Chapter I General Provisions
Article 1 With a view to fully implementing the rural revitalization strategy, promoting the comprehensive upgrading of agriculture, the comprehensive progress of rural areas, the all-round development of farmers, and accelerating the modernization of agriculture and rural areas, these Regulations are formulated in accordance with the Law of the People's Republic of China on Rural Revitalization Promotion and other laws and administrative rules, and in the light of the actual circumstances of this Municipality, .
Article 2 The implementation of the rural revitalization strategy shall adhere to the leadership of the Communist Party of China, follow the general requirements of industrial prosperity, ecological livability, civilized rural customs, effective governance, and affluent life, implement new development concepts, adhere to the priority development of agriculture and rural areas, and adhere to the dominant position of farmers, adhere to the harmonious coexistence of man and nature, adhere to reform and innovation, adhere to adapting measures to local conditions, plan ahead, and proceed step by step, promote the construction of beautiful homes, green countryside, and happy paradises, build a new pattern of mega-city space, and promote urban-rural integration and development.
Article 3 This Municipality shall establish and improve the leadership responsibility system for the promotion of rural revitalization under the unified leadership of the Party Committee, the responsibility of the government, and the overall coordination of the rural work department of the Party Committee, and improve the rural revitalization linkage working mechanism in which the city takes overall responsibility and the districts and towns/townships focus on implementation.
People's governments at all levels shall incorporate rural revitalization promotion work into national economic and social development plans and annual plans, study and coordinate major issues in rural revitalization promotion work, and establish rural revitalization assessment and evaluation, work annual reports, and supervision and inspection systems. The district people's government assumes the primary responsibility for the promotion of rural revitalization within its administrative region. The town/township people's government is responsible for the implementation of the rural revitalization and promotion work within its own administrative area.
The agricultural and rural departments are responsible for the overall coordination, policy guidance, promotion and implementation, supervision and inspection of rural revitalization and promotion work within their respective administrative regions. Development and reform, finance, housing and urban-rural development, planning resources, economic informatization, education, science and technology, civil affairs, human resources and social security, ecological environment, water affairs, cultural tourism, health, finance, and other relevant departments are responsible for the rural revitalization promotion work within their respective responsibilities fields
Article 4 Villagers committees and rural collective economic organizations shall, under the leadership of town/township party committees and village party organizations, handle the public affairs of the village in accordance with the law, develop and expand the collective ownership economy and public welfare undertakings in the village, safeguard the lawful rights and interests of the villagers, and accept the supervision of the villagers.
This Municipality shall support and guide enterprises, public institutions, people's organizations, social organizations and other social sectors to participate in activities related to the rural revitalization promotion.
Encourage all kinds of enterprises to participate in the construction of major rural revitalization projects and accelerate the development of rural industries. State-owned enterprises shall strengthen the role of demonstration and leadership, give full play to their own advantages, and participate in the promotion of rural revitalization.
Article 5 The municipal and relevant district people's governments shall, according to the national economic and social development plan, organize the formulation of the rural revitalization plan, which shall be linked with the national land and space planning, and form a planning system integrating urban and rural areas, regions, and multi-plans.
The rural revitalization plan shall coordinate the development of urban and rural industries, infrastructure construction, guarantee of basic public services, utilization of resources and energy, and ecological and environmental protection.
Article 6 This Municipality shall implement the strictest system of arable land protection, establish a three-level arable land protection responsibility mechanism at the municipal, district and town/township levels, improve the assessment of arable land protection responsibility targets, implement the regulation on the use of arable land, strictly observe the red line for arable land and permanent basic farmland protection, and strictly implement compensation for occupation of arable land, and improve the monitoring and supervision mechanism for the quantity and quality of cultivated land. Establish a joint inspection and law enforcement system for farmland protection, and strictly implement inspection and law enforcement responsibilities.
Article 7 The people's governments at all levels shall implement the national food security strategy, strictly assess the food security responsibility system, adhere to the principle of storing grain in the land and technology, formulate policies to support grain production, promote the construction of high-quality grain projects, and improve grain processing, circulation, reserve and emergency security systems to improve food supply and security capabilities. Adhere to the priority of saving, strengthen food security education, and oppose food waste.
Article 8 This Municipality shall establish and improve a mechanism conducive to the steady growth of farmers' income, and promote the quality and efficiency of agricultural development by improving support policies such as finance, land use, employment, subsidies, etc., and promote the coordinated development of ecological protection and farmers' income increase; deepen rural collective property rights system reform, realize the appreciation and preservation of rural collective assets and the annual income distribution of collective economic organizations; expand employment channels for rural labor force, improve farmers' social security level, increase farmers' income, narrow the gap between urban and rural areas, and promote common prosperity.
Article 9 This Municipality shall promote the establishment of a working mechanism for jointly promoting rural revitalization in the Yangtze River Delta region, strengthen inter-governmental cooperation, and promote the protection of biodiversity in the Yangtze River Basin, rural leisure tourism, talent training for rural revitalization, rural science and technology services, and beautiful rural construction, urge regional coordination and promote the integrated development of rural revitalization.
