notes with other deputies with regard to the deputies' performance of duty; and
6. participating in other deputy activities that are in compliance with relevant provisions of laws and regulations.
Article 30
In accordance with the principle of conducting activities locally and nearby, the Standing Committees of the Municipal and District People's Congresses as well as the Presidium of the Township and Town People's Congresses shall, through People's Congresses' grassroots practice stations for the implementation of the whole-process people's democracy, deputies' platforms for maintaining contact with the people, and other channels, regularly organize and assist deputies within their administrative regions in carrying out activities to maintain contact with the people, and listen to and convey the opinions and demands of the people.
Article 31
Deputies to the Municipal or District People's Congresses shall inspect the work of the respective state organs, organizations and departments as well as those at the subordinate level in accordance with the uniform arrangement of the Standing Committees of the respective People's Congresses.
Deputies to the Township and Town People's Congresses shall inspect the work of the respective People's Government and relevant departments in accordance with the arrangement of their respective Presidium. In accordance with the arrangements, deputies to the Municipal People's Congress may also conduct inspection across their respective electoral units within their respective administrative region.
For an inspection in accordance with the preceding Paragraph, a deputy may submit a prior request for an interview with the leader(s) of a relevant same-level or subordinate-level state organ. The administrative or executive office of the Standing Committee of the respective Municipal or District People's Congress or the Presidium of the respective Township and Town People's Congress shall arrange such interview. The leader(s) of the relevant state organ or authorized person thereof shall listen to the suggestions, criticisms, and opinions of the deputy, and give the deputy timely feedbacks.
When a deputy inspects in his/her own administrative region upon showing his/her deputy certificate, upon the request of the deputy or his/her deputy group, the Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congress shall make necessary arrangements.
Article 32
Deputies shall, in accordance with the uniform arrangement of the Standing Committee of the respective People's Congress or the Presidium of the respective Township and Town People's Congress, carry out special investigations on major issues and major matters of public concern involving the economic and social development of their administrative regions and the immediate interests of the people, as well as on the key work of the Standing Committee of the People's Congress at the corresponding level. In accordance with the arrangements, deputies to the Municipal People's Congress may also carry out special investigations across their respective electoral units within their respective administrative region.
Article 33
When participating in the inspection or special investigations, a deputy may, through such means as on-site observation, group discussions with the public, and individual conversations, learn about the situation, and listen to their opinions and demands, and may submit suggestions, criticisms, and opinions to the relevant organs and organizations, but shall not directly handle the issues.
The relevant organs and organizations shall properly receive the deputies, make truthful representations, provide relevant materials, and listen to their suggestions, criticisms and opinions.
The inspection or investigation report resulting from an inspection or special investigation conducted under the uniform arrangement shall be handed over, by the administrative office or the executive office of the Standing Committee of the People's Congress at the corresponding level, or the Presidium of the Township and Town People's Congress, to the relevant state organ or organization for consideration and handling.
The relevant state organ or organization shall deliberate on and handle the opinions and suggestions in the inspection or investigation report, and may invite the deputy to participate in their deliberation and handling. It shall submit a report on such deliberation and handling to the office that handed over the deputy's report, and shall give timely feedbacks to the deputy.
Article 34
Deputies to the Municipal or District People's Congresses shall, according to the uniform arrangement of the Standing Committee of the respective People's Congress, participate in the assessment activities regarding the work of the respective People's Government; Deputies to the Township and Town People's Congresses shall, according to the uniform arrangement of the Presidium of the respective People's Congress, participate in the assessment activities regarding the work of the respective People's Government.
The suggestions, criticisms and opinions of the deputies raised in the assessment activities shall be submitted to the state organ subject to the assessment by the Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congress that organized the evaluation, which shall also urge the said state organ to improve their work.
Article 35
Deputies shall have the right, through a joint proposal signed by more than onefifth of the deputies, to propose the temporary convocation of a session of the People's Congress at the corresponding level to its Standing Committee or to the Presidium of a Township or Town People's Congress.
Article 36
A deputy to the Municipal or District People's Congress may be invited to attend, as a non-voting participant, the Standing Committee and special committee meetings of the People's Congress at the corresponding level, and may also be invited to attend relevant meetings organized by the Standing Committee, special committees, the administrative or executive office of the People's Congress at the corresponding level; and may, in accordance with the arrangements, participate in law enforcement inspections, special inquiries, and other activities organized by the Standing Committee of the People's Congress at the corresponding level.
