Main responsibilities are as follows:

1. Assume responsibility of comprehensive market supervision and regulation. Enforce laws, regulations, rules, policies, and standards related to market supervision and regulation. Conduct research and develop local regulations and rules drafts for market supervision and regulation, formulate policies and plans and oversee their implementation. Implement national strategies of boosting product quality, enhancing food safety, and improving standardization. Uphold market order and foster an environment of honesty, trustworthiness, and fair competition. Conduct research and study on the establishment of a new market supervision and regulation system in an open economy,  and coordinate efforts in addressing major issues in relevant areas.

2. Facilitate the registration and licensing of market entities. Deal with registration of various market entities, including enterprises, farmers’ professional cooperatives, units engaged in business activities, individual-owned businesses, and Shanghai-based representative offices of foreign-funded enterprises. Establish an enterprise name approval system, approve and issue business licenses and relevant permits to eligible market entities. Develop and implement administrative licensing measures for food-related products, and oversee their enforcement. Undertake the work related to issuing production permits for food-related products.

3. Oversee coordinated law enforcement in market supervision and regulation. Provide guidance for the development of task forces of law enforcement at district-level market supervision and regulation units, advance reform of the comprehensive law enforcement system for market supervision and regulation in accordance with relevant requirements, and ensure unified and comprehensive market supervision and regulation. Coordinate and oversee the investigation and handling of major violations related to market supervision and regulation, and supervise the investigation progress of such cases. Regulate administrative law enforcement practices pertaining to market supervision and regulation.

4. Enforce anti-monopoly laws. Promote the adoption of competition policies and facilitate the implementation of a fair competition review system. Carry out enforcement of anti-monopoly laws, such as addressing monopoly agreements, market dominance abuse, and abuse of administrative power to exclude or restrict competition, as authorised by the State and in accordance with the law. Offer assistance and guidance to enterprises in responding to anti-monopoly lawsuits abroad.

5. Supervise and regulate market order. Oversee market transactions, online commodity transactions and relevant services in accordance with the law. Investigate and punish violators involved in activities such as irregularities in pricing and fee charges, unfair competition, illegal direct selling, pyramid schemes, illegal advertising, trademark and patent intellectual property rights infringement, and the production and sale of counterfeit goods. Oversee various consumer goods markets, production materials markets, etc. Develop a contract supervision and management system with specific measures. Enforce the supervision and administration of contract and auction activities in accordance with the law, and manage the registration of collaterals. Formulate development plans and professional standards for the advertising industry and oversee advertising activities. Investigate and penalise those involved in unlicensed production and business operation, as well as other unauthorized production and business activities.

6. Provide guidance to consumer protection committees in safeguarding consumer rights. Formulate relevant rules and regulations to protect the legitimate rights and interests of consumers and improve the consumer rights protection system. Monitor the credibility of market entities. Establish an information release and sharing mechanism for market entities, and collaborate with relevant departments in constructing a credit system for market entities which enables joint punishment.

7. Conduct macro quality management. Develop and implement quality development systems and measures. Organize efforts for quality-oriented technological breakthroughs, and enhance overall planning for collaborative services and application of quality infrastructure. Promote civil-military integration in relevant fields and establish an effective quality development working system. Ensure that enterprises fulfill their primary responsibilities for product quality. Support the implementation of branding strategies and prepare and publish quality analysis reports. Establish and implement a recall system for defective products and oversee anti-counterfeiting efforts.

8. Oversee product quality and safety. Monitor product quality and safety risks, and develop a watch list of products for quality monitoring. Strengthen monitoring efforts for product quality and safety risks and carry out random checks on product quality. Establish and implement a quality grading system and a quality and safety traceability system. Manage production permits for industrial products. Oversee quality supervision and inspection of fibres and fibre products.

9. Supervise and administer the quality and safety of special equipment. Oversee the overall management and coordination of quality inspection and supervision on special equipment. Monitor the implementation of energy-saving standards for high-energy-consumption special equipment and environmental protection standards for boilers. Investigate and handle special equipment related accidents, conduct statistical analysis thereof, and disclose information on safety of special equipment to the public on a regular basis, as specified in statutory functions.

10. Coordinate comprehensive food safety supervision and administration. Formulate and implement food safety plans and major policies, and enhance the food safety traceability system. Establish a food safety emergency response system and provide guidance for emergency management and response to food safety incidents. Establish a unified system for food safety information disclosure. Promote cross-regional and cross-departmental coordination and cooperation mechanisms for food safety.

11. Oversee food safety. Establish and implement a comprehensive supervision and inspection system covering the entire process of food production, distribution, and consumption, along with mechanisms for identifying and eliminating hidden hazards. Conduct random inspections on food safety, risk monitoring, verification and defusing, risk early warning, and information exchange. Oversee the production and processing quality of special foods and food-related products.

12. Oversee metrological work. Implement national legal units of measurement and the national measurement system. Establish and oversee citywide metrological benchmarks and public measurement standards. Oversee the formulation (revision), review, approval, and issuance of local metrological verification procedures and technical specifications. Manage measuring instruments, including their calibration and comparison, and regulate and supervise quantity measurement of goods and market measurement practices.

13. Oversee standardisation initiatives. Prepare and implement a standardised development strategy and government-initiated guiding policies and measures for standardisation, and advance the establishment of “Shanghai Standards.” Facilitate the implementation of national, industrial, and local standards. Promote international standardisation efforts and adoption of international and advanced international standards. Oversee the formulation (revision), review, approval, and issuance of local standards.

14. Oversee inspection and testing activities. Regulate inspection and testing markets and foster the reform and development of the inspection and testing industry. Improve the inspection and testing system and enhance the capabilities and internationalisation of technical agencies involved in market supervision and regulation.

15. Oversee and coordinate certification and accreditation work. Implement the national unified system for certification, accreditation, and conformity assessment supervision and administration. Encourage and guide various organizations to get certifications for their management systems and products. Keep records of agencies involved in certification activities, and supervise and manage such activities.

16. Foster the technology and information based development of market supervision and regulation. Promote the establishment of a standardized public information service system and ensure the timely release of government affairs-related news and announcements. Facilitate international exchanges and cooperation, engage in updates and consultations related to the Agreement on Technical Barriers to Trade of the World Trade Organization.

17. Oversee energy measurement in key energy-consuming entities. Promote energy measurement practices and support green development initiatives. Oversee the formulation (revision) of local standards for energy-saving and environmental protection, as well as the implementation of the energy efficiency label management system.

18. Oversee the Shanghai Municipal Medical Products Administration and Shanghai Municipal Intellectual Property Administration.

19. Carry out any additional tasks assigned by the CPC Shanghai Municipal Committee and Shanghai Municipal People’s Government.