This Municipality shall support relevant districts to deepen cooperation with adjacent areas in Jiangsu and Zhejiang provinces, build regional brands, and form a spatial pattern of harmonious coexistence of green pastoral, quaint villages, modern towns, and industrial parks, and achieve an organic combination of ecological priority, green development, and rural revitalization.
This Municipality and Jiangsu Province and Anhui Province shall establish a coordinated promotion mechanism to promote the high-quality development of out-regional farms in Shanghai to better promote industrial development and infrastructure construction, give full play to its advantages and characteristics, and improve the supply capacity and quality level of safe and high-quality staple and non-staple food, and build modern farms that match a mega-city.
Chapter II Urban-rural Integration
Article 10 The people's governments at all levels shall coordinately promote the implementation of the rural revitalization strategy and the new-type urbanization strategy, optimize the urban-rural space system, and promote the coordinated development in spatial layout, industrial economy, public services, ecological protection, infrastructure construction and other aspects. Give full play to the agglomeration function and empower role of the new city, reflect the economic value, ecological value, and aesthetic value of the countryside, and build a new pattern of urban-rural integrated development.
Article 11 The people's governments at all levels shall coordinate the planning and construction of urban and rural public infrastructure, promote the extension of municipal infrastructure such as roads, gas, communications, logistics, and passenger transport to rural areas, and accelerate the construction of new infrastructure such as new-generation communication base stations and new-energy vehicle charging piles, and UHV, intercity high-speed railways, urban rail transit, etc., promote the interconnection of urban and rural infrastructure, and guarantee the needs of rural development.
People's governments at all levels shall strengthen the construction of rural digital infrastructure, and support the improvement of village-level comprehensive service facilities and comprehensive information platforms.
The people's governments at all levels shall, according to their respective powers, undertake the responsibility for the management and protection of rural public infrastructure, guarantee the management and protection funds, compile a list of management and protection responsibilities, clarify the management and protection objects, subjects and standards, etc., and make them public.
Encourage social capital to participate in the construction, operation and management of rural public infrastructure.
Article 12 This Municipality shall establish and improve the development mechanism of urban-rural integration and balanced promotion in the fields of compulsory education and medical and health care.
The municipal and relevant district people's governments shall coordinate urban and rural educational resources, improve the mechanism of joint advancement of urban and rural schools, continuously improve the conditions for running schools in rural schools, and improve the quality of rural education. The use of education funds shall tilt further to weak areas and key links, and the priority in annual increment of education funds shall be given to the development of basic education in rural areas in the outer suburbs.
The municipal and relevant district people's governments shall increase investment in rural grass-roots medical and health institutions, and improve rural medical and health services, medical emergency support, and the ability to respond to public health emergencies. The health department shall guarantee the supply of essential medicines for rural grass-roots medical and health institutions, strengthen the construction of medical consortia, and promote the balanced distribution of high-quality medical and health resources in urban and rural areas.
Article 13 The municipal and relevant district people's governments shall improve the public employment and entrepreneurship service system integrating urban and rural areas, improve the unified employment statistics and unemployment assistance policies for urban and rural areas, promote the formation of a human resources market with equal competition, standardization and order, and integrate urban and rural areas, and make overall plans to promote rural labor employment.
Human resources and social security departments shall improve the support policies for promoting farmers' employment and entrepreneurship, strengthen training and guidance, rationally deploy grass-roots employment service sites, regularly carry out employment and entrepreneurship services in rural areas, follow up and analyze the employment situation of farmers in this Municipality, and publicize the situation and policies of rural employment and entrepreneurship to guide farmers to establish employment concepts that meet market requirements.
Article 14 This Municipality shall, according to the economic and social development conditions, improve the basic endowment insurance, basic medical insurance, critical illness insurance, urban and rural subsistence allowances, medical assistance and other systems for urban and rural residents, and continuously improve the level of rural social security.
The people's governments at all levels shall promote the development of the rural elderly care undertaking, distribute elderly care service facilities in a balanced manner, innovate elderly care service models suitable for the characteristics of rural areas, develop rural inclusive elderly care and mutual aid elderly care services, and support the use of farmer houses and rural collectively-owned land and houses. and other resources, and build elderly care service facilities according to local conditions.
Article 15 Relying on the urban digital transformation, this Municipality shall use big data, cloud computing and other technologies to strengthen the digital construction of rural areas, enhance the collection and application of data in the agricultural and rural areas, and promote the deep integration of agricultural data resource databases, network platform information systems, and agricultural spatial geographic information systems. Relying on the "Government Online-Offline Shanghai" for government services and the "One-network Management" for urban operations, promote the construction of digital application scenarios for rural public services and management, realize the online operation of village-level affairs such as information release, public opinion collection, discussion and consultation, and public services, and improve the digital and intelligent level of rural public services.
