Decision of the Standing Committee of Shanghai Municipal Peoples Congress on Managing to Prevent and Control the Current Coronavirus Pneumonia Epidemic

In order to do our best to prevent and control the current coronavirus pneumonia epidemic, and implement the most stringent prevention and control measures to protect public health and social safety, and work hard with the strength citywide to win the fight against epidemic prevention and control, according to the Law of the Peoples Republic of China on the Prevention and Control of Infectious Diseases, the Law of the Peoples Republic of China on Emergency Response and the Regulations on Emergency Response to Public Health Emergencies, and such laws and administrative rules, and in the light of the actual circumstances of this Municipality, we make the following Decision during the epidemic prevention and control period:

1. The epidemic prevention and control work in this Municipality shall implement the principles of law and rules-governing, scientific prevention, accurate policy enforcement, orderly regulation, joint prevention and control, and mass prevention and governance, adhere to Party building leadership, and adopt practical and effective measures to integrate regional, departmental, industrial, grassroots and unit governance in an organic manner, thus effectively improving the scientificity, timeliness, and effectiveness of epidemic prevention and control.

2. The peoples governments at all levels and their related departments shall earnestly perform territorial and departmental responsibilities, establish and improve protection networks in the whole Municipality, districts, sub-districts, towns, and urban and rural communities, play the role of “one network for unified management” to form the cross-department, cross-level, and cross-regional prevention and control system and do a good job in epidemic surveillance, investigation, early warning, prevention and control, prevent import, transmission, and proliferation, and implement this Municipality’s joint prevention and control mechanism.

The peoples governments at all levels and their related departments must strengthen the comprehensive management and guarantee work of key medical institutions such as designated medical institutions and centralized isolation sites, and fully maintain the order of medical treatment and isolation. It is imperative to arouse the enthusiasm of the higher learning institutions, scientific research institutes, enterprises and all sides, strengthen scientific research and key problems tackling, and actively improve the ability of scientific treatment.

The township peoples governments and sub-district offices must, in accordance with unified arrangements of this Municipality and the district, give full play to the power of mass prevention and control, organize and guide the residents and villagers committees to manage the areas under their jurisdiction, adopt targeted prevention and control measures, and effectively do a good job in the prevention and control work in their areas.

Residents and villagers committees must play an autonomous role, assist relevant departments to do a good job in publicity, education, and health tips for community epidemic prevention and control, implement relevant prevention and control measures, and collect, register, verify, and submit relevant information in a timely manner. Owners committees and real estate service enterprises shall cooperate in the prevention and control of the epidemic.

Within the administrative area of this Municipality, every unit and individual must abide by the provisions on epidemic prevention and control, obey the unified command and management of the local peoples government, and promptly report matters about patients with coronavirus pneumonia, close contacts with infected patients, and other persons requiring medical observation and isolation treatment.

Organs, enterprises, institutions, and social organizations have the main responsibility for the implementation of various epidemic prevention and control measures in their units. They shall strengthen the responsibility system and management system for prevention and control work, implement strict management and control of particular persons and groups, and important places and facilities. They shall strengthen health monitoring and report any abnormal situation to relevant departments in time. The industrial park management agency shall do well all jobs of the epidemic prevention and control in the park. Public service units such as aviation, railway, rail transportation, long-distance passenger transportation, and water transportation shall take necessary measures to ensure the effective implementation of various epidemic prevention and control measures.

Individuals shall protect themselves,wearing masks consciously on entering public places. Individuals shall truthfully provide relevant information in accordance with provisions, cooperate with relevant departments to do a good job in epidemic prevention and control, and accept investigation, monitoring, quarantine observation, and centralized treatment and other preventive and control measures in accordance with the law to ensure early detection, early reporting, early diagnosis, and early isolation treatment.

