Shanghai Municipal Bureau of Human Resources and Social Security

In accordance with the stipulations in the Notice of the Plan of Institutional Reform of the Shanghai Municipal Government issued by General Offices of the CPC Central Committee and the State Council, Shanghai Municipal Bureau of Human Resources and Social Security is established as component department of the Shanghai Municipal Government. The Shanghai Municipal Bureau of Human Resources and Social Security also functions as Shanghai Municipal Administration of Foreign Experts Affairs and Shanghai Municipal Office of Medical Insurance. Its responsibilities include:

1. To implement laws, regulations, rules, principles and policies concerning human resources and social security; study and draft local regulations and rules concerning human resources and social security, as well as implement related local regulations and rules; formulate local development plans and policies concerning human resources and social security, as well as implement, oversee and inspect the above-mentioned plans and policies.

2. To formulate development plans for the human resources market and policies of human resources flow, promote establishing standardized and unified human resources market, promote reasonable flow and effective allocation of human resources; administer employment of overseas personnel in Shanghai; administer introducing domestic talents into Shanghai.

3. To promote employment, formulate overall urban and rural employment development plans and policies, improve public employment service system, formulate employment aid institutions, promote business startup to drive employment; improve professional certification system, set up overall vocational training system for urban and rural workers, participate in formulation of employment policies of college graduates; participate with relevant departments in the work of providing talents service for the whole nation; formulate policies of training and motivation of highly skilled talents and countryside practical talents together with relevant departments.

4. To formulate together with relevant departments policies concerning distribution of wage and income of personnel in government agencies and public institutions, set up mechanism of regular growth of wage and guaranteed payment for wage of personnel in government agencies and public institutions, formulate policies concerning welfare and retirement of personnel in government agencies and public institutions; formulate macro-control policies concerning wage and income of workers in enterprises, improve institutions of minimum wage and safeguard mechanism of payment for wage.

5. To formulate jointly regulations of arbitration of labor and personnel disputes and coordinative policies concerning labor relations, improve coordinative mechanism of labor relations, formulate policies to eliminate illegal employment of child labor and special labor protection polices for female and minor workers, organize and execute labor security supervision, coordinate the work of safeguarding labor rights, investigate and punish illegal actions in accordance with law.

6. To provide guidance together with relevant departments for reform on personnel system of public institutions, formulate administrative policies concerning personnel in public institutions and attendants in government agencies; participate in administration of talents, formulate policies concerning administration and continued education of professionals and technicians, lead in efforts to push forward and deepen the reform on evaluation and ranks and titles system of professionals and technicians, improve post-doctoral management systems, select and train high-caliber professionals and technicians.

7. To introduce overseas talents and experts, facilitate employment and inhabitation in China of overseas Chinese scholars, formulate relevant policies concerning the introduction of overseas talents, coordinate the work of dispatch of overseas scholars from non-education organs and emplacement of them when returning, examine and administer overseas training groups and group members.

8. To formulate with relevant departments emplacement policies and plans for demobilized army cadres, educate and train the demobilized army cadres, organize and formulate policies concerning stabilizing and problem-solving of those demobilized army cadres from enterprises, administer and serve those demobilized army cadres who find jobs on their own.

9. To comprehensively administer civil servants of government agencies, formulate deployment policies for relevant personnel and emplacement policies for special personnel, formulate local mechanisms of honors and government awards together with relevant departments, cooperate with relevant departments in conducting performance assessment of government civil servants.

10. To formulate comprehensive policies and plans of the work of migrant workers together with relevant departments, push forward the implementation of related policies concerning migrant workers, coordinate and solve key problems and difficulties, safeguard legal interests of migrant workers; undertake regular work of the office of the municipal joint conference for migrant workers affairs.

11. To establish overall social security system covering both urban and rural areas; formulate overall policies and standards of urban and rural social insurance and its supplementary insurance, formulate policies concerning transferring and connecting social insurance, formulate overall basic old-age insurance policies covering government agencies, public institutions, enterprises, other organizations and members in society; formulate administrative and supervision mechanisms of social insurance and its supplementary insurance funds together with relevant departments, organize and formulate draft of budget and final accounts of social insurance funds, administer and oversee the work of preserving and increasing the value of social insurance funds in accordance with regulations.

12. To formulate payment standards, medicare service items and scopes of medicines and medicare facilities for basic medical insurance, work-related injury insurance and maternity insurance, formulate administrative measures for examination of the final accounts and other issues of designated medicare facilities and pharmacies, administer and supervise the medicare service covered by the basic medical insurance, reform on payment by medical insurance fund; research and formulate related policies concerning the reform of medical system together with relevant departments.

13. To forecast, provide early warning and information guidance for employment, unemployment and social insurance funds, formulate contingency plans, take measures of prevention, adjustment, and control; maintain the stability of employment and overall balance between incomes and expenditures of social insurance funds.

14. To accept and hear related administrative reconsiderations and respond to administrative lawsuits.

15. To undertake other tasks assigned by the municipal government.
