The Shanghai Municipal Bureau of Justice is a municipal government department in charge of judicial and legal work across the city, with the status of a regular-level bureau.

The Office of the Commission for Overall Law-based Governance of the Communist Party of China Shanghai Municipal Committee (hereinafter referred to as the Office) is located in the Shanghai Municipal Bureau of Justice. The Office is under the direct leadership of the Commission for Overall Law-based Governance of the CPC Shanghai Municipal Committee (hereinafter referred to as the Commission), undertaking specific tasks from the Commission, organising and conducting policy research on major issues related to the overall law-based governance of the city, and coordinating and urging relevant parties to implement decisions, work arrangements, and requirements of the Commission. The internal institutions of the Bureau of Justice undertake relevant work of the Office according to the needs of the work and are subject to the overall coordination by the Office.

Main responsibilities:

1. Conduct policy research on major issues related to the overall law-based governance of the city. Coordinate with relevant parties to provide suggestions for mid- and long-term plans for overall law-based governance. Inspect the implementation of major decisions and arrangements.

2. Advance the construction of a law-based government. Guide and supervise the law-based administration of all departments of the municipal government, district governments, and township governments. Serve as the legal adviser to the municipal government and support the legitimacy review of major administrative decisions. Promote the work related to legal advisers for governments at all levels.

3. Coordinate and plan local legislation. Coordinate relevant parties to propose suggestions for local legislative plans and annual legislative plans, monitor the implementation of plans related to the legislative work in all departments, strengthen organisational coordination, supervision and guidance, and propose opinions and measures for the connection of legislation with reform decisions. Solicit public opinions on legislative projects.

4. Draft or organise the drafting of local regulations and draft regulations. Review local regulations and regulatory drafts submitted by various departments to the municipal government. Undertake legislative interpretation, post-legislation evaluation, and compilation of municipal government rules and regulations. Coordinate and address disputes and issues in the formulation and implementation of local rules and regulations. Organise the translation, examination and approval of the official foreign-language versions of municipal government rules and regulations. Coordinate and promote the development of administrative normative documents.

5. Supervise administrative law enforcement activities. Provide guidance and supervision for administrative reconsideration, response to administrative litigation, and administrative compensation. Handle administrative reconsideration, response to administrative litigation, and administrative compensation cases of the municipal government. Coordinate the resolution of jurisdictional disputes in administrative reconsideration. Responsible for the comprehensive coordination of administrative law enforcement work, managing the qualifications of administrative law enforcement entities, advancing relevant work in the reform of the administrative law enforcement system, formulating and promoting the implementation of administrative law enforcement systems, organising and guiding the inspection of administrative law enforcement work, and ensuring strict, standardized, fair, and civilized law enforcement.

6. Develop comprehensive plans for the construction of a society ruled by law. Formulate plans for legal publicity and education, organise and conduct law popularization and awareness campaigns, and organise international law-related publicity efforts. Guide law-based governance and legal development work. Promote public participation in legal construction, guide mediation work, guide and oversee the selection and appointment of people’s jurors, and manage the selection and appointment of people’s supervisors. Promote the establishment and improvement of judicial offices.

7. Manage prisons and supervise and manage the execution of sentences and the reform of prisoners.

8. Manage judicial and administrative drug rehabilitation centres. Guide and supervise forced quarantine and drug rehabilitation within the judicial system. Provide guidance, support, and assistance for community-based drug treatment and rehabilitation efforts.

9. Promote the development of the public legal service system. Formulate plans for the construction of the public legal service system and guide the implementation. Coordinate legal service resources and provide basic public legal services. Provide guidance and supervision for lawyers, legal aid, judicial appraisal, notarization, arbitration, and grassroots legal services.

10. Organise the national unified legal professional qualification examination in Shanghai. Manage the issuance of national unified legal profession qualification certificates. Plan and guide pre-job training for legal professionals.

11. Organise and carry out international legal cooperation. Handle legal affairs related to Hong Kong, Macao, and Taiwan. Facilitate the external exchange and cooperation for the judicial system.

12. Manage firearms, ammunition, clothing, and police vehicles within the judicial system. In accordance with the prescribed authority, manage State-owned assets within the system. Review, approve, and report on investment project plans involving State-owned assets of subordinate units. Guide and supervise fixed-asset investment and management of the prison system. Undertake information technology construction within the system.

13. Plan, coordinate, and guide efforts to nurture legal professionals. Nurture talents for the judicial system and handle matters related to retired officials. Manage and supervise police officers within the judicial system. Assist in the management of the leading groups and leading officials of district-level bureaus of justice.

14. Fulfill other tasks assigned by the CPC Shanghai Municipal Committee and the municipal government.