A deputy to the Municipal People's Congress may attend, as a non-voting participant, the sessions of the People's Congress of the original electoral unit, and may, as a non-voting participant, be invited to attend the meetings of the Standing Committee of the People's Congress of the original electoral unit.
A deputy to a District People's Congress may attend the Township or Town People's Congress of the original electoral district.
A deputy to the Township or Town People's Congress may participate in law enforcement inspections and other activities organized by the Presidium of the People's Congress at the corresponding level.
Article 37
Deputies shall take the initiative to maintain close contact with the voters of their original electoral districts or units and the people, popularize laws, regulations and policies, and listen to and report their opinions and demands to relevant authorities through various means such as field visits, symposiums, inspections, investigations, and setting up deputy mailboxes or email boxes. Deputies shall supervise state organs at the corresponding levels and make sure that the latter duly perform their duties, improve their work, solve problems, and subject themselves to supervision of the people.
At least twice a year, deputies shall participate in events held at the site of the relevant community to reach out to the people. The Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congresses shall make proper arrangement necessary for the deputies' performance of duty.
Deputies may participate in the work of grievance-handling under the Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congresses to learn about the opinions and demands of the people and report to relevant authorities.
Article 38
Deputies may report to relevant authorities about the opinions and demands of the people in the following ways:
1. presenting their opinions during a session of the respective People's Congress, when the deputies are deliberating on various topics or special issues;
2. submitting proposals or suggestions, criticisms and opinions in accordance with law;
3. proposing suggestions, raising criticisms and giving opinions when attending, as full-right or non-voting participants, relevant meetings and activities organized by the Standing Committee of the respective People's Congress or the Presidium of the respective Township and Town People's Congress;
4. reporting to the administrative or executive office of the Standing Committee of the People's Congress at the corresponding level, to the sub-district working committee of the Standing Committee of the District People's Congress, or to the Presidium of the Township People's Congress;
5. forwarding letters from the people to the grievance-handling office of the respective People's Congress or its Standing Committee;
6. reporting to deputies to the People's Congress at the next higher level; and
7. other ways prescribed by laws and regulations.
Suggestions, criticisms, and opinions put forward by deputies on various aspects of work shall be handed over to the relevant state organ or organization for study and handling by the administrative or executive office of the Standing Committee of the People's Congress at the corresponding level, or to the Presidium of the Township or Town People's Congress. The relevant state organ or organization shall conscientiously study and handle such suggestions, criticisms, and opinions, maintain contact and communication with the deputies, and reply within three months from the date of referral. For suggestions, criticisms, and opinions which that are complex and cross-sectoral, a reply shall be given within six months from the date of referral.
Article 39
During the intersessional period of the People's Congress at the corresponding level, deputies shall have the right to duly submit bills, or give suggestions, criticisms, and opinions. Such suggestions, criticisms and opinions shall be handled in accordance with relevant provisions.
Article 40
Deputies to the Municipal and District People's Congresses shall, according to the decision of their respective people's Congress or its Standing Committee, be members of investigation committees for specific issues.
Article 41
During the intersessional period of the People's Congress at the corresponding level, deputies to the Municipal and District People's Congresses may, through its administrative or working offices, request to meet with members of the Standing Committee of the said Congress to discuss matters related to the Committee's work.
During the intersessional period of the People's Congress at the corresponding level, deputies to the Township and Town People's Congresses may request to meet with the chairman or vice chairman of the Township or Town People's Congress regarding the work of the said congress.
Chapter IV Guarantees for the Performance of Duties by Deputies
Article 42
Deputies shall not be pursued for legal liability on account of the speeches they made or the votes they cast at the various meetings of the People's Congress.
Article 43
When a Municipal or District People's Congress is in session, none of its deputies shall be arrested or subjected to criminal trials or other restrictions on personal freedom provided by law without the approval of its Presidium. During the intersessional period of such Congress, none of its deputies shall be arrested or subjected to criminal trials or other restrictions on personal freedom without the approval of its Standing Committee. If a deputy is detained for committing a crime, the organ executing the detention shall immediately report the matter to the Presidium or the Standing Committee of the People's Congress at the corresponding level.
When handling an application for approval duly submitted by a relevant state organ in accordance with the provisions hereunder, the Presidium or Standing Committee of the People's Congress shall examine whether the deputy in question is being pursued for legal liability on account of his/her speeches or votes at the various meetings of the People's Congress, or whether he/she is being retaliated against for his/her suggestions, criticisms and opinions or other acts in line with his/her official duties, and shall make a decision accordingly.