The Municipal Peoples Government may, on the premise of no conflict with the Constitution, laws and administrative rules, and not running counter to the basic principles of this Municipalitys local rules, adopt temporary emergency management measures, formulate government regulations or issue decisions, orders, notices, etc.,in the areas of health care, epidemic prevention management, isolation observation, crossing management, transportation, community and market management, site management, production and operation, labor security, city appearance and environment, etc. and report to the Standing Committee of the Municipal Peoples Congress for the record. The municipal and district peoples governments and related departments may, as occasion requires, requisition units or individuals for equipment, facilities, places, vehicles and other materials needed for epidemic prevention and control according to law, and require relevant enterprises to organize the production and supply of necessities for corresponding epidemic prevention and control and livelihood. The municipal and district peoples governments and their relevant departments shall issue emergency requisition vouchers to the requisitioned units or individuals and return or compensate them according to law. The municipal and district peoples governments and their related departments must increase overall planning and give priority to meeting the needs of front-line medical and nursing staff and patients for epidemic prevention and control.

Relevant departments such as development and reform, economic informatization, commerce, emergency management, market supervision, finance, port inspection, housing and urban and rural construction shall innovate supervision methods, optimize work processes, and establish green channels to facilitate the production, supply and use of materials for epidemic prevention and control, and related engineering construction. The municipal and district peoples governments and their related departments shall provide timely assistance to the difficulties encountered by the relevant units in the prevention and control work, and effectively solve the related problems.

Relevant departments of the municipal and district peoples governments shall strengthen the standardized management of charitable donation activities related to epidemic prevention and control and emergency rescue to ensure that the entire process of receiving, spending, using and supervising is transparent, open, efficient and orderly.

This Municipality shall give full play to the role of the services be accessed via one website platform, strengthen business collaboration, optimize government service processes, and provide online government affairs handling services.

Encourage enterprises, institutions, social organizations and individuals to apply for online taxation, human and social security, medical insurance, provident fund, immigration and other related services through online application, license express delivery and other methods.

The Municipal Peoples Government and its relevant departments shall strictly implement the epidemic reporting system, seek truth from facts, be open, transparent and timely, and promptly announce the epidemic information to society. No delay, omission, concealment or false reporting shall be allowed.

Media such as radio, television, newspapers, and the Internet must actively carry out public welfare publicity, popularize knowledge on epidemic prevention and control, publicize and interpret policies and measures, promote prevention and control work experience and practices, conduct public opinion guidance, respond to social concerns, and build a positive atmosphere of firm confidence in the whole society with all people fighting the epidemic outbreak.

No unit or individual may fabricate or spread false information about the epidemic situation.

According to the needs of epidemic prevention and control, the municipal and district peoples governments may establish cooperative mechanisms for epidemic prevention and control with relevant provinces and cities in the Yangtze River Delta region, strengthen information communication and work coordination, and work together to do joint epidemic prevention and control. Every unit and individual has the right to report the hidden dangers and risks of the spread of the epidemic to the peoples governments at all levels and relevant departments, and to report other matters in violation of this Decision. The authorities that accept the report shall investigate and deal with it in a timely manner. The Municipal Peoples Court and Peoples Procuratorate shall actively perform their duties, deal with various civil and commercial disputes related to epidemic prevention and control in accordance with the law, severely punish all kinds of illegal and criminal acts that hinder epidemic prevention and control, and provide timely judicial protection for epidemic prevention and control. In the work of epidemic prevention and control, any unit or individual who violates relevant laws and rules and this Decision shall be punished by relevant departments such as the public security organ according to law; if it causes damage to the person or property of others, it shall bear civil liability in accordance with the law, and shall be investigated for criminal responsibility according to law if a crime is constituted. As of individuals who have concealed medical history, travel history in particular areas, history of contact with infected or suspected patients, and evaded quarantine, etc., in addition to strictly investigating corresponding legal responsibilities in accordance with the law, relevant departments shall also report their untrustworthy information to this Municipality’s public credit information platform according to the provisions of the State and this Municipality, and shall take disciplinary measures according to law.

12. The Standing Committee of the Municipal Peoples Congress and the standing committees of the district peoples congresses shall strengthen the supervision of the implementation of this Decision by hearing special work reports and other methods.

The Standing Committee of the Municipal Peoples Congress and the standing committees of the district peoples congresses shall give full play to the role of deputies to the peoples congresses at all levels, collect and reflect the opinions and suggestions of the people, and urge relevant parties to implement various tasks for epidemic prevention and control.

This Decision shall be effective as of February 7, 2020, and the termination date shall be announced separately by the Standing Committee of Shanghai Municipal Peoples Congress.
