Decision of the Standing Committee of Shanghai Municipal People's Congress on Further Promoting and Guaranteeing the Construction of “One Network Administration” in City Operation

With a view to fulfilling the important concept of “city of the people”, propelling the digital transformation of city governance, promoting and guaranteeing the construction of the One Network Administration in city operation (hereinafter referred to as ONA, or Integrated Online Administration), raising the level of scientificalness, meticulousness and intelligence of city administration, and promoting the modernization of megacity governance system and governance ability, the following decision has been made according to the provisions of relevant laws and administrative rules, and in the light of the actual circumstances of this Municipality:

I. This Municipality shall promote the construction of ONA, with “a screen to view the world, a network to administrate the city” as the goal, adhere to governing by rules in combination with the wisdom of science and technology and the strength of the people, build a perfectly-structured administration and service system of city operation, realize digital presentation, intelligent administration and smart prevention, focus on the efficient handling of an incident and achieve early discovery, early warning, quick judgement, and quick handling, and continuously improve the efficiency of city governance.

II. The Municipal People's Government shall strengthen the organization and leadership of the construction of ONA, incorporate it into the national economic and social development plan, coordinate and solve the major problems in the construction of ONA, establish a new mode of digital and intelligent government operation, and improve the efficiency of city governance.

The district people's governments shall, in accordance with the overall requirements and deployment of the construction of ONA, draw up the implementation plan of their respective administrative areas, improve the working system of the construction of ONA, and the working mechanism of coordination, and deepen the collaboration of online and offline handling of an incident, expand the construction of scenarios for application, promote the innovation of digital and intelligent governance models, and increase regional governance efficiency.

Relevant municipal and district departments, government agencies and relevant units shall coordinate and promote the construction of ONA within their own systems, regions and units in an overall manner, and do well in the relevant comprehensive work of ONA according to their respective functions and duties.

The town/township people's governments and the sub-district offices shall implement the construction requirements of ONA in community-level governance, promote practical application, and improve the efficiency of community-level governance.

III. This Municipality shall establish city operation administrative agencies at three levels, i.e., the municipal, district, and town/township or sub-district levels, which shall be specifically responsible for the overall planning, coordination and promotion, supervision and guidance of the construction of ONA at the corresponding levels. The city operation administrative agencies at a higher level shall strengthen the professional guidance, supervision and inspection of the city operation administrative agencies at a lower level.

The municipal administrative agency for city operation shall be responsible for drawing up the intelligent administration strategy and development plan for city operation of the whole Municipality, studying and formulating standards and norms, strengthening the monitoring, analysis and early warning of city operation status, improving the hierarchical and classified commanding and handling system, and coordinating the joint response to major emergencies.

The district administrative agency for city operation shall strengthen the connection between the upper and lower levels and the integration of resources, integrate functions such as watch keeping and security guarantee, joint emergency response, resident hotline, and grid administration, improve its ability of daily administration and joint emergency response coordination in regional city operation, and improve the efficiency of handling comprehensive administration matters in city operation.

The town/township and sub-district administrative agencies for city operation shall strengthen their ability of front-line coordination and handling, and coordinate and handle specific problems in community-level governance by relying on the comprehensive law enforcement and joint work mechanisms at the community level. Where conditions permit, the town/township or sub-district administrative agencies for city operation may set up city operation workstations thereunder.

IV. This Municipality shall apply modern information technologies such as big data, cloud computing, Internet of Things (IOT), blockchain and artificial intelligence to build an Integrated Online Administration platform, which shall be planned, constructed, operated and maintained by the city operation administrative agencies, so as to integrate departmental incident handling systems, realize regulated data collection, unified standards, real-time update, and interconnection, and provide support for timely and precise detection of problems, docking of demands, analysis of situation  prevention of risks and effective handling of problems.

V. This Municipality shall, by relying on the Integrated Online Administration platform,  establish a five-level application system of the Municipality, districts, towns/townships and sub-districts, grid areas, and communities and buildings, strengthen command, coordination and on-site handling, and realize online and offline coordinated and efficient handling of an incident.

As for the problems in city operation that are found by relying on the the Integrated Online Administration platform, the city operation administrative agencies shall, according to their scope of administrative authority, dispatch orders to the relevant departments and units to promptly handle them; the relevant departments and units shall accept the dispatched order, promptly handle them, give feedback on the handling status, and accept the supervision and verification.