If a deputy to a Town or Township People's Congress is arrested or tried at a criminal court, or is subject to other restrictions on personal freedom provided by law, the department enforcing such measures shall report the matter to the Town or Township People's Congress immediately.
Article 44
A deputy's work unit shall ensure that the deputy has time to duly perform his/her duties as a deputy, and must treat the hours spent for that purpose as normal work hours that will in no way affect his/her salary/wage or other benefits. The said unit shall, in accordance with the necessity for the deputies' performance of duty and as circumstances allow, provide support and guarantee to facilitate the deputy's performance of duty.
Deputies who have no fixed salary/wage or steady income shall, in the light of the actual circumstances, be reasonably compensated for their lawful performance of duties by the financial department of the respective government.
Deputies shall, in the light of actual needs, be provided with round-trip travel expenses and necessary material facilities or subsidies for their lawful performance of duties by this Municipality.
Article 45
With respect to the expenses for deputies' activities, the Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congresses shall make a plan in accordance with the actual needs of such activities. The plan shall be incorporated into the budget of the respective People's Government to ensure that all the necessary expenses are covered. Funds shall be used for the specific activities designated in the plan.
Upon the authorization of the Standing Committee of the Municipal People's Congress, the Standing Committees of the District People's Congresses shall budget the expenses necessary for the activities of the deputies to the Municipal People's Congress, and such expenses shall be appropriated by the Standing Committee of the Municipal People's Congress.
Article 46
The Standing Committees of the Municipal and District People's Congresses shall formulate annual plans for deputies' work, and shall, in accordance with law, make overall arrangements for organizing deputies' performance of duties, thus enhancing the planning, organization, and standardization of such activities.
Annual plans for deputies' work shall be adopted by a meeting of the Standing Committee Directors, reported to deputies to the People's Congresses at the corresponding level, and released to the public.
Article 47
The Standing Committees of the Municipal and District People's Congresses shall maintain contact with their respective deputies by various means, establish and improve working mechanisms for constituent members of the Standing Committees, special committees, the administrative and executive office of the Standing Committee to maintain contact with deputies, expand deputies' participation in legislative, oversight, and other related work, and listen to deputies' suggestions, criticisms, and opinions.
The Chairman and Vice Chairman of the Township and Town People's Congresses are responsible for maintaining contact with their deputies during the intersessional period of the People's Congresses at the corresponding level.
Article 48
The Standing Committees of the Municipal and District People's Congresses shall strengthen their contact with deputies within their respective administrative regions, and provide the necessary conditions for deputies' lawful performance of their duties.
The Standing Committees of the Municipal and District People's Congresses may make use of modern information technology to establish and improve online platforms for deputies' performance of duties, thus providing convenience and services for deputies' lawful performance of their duties and for the strengthening of their study and training related to the performance of duties.
Article 49
The Standing Committees of the Municipal and District People's Congresses shall establish a system of networking among the deputies to the People's Congresses at various levels within this Municipality, and facilitate channels for deputies to learn about and report to relevant authorities the opinions and demands of the people.
Article 50
The Standing Committees of the Municipal and District People's Congresses, the People's Government at various levels in this Municipality and their departments, the Supervision Commissions, the People's Courts and the People's Procuratorates shall promptly report their work to deputies to the People's Congresses at the corresponding level, and shall, by distributing printed materials and by releasing information online, provide relevant information to their deputies. At the request of the deputies, they shall provide relevant information necessary for the deputies to perform their duties as deputies, and ensure that the deputies' right to know is not impaired.
The People's Governments at various levels of this Municipality, their various departments, the Supervision Commission, the People's Court and the People's Procuratorate shall, in accordance with the overall arrangement of the Standing Committee of the People's Congress at the corresponding level, invite their deputies to participate in relevant work and activities and listen to their opinions and suggestions.
Article 51
The Standing Committees of the Municipal and District People's Congresses shall formulate study and training plans on performing duties, organize deputies to participate in such training and exchanges, and improve deputies' capacity to perform their duties.
Deputies shall study and implement the theories, lines, principles, and policies of the Communist Party of China, acquire a comprehensive knowledge of the Constitution and the system of the People's Congresses, as well as the legal knowledge, practical skills and other professional knowledge necessary for performing their duties.
Deputies to the Township and Town People's Congresses shall participate in the said studies and trainings organized by the Standing Committee of People's Congress at a higher level and the Presidium of the Township and Town People's Congresses.
Article 52
The Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congresses shall establish a system for deputies to maintain contact with the voters of their original electoral districts or units as well as the people.
