Decisions of the Standing Committee of Shanghai Municipal People's Congress on Promoting and Safeguarding the Construction of Chongming World-class Ecological Island

Chongming Island is the most precious, irreplaceable, future-oriented ecological strategic space for Shanghai. Therefore, with a view to actively practicing the development conceptions of innovation, coordination, green-tech, openness and sharing, concentrating the consensus of the whole society, and, in line with the international advanced standard, striving to construct Chongming into the world-class ecological island, showcasing guide effects, harmony and beauty in ecological environment, the integrated and economical use of resources, the coordinated and sustainable development of economic society and other comprehensive characteristics, the following decisions are hereby formulated:

1. The construction of Chongming ecological island is a key link in the national development strategy of Yangtze River Economic Belt as well as in the ecological civilization construction of Shanghai Municipality. And so it is essential to make full use of and give full play to the unique environmental advantages of Chongming Island, place the ecological civilization construction onto the prominent strategic position, establish the ecological civilization conception of having respect for, compliance with and protection of nature, facilitate green development, advocate ecological culture, promote green life and achieve ever sustainable development.

2. The construction of Chongming ecological island shall follow the principle of an ecological island, with priority given to thrift and protection as a fundamental policy, with the green, recycling and low-carbon development as a basic approach, and with the in-depth reform and innovation-driven development as the basic power so as to build an institutional system of sound ecological civilization and achieve symbiotic harmony between human and nature.

3. The Municipal People's Government shall strengthen the unified leadership in the construction of Chongming ecological island, establish a mechanism of promoting coordination  and strengthen the target management and plan as a whole in work  to formulate a resultant force of the whole municipality in promoting the construction of Chongming ecological island. The relevant departments of the Municipal People’s Government shall, in accordance with their respective duties and functions, deepen and perfect the implementation mechanism and actively facilitate the construction of Chongming Ecological Island.

The Chongming District People's Government shall implement the national and municipal work deployment and task requirements on the construction of ecological civilization, and ensure that the construction work of Chongming ecological island shall be facilitated in an orderly manner.

The Municipal People's Government and its relevant departments shall strengthen coordination in construction planning and management with the neighboring provinces and cities to facilitate the integrative development of regional ecological construction.

4. The construction of Chongming ecological island shall combine the ecological conception with the requirements for new type of urbanization and the integrative development of urban and rural area, optimize the spatial development pattern, and promote the integration of ecology, production and living space. It is necessary to co-ordinate the development of Chongming Island, Changxing Island and Hengsha Island, have strict control of the total resident population, construction-use land size and building height, and strict delineation of ecological protection red line, strengthen the protection of the beach and wetland, facilitate the construction of both the Chongming Dongtan National Nature Reserve for Birds and the Yangtze River Rare Aquatic Animal Protection Area, delimit non-hunting (fishing) area, build the wild bird protection management system, establish a barrier system against the invasion of alien species and safeguard the ecological security and biological diversity.

5. The construction of Chongming ecological island shall be in compliance with the requirements of reduction, reuse and resource, promote the comprehensive utilization of various types of waste and establish the resources cycling and utilization system in the whole society for the development of circular economy. It is imperative to enhance protection and treatment of water and air pollution, implement soil contamination management and ecological restoration in line with the requirements of combining prevention and treatment, addressing both the symptoms and root cause, and implementing policies in a comprehensive way. It is imperative to optimize the layout of public green space, increase the total amount of green space and forest land in an orderly way and upgrade the quality of ecological environment.

6. The construction of Chongming ecological island shall, in compliance with the requirements of the common development of advantages in ecological nature and development, intensify the leading role of scientific and technological innovation,   carry out research and tackling of linchpin technology in wetland protection, ecological restoration and other fields, give In-depth push to the industrial restructuring, promote the green industry, upgrade intelligence, focus on ecological agriculture, marine economy, tourism and leisure, health services, culture and sports, exhibition business and other fields, lift the level of green agriculture modernization, facilitate the development of green advanced manufacturing industry, improve the quality of modern service industry, and make flourishing  development of innovative economy.

7. The construction of Chongming ecological island shall, in compliance with the requirements of ecological benefits for people, build the green production and life style, improve the level of ecological living environment, actively develop the clean energy, set up the green energy exploration and utilization system, develop green transportation guided by low-carbon travel and best traffic outside and inside the island, develop the green architecture, strengthen its planning, designing and construction management, build a harmonious and diverse architectural style in line with the requirements of Chinese elements, southern charms and island features,  raise the development level of social undertakings, improve public service facilities system, provide high-quality public services, enlarge employment channels and set up urban and rural integrative system of social security so that Chongming residents can enjoy the fruits of the ecological island construction.

8. The construction of Chongming ecological island shall strengthen the ecological civilization awareness of the whole society; make a sound system of reporting, hearing and other public supervision, to formulate good social conduct of co-construction and sharing of the whole society. Residents of Chongming Island should be the first to strengthen the concept of ecological protection, practice the green production and life style, and actively devote every effort to Chongming ecological island construction. Relevant domestic and foreign scientific research institutes, colleges, enterprises, public institutions, social organizations and individuals shall be encouraged and supported to actively participate in the construction of Chongming ecological island.

9. The Municipal People's Government and its relevant departments shall actively seek support from the State, and shall innovate policy measures that meet the characteristics of Chongming Island, focusing on the major areas and key links of the Chongming ecological island construction, increase fiscal investment, improve the ecological compensation mechanism, perfect personnel training and exchange schemes, innovate the ecological environment management mechanism, and promote the reform of ecological civilization system.

10. The Standing Committee of the Municipal People's Congress shall, in accordance with the needs of Chongming ecological island construction, promptly formulate, revise or temporarily adjust or suspend implementation of the local laws and regulations relating to Chongming ecological island construction. The Municipal People's Government may, on the premise of adhering to the unified principle of the national legal system and essential principles of the municipal local laws and regulations, formulate government regulations or normative documents on the construction of Chongming ecological island in a pilot way, and report to the Standing Committee of the Municipal People's Congress for the record. The Chongming District People's Congress and its Standing Committee may formulate the related resolution and decisions on promoting and safeguarding the construction of Chongming ecological island, and report to the Standing Committee of the Municipal People's Congress for the record.

11. The municipal people's court and municipal people's procuratorate shall actively perform their duties and functions, carry out public welfare litigation in the ecological environmental field according to the law, severely punish all kinds of illegal acts of ecological environment destruction and provide judicial guarantee for the construction of Chongming ecological island.

12. The Standing Committee of the Municipal People's Congress and the Standing Committee of Chongming District People's Congress shall strengthen supervision on the decision implementation by listening to the special work report and carrying out law enforcement inspection and other means.

The Standing Committee of the Municipal People's Congress and the Standing Committee of Chongming District People's Congress shall give full play to the role of deputies at all levels and organize the NPC deputies to carry out special research and inspection activities around the construction of Chongming ecological island to gather and reflect the opinions and suggestions of the masses and urge the relevant parties to implement every work on the construction of Chongming ecological island.

These Decisions shall be effective as of July 1, 2017.