VI. Relevant municipal departments and the district people's governments shall, according to their respective functions and duties, strengthen the construction of application scenarios of the  ONA for major tasks, key areas and important fields.

The municipal and district administrative agencies for city operation shall strengthen the overall coordination and guidance of the construction of the application scenarios of ONA, regularly publish the construction of such scenarios to the society, and accept the supervision of the society.

VII. The people's governments at all levels shall give full play to the advantages of digital governance, actively rely on the Integrated Online Administration platform, earnestly fulfill their jurisdictional responsibilities, and effectively respond to natural disasters, accidental disasters, public health and social security emergencies, and other events affecting the safety of city operation according to law.

VIII. This Municipality shall apply the function of digital governance, and during the pandemic prevention and control period, implement measures for the verification of personal pandemic prevention and control information (i.e., verification measures such as “site code” or “digital sentinel”) to verify personal health information.

The departments designated by the municipal and district people’s governments shall be responsible for the overall coordination, organization and implementation of the measures for the verification of personal pandemic prevention and control information. The municipal and district administrative departments of relevant industries shall be responsible for the usual supervision, inspection and guidance of the implementation of the measures for the verification of personal pandemic prevention and control information in their respective industries and systems. The town/township people's governments and the sub-district offices shall earnestly supervise and guarantee the implementation of the measures for the verification of personal pandemic prevention and control information within their respective jurisdictions.

People entering and exiting from public places, residential communities and other places shall voluntarily accept the measures for the verification of personal pandemic prevention and control information in accordance with the provisions. Managers and operators of relevant sites shall carry out the measures for the verification of personal pandemic prevention and control information as required, report to relevant government departments in a timely manner if they find a case that does not meet the requirements for pandemic prevention and control, and cooperate with relevant government departments for joint handling. The collection and processing of personal pandemic prevention and control information during information verification shall comply with the provisions of relevant laws, rules and regulations on the protection of personal information. The personal information collected shall only be used for pandemic prevention and control and shall not be disclosed by any unit or individual.

The specific measures for the verification of personal pandemic prevention and control information shall be formulated separately by the Municipal People’s Government.

IX. This Municipality shall promote the construction of a digital indicator system for city operation, scientifically set an indicator system for city operation, and strengthen the real-time dynamic intelligent and accurate monitoring of city operation by relying on the Integrated Online Administration platform and the intelligent sensing system.

X. Relevant departments and units shall, in accordance with the construction requirements of  ONA and the relevant technical standards, rely on the big data resource platform to strengthen the collection and sharing of public data, promptly and dynamically update such data, ensure the accuracy of data, and improve the quality of data.

This Municipality shall encourage enterprises, e-commerce platforms and other market participants to participate in the development and construction of application scenarios of ONA, strengthen data sharing, and provide technical and data support for the construction of ONA.

In case of emergency response, relevant enterprises, e-commerce platforms and other market participants shall cooperate in the emergency response measures that are taken by the government according to law, provide necessary data support and jointly maintain the safety of city operation.

XI. This Municipality shall promote the integrated development of “Government Online-Offline Shanghai” and “One Network Administration”, relying on the big data resource platform and ing on data, scenarios and systems, advance the two-way integration and mutual coordination of the “two networks”, promote the transformation of government functions and procedure reshaping, the improvement of the capacity and level of digital governance, and the construction of a digital government.

XII. The municipal and district people’s governments and their relevant departments shall integrate the concepts of ONA and digital governance into city planning, construction and administration.

The municipal and district departments of planning and resources, housing and urban-rural development administration, transport and other relevant departments shall, when formulating relevant plans and establishing major projects, solicit opinions from the city operation administrative agencies at the same level.

XIII. The relevant municipal and district departments shall rely on the Integrated Online Administration platform to integrate and merge operational systems, strengthen data sharing, reduce repeated order dispatching and information submission, support the town/township people’s governments and the sub-district offices in performing their service and administration functions according to law, and reduce burdens and raise efficiency of the community level.

The departments of public security, market regulation, housing and urban-rural development administration, planning and resources, civil affairs, economy and informatization, health, and human resources and social security shall provide the basic data of population, legal persons, and housing to the town/township people’s government and the sub-district office according to law, and enable community-level governance.