Article 53
The administrative and executive offices of the Standing Committees of the Municipal and District People's Congresses are the service providing centers for deputies to perform their duties. They undertake to serve the deputies when the latter perform their duties as deputies.
Sub-district working committees of the Standing Committees of District People's Congresses and deputy contact offices of the Township and Town People's Congresses shall provide service guarantees to deputies to People's Congresses at various levels in their performance of duties as deputies within respective administrative regions, and shall publicize the contact information to deputies and the society.
A mechanism for mutual liaison shall be established between the relevant deputy affairs departments of the Standing Committees of the Municipal and District People's Congresses, sub-district working committees of the Standing Committees of District People's Congresses, and deputy liaison bodies of the Township and Town People's Congresses.
Article 54
The People's Congresses at various levels of this Municipality shall issue deputy certificates to their respective deputies, so as to facilitate the deputies' performance of duties.
Article 55
Relevant state organs and organizations shall conscientiously consider and handle deputies' bills, suggestions, criticisms and opinions.
Information about the handling of deputies' bills, suggestions, criticisms and opinions shall be reported to the respective People's Congress or its Standing Committee or the Presidium of the Township and Town People's Congress and shall be made available to the deputies and to the general public.
Article 56
When deputies from ethnic minorities lawfully perform their duties, the relevant departments shall provide them with necessary assistance and special considerations in respect of language, written scripts, living customs, and other aspects.
When deputies with physical disabilities or other mobility difficulties lawfully perform their duties, the relevant departments shall provide them with necessary assistance and special considerations in light of their needs.
Article 57
All organizations and individuals shall respect the deputies' rights, and shall provide support for them when they do so.
For an act of refusing to assist in a deputy's performance of duty on the part of one who has the obligation to do so, the relevant unit shall criticize and educate the wrongdoer, and even impose sanctions in accordance with law.
Where a person obstructs a deputy from performing his/her duties in accordance with law, that person shall, depending on the circumstances, be subject to disciplinary action by the entity to which they belong or by the relevant organs, or be punished in accordance with the relevant provisions of the Law of the People's Republic of China on Imposition of Punishment for Public Security Administration. Where a person obstructs a deputy from performing his/her duties by means of violence or threat, that person shall be investigated for criminal liability in accordance with the relevant provisions of the Criminal Law.
For a person retaliates against a deputy who duly performed his/her duties, the entity to which they belong or the relevant organs shall order them to make correction or impose sanctions. If a government employee's act of retaliation constitutes a crime, he/she shall be prosecuted for criminal liability in accordance with the relevant provisions of the Criminal Law.
The Standing Committees of the Municipal and District People's Congresses or the Township and Town People's Congresses shall supervise relevant state organs and units and shall duly handle such matters in accordance with the law. The relevant state organs and units shall promptly report to the respective People's Congress or its Standing Committee with regard to the handling of such matters.
Article 58
The Standing Committees of the Municipal and District People's Congresses and the Presidium of the Township and Town People's Congresses shall publicize, through various ways, deputies' exemplary cases of lawfully performing their duties and giving full play to their roles, thus showcasing their vivid practice in the implementation of the whole-process people's democracy.
Chapter V Supervision over Deputies
Article 59
Deputies shall take a firm political stance, fulfill their political responsibilities, improve their ideological and work conduct, willingly accept oversight, and consciously safeguard the image of deputies.
Article 60
Deputies shall seek opinions about their job performance from the voters of their original electoral districts or units as well as the people on a regular basis and by various means, shall answer questions from the latter about their work and activities, and shall voluntarily subject themselves to the latter's supervision.
Deputies to the Municipal People's Congress shall give oral or written reports on their job performance to their respective electoral unit, as is arranged in the uniform plan of the Standing Committee of the Municipal People's Congress.
Deputies to the District, Township and Town People's Congresses shall give oral or written reports on their job performance, on a regular basis, to voters of their original electoral districts, as is arranged in the uniform plan of the Standing Committees of the District People's Congresses or the Presidium of the Township and Town People's Congresses.
Article 61
Information regarding a deputy's place of work, position or job title and mailing address shall be made available to the voters of the original electoral districts or units.
In the case of any change in the deputy's place of work, position, job title or mailing address, notice shall be served on the relevant deputy affairs department of the Standing Committee of the People's Congress at the corresponding level if the deputy in question is a municipal or district-level deputy, and on the deputy communication office of the respective People's Congress if he/she is a town/township-level deputy.
Article 62
The deputy activities organized by the People's Congresses at various levels of this Municipality or the Standing Committees thereof, as well as those organized by the special committees of the Municipal or District People's Congresses and the administrative and executive offices of their Standing Committees, shall all be part of a deputy's job performance.
The Standing Committees of the Municipal and District People's Congresses as well as the Presidium of the Township and Town People's Congresses, shall establish a filing system for the job performance of their respective deputies. Information relevant to a deputy's activities of job performance shall be promptly filed with the activity organizer, and be checked with the deputy on a regular basis. Where a deputy challenges an entry regarding his/her job performance, the entry shall be adjusted after verification. Information about the job performance of deputies to the People's Congresses at various levels of this Municipality shall be made available to the voters of the original electoral districts or units.
Article 63
Deputies shall properly handle the relationship between their occupational activities and performance of deputy duties, and shall not seek personal gains by taking advantage of their status as deputies or performance of their duties to interfere with specific law enforcement actions or judicial cases, meddle in economic activities such as bidding and tendering, or engage in commercial activities in disguised forms.
Deputies shall not accept financial sponsorship from enterprises, public institutions, social organizations or individuals in performing their duties as deputies.
Article 64
The voters or electoral units shall have the right to duly remove the deputies they elected. In the case of a proposed removal, the deputy in question shall have the right to attend the meeting for his/her removal and present his/her defense orally or in writing.
Article 65
If a deputy falls into any of the following descriptions, he/she shall be suspended from performing his/her duties as a deputy, and the deputy credentials commission shall report the matter to the Standing Committees of the Municipal and District People's Congresses or the Presidium of the Township and Town People's Congresses.
1. being detained in a criminal case and undergoing investigation, prosecution, or trial; or
2. serving a sentence of public surveillance, criminal detention, or fixed-term imprisonment imposed in accordance with law without the additional deprivation of political rights.
When the circumstances specified in the preceding Paragraph cease to exist during the term of office of the deputy, the performance of his/her duties as a deputy shall be resumed, except when he/she has been disqualified as a deputy.
Where a deputy to the Municipal People's Congress suspends or resumes the performance of his/her duties as a deputy during his/her term of office, the Standing Committee of the Municipal People's Congress shall notify the deputy in person and circulate a notice to the original electoral unit of the deputy and the deputies' group to which he/she belongs.
Where a deputy to the District People's Congresses or to the Township or Town People's Congress suspends or resumes the performance of his/her duties as a deputy during his/her term of office, the Standing Committee of the District People's Congress or the Presidium of the Township and Town People's Congress shall notify the deputy in person and circulate a notice to the original electoral district of the deputy and the deputy's group to which he/she belongs.
Article 66
A deputy to the Municipal People's Congress may submit his/her written resignation to the Standing Committee of the District People's Congress that elected him/her. The acceptance of such resignation by the Standing Committee of the District People's Congress shall be adopted by a majority vote of all its members. The resolution on the acceptance of the resignation shall be filed with the Standing Committee of the Municipal People's Congress for the record and public announcement.
A deputy to the District People's Congress may submit his/her written resignation to the Standing Committee of the District People's Congress; a deputy to the Township or Town People's Congress may submit his/her written resignation to the Township or Town People's Congress. When the Standing Committee of the District People's Congress accepts the resignation, it shall be adopted by a majority vote of all its members. When the Township or Town People's Congress accepts the resignation, it shall be adopted by a majority of all deputies to the People's Congress. The acceptance of such resignation shall be publicly announced.
Article 67
If a deputy falls into any of the following descriptions, he/she shall be disqualified:
1. having moved or having been transferred out of the respective administrative region;
2. having had his/her resignation request or resignation required by the relevant authority accepted;
3. having been absent twice from sessions of the respective People's Congress without proper approval;
4. having been removed;
5. having forfeited his/her citizenship of the People's Republic of China;
6. having been duly deprived of his/her political rights; or
7. having lost capacity for civil conduct.
Where a deputy dies, his/her qualification as a deputy shall terminate automatically.
Disqualification of a deputy to the Municipal or District People's Congress shall be reported by the deputy credentials commission of deputies' qualifications to the Standing Committee of the respective People's Congress, and be publicly announced by the latter.
Disqualification of a deputy to the Township or Town People's Congress shall be reported by the deputy credentials commission to the Presidium of the respective People's Congress, and be publicly announced by the said People's Congress.
Chapter VI Supplementary Provision
Article 68
These Measures shall be effective as of March 1, 2015.