XIV. This Municipality shall encourage and support individuals, enterprises, and social organizations to actively participate in the construction of ONA, give play to the role of “12345” citizen service hotline and the information collecting function of opinion solicitation and real-time photo uploading, expand participation channels and means, reflect the public opinion, respond to public demands, promote the construction of a city of the people, by the people, and for the people.

XV. The people’s governments at all levels shall incorporate the construction funds for  ONA into their respective fiscal budgets, implement project database management, establish a  scientific and efficient project examination and approval mechanism in line with the construction of ONA, and guarantee the project funds.

XVI. The people’s governments at all levels shall, according to the requirement of the construction of ONA, innovate the talents guarantee mechanism, strengthen staffing through the appointment system of civil servants and the introduction of professional and technical personnel, raise and improve the ability and the quality of the personnel, and include the specialized knowledge of ONA and digital governance into the training contents of community-level staff, civil servants and leading cadres.

This Municipality shall establish an expert consultation mechanism for ONA to provide expert consultation opinions on the technical, safety, legal and other issues involved in the construction of ONA.

XVII. The departments and the units relevant to the construction of ONA shall, in accordance with the relevant laws, rules and regulations, and safety technical standards, establish and improve the risk assessment, safety review, instant monitoring and emergency response mechanisms, strictly implement the system of classified protection of network security, strengthen the classified and graded protection of data, and perform the obligation of personal information protection in accordance with the law.

XVIII. The municipal and district people's governments shall strengthen the assessment of the effectiveness of the construction of ONA by the people’s governments at lower levels and the relevant departments, and take the assessment results as an important basis for the annual performance assessment, and the comprehensive assessment and evaluation of leading cadres.

XIX. This Municipality shall support Pudong New Area in making innovative explorations in such aspects as the working mechanism, governance concept, governance model and governance means in the construction of ONA, and take the lead in building a governance system featuring coordinated promotion and organic connection of economic governance, social governance and city governance; if the conditions are mature, such explorations may be promoted in the whole Municipality.

XX. This Municipality shall give full play to the role of ONA in promoting the regional coordinated governance of the Yangtze River Delta, and strengthen the cooperation and exchanges in the construction of ONA.

XXI. The Standing Committee of the Municipal People’s Congress shall, based on the actual needs of the construction of ONA, formulate and amend relevant local rules or make provisions in relevant local rules to promote and guarantee the construction of ONA.

The standing committees of the municipal and district people’s congresses shall strengthen supervision over the implementation of this Decision by hearing special work reports and other relevant means,

The standing committees of the municipal and district people’s congresses shall give full play to the role of deputies to the people’s congresses at various levels, collect and reflect the opinions and suggestions of the people, and urge relevant parties to carry out various work of the construction of ONA.

XXII. Where relevant departments or their staff members do not accept the overall coordination, order dispatch or supervision and verification by the city operation administrative agencies, do not collect or share public data according to the requirements, do not perform their statutory duties or do not do so correctly, they shall be corrected, and be given sanctions in accordance with the law by their units or superior departments.

XXIII. During the period of pandemic prevention and control, if a site manager or operator fails to fulfill the responsibility for verification of personal pandemic prevention and control information in accordance with the provisions, the relevant administrative department shall order him/her to make corrections and impose punishment thereon according to law. The site manager or operator has the right to refuse entry to the persons who do not meet the requirements in the relevant provisions of the Municipal People’s Government and refuses to accept the verification of personal pandemic prevention and control information.

If, during information verification, there is any violation of relevant provisions of laws, rules or regulations on the protection of personal information regarding the collection and processing of personal pandemic prevention and control information, relevant administrative departments shall order the wrongdoer to make corrections, and impose punishment thereon according to law.

Where an individual or a unit commits any act that disturbs public order or impedes public safety, which constitutes a violation of the provisions on public security administration, the public security organ shall impose punishment according to law; if such violation causes damage to the body or property of another person, the violator shall bear civil liability according to law; if a crime is constituted, the wrongdoer shall be investigated for criminal liability according to law. The relevant departments shall, in accordance with the provisions of the State and this Municipality, collect and submit their dishonesty information onto this Municipality’s public credit information platform, and take disciplinary measures according to law.

This decision shall be effective as of May 24, 2022.