Article 16 The relevant district people's governments shall comprehensively consider the rural settlement pattern and the layout of land used for infrastructure and public service facilities, according to the space range that can be reached by slow travel, for the functional positioning and service groups in different rural areas, and make differential allocation based on the specific needs of the village. strengthening the composite utilization of space, establishing a network of infrastructure and public service facilities with the whole regional coverage, inclusive sharing, and integration of urban and rural areas, gradually building a rural community life circle, and improving the quality of rural life.
Chapter III Industrial Development
Article 17 The municipal and relevant district people's governments shall, according to the national land and space planning and the rural revitalization plan, organize the formulation of plans for the development of rural industries and special agricultural projects.
Rural industry development, agricultural special projects and other plans shall be used as an important basis for the examination and approval of rural industry development projects.
Article 18 This Municipality shall promote the high-quality integrated development of the primary, secondary and tertiary industries in rural areas, and support the development of modern planting industry, modern breeding industry, agricultural product processing industry, agricultural materials and agricultural machinery industry, rural commercial and trade circulation industry, rural leisure tourism and other industries.
The district and town/township people's governments shall combine resource advantages and industrial characteristics to promote the development of modern rural industries that combine agriculture with tourism, culture, health, elderly care, sports, new energy and other industries.
Article 19 The people's governments at all levels shall take measures to improve the comprehensive agricultural production capacity, vigorously promote the construction of urban modern agriculture, support the construction of permanent basic farmland with high standards, and delineate, protect and build functional areas for grain production, protected areas for vegetable production, and advantageous areas of featured agricultural products, and enhance the production and supply capacity of important agricultural products such as grain, vegetables, livestock and poultry, aquatic products, and major economic crops
Agricultural and rural departments shall work with relevant departments to strengthen the construction of modern agricultural infrastructure such as high-standard farmland, farmland water conservancy, fishing ports, agricultural product fresh-keeping storage and logistics, agricultural machinery warehouses, etc., building smart agriculture demonstration bases, encouraging the production, research, development and promotion of agricultural smart facilities and equipment, and promoting the application of information technology in agricultural production, operation, management and services.
Agricultural and rural departments shall carry out agricultural information monitoring, early warning and comprehensive services.
Article 20 People's governments at all levels shall carry out agricultural green development actions, take measures to promote the reduction of chemical inputs, develop planting and breeding circular agriculture, and implement organic fertilizers to replace chemical fertilizers, green prevention and control of pests and diseases, and the resource utilization or harmless treatment of agricultural wastes such as crop straws.
This Municipality shall support the development of soil ecological conservation technology research and development, the implementation of soil ecological restoration demonstration projects, and the acceleration of soil ecological conservation in key areas.
Article 21 This Municipality shall improve the agricultural scientific research investment guarantee mechanism, support agricultural scientific and technological innovation, strengthen the innovation capabilities of colleges and universities, scientific research institutions and enterprises, and increases R&D investment in the fields of provenance agriculture, smart agriculture, ecological agriculture, and facility agriculture, establish and improve the innovation platform, promote the transformation of agricultural scientific and technological achievements, and strengthen the construction of national agricultural science and technology parks in Pudong, Chongming and Jinshan.
This Municipality shall strengthen the construction of agricultural technology spread system, support agricultural technology spread institutions to cooperate with institutions of higher learning, scientific research institutions and other units to accelerate the popularization and application of agricultural technology through experiments, demonstrations, training, guidance and consulting services.
Encourage enterprises, farmers' professional cooperatives or other social organizations to provide agricultural technology spread services through technology contracting, technology equity participation, etc.
Article 22 The municipal and relevant district people's governments shall organize the formulation and implementation of the seed industry development plan, strengthen the construction of the germ plasm resource bank and the breeding base of fine seeds, strengthen the protection and utilization of germ plasm resources, enhance the scientific and technological innovation capability of the seed industry, and improve the seed industry developing incentive mechanisms, strengthen intellectual property protection in the field of breeding, build seed industry enterprises with independent intellectual property rights and international competitiveness, and promote high-quality development of the seed industry.
The agricultural and rural departments shall, in conjunction with the planning resources and other departments, formulate and improve policies and measures to support the development of the seed industry, promote the tilt of facilities agricultural land-use to the construction of seed source facilities, and give priority to supporting R&D seed industry enterprises and seed industry scientific research institutions in terms of construction-use land indicators; establish and improve the system of seed selection, breeding, and spread, promote the commercial breeding, emphasize on the development of advantageous and characteristic varieties, strengthen the supervision of the seed industry market, and regulate the development of the seed industry.
This Municipality shall support colleges and universities, scientific research institutions and enterprises to promote the key core technologies of the seed industry and the industrial application of biological breeding, and provide basic, cutting-edge and applied technology-based research and guarantees for the innovative development of the seed industry.
Article 23 This Municipality shall strengthen the cultivation, protection and promotion of regional public brands of agricultural products, and increase the registration and protection of geographical indications of agricultural products. Encourage the registration of regional brands and geographical indications in the form of collective marks and certification marks.
The relevant district people's government shall formulate policies and measures according to the regional resource advantages, and cultivate and develop advantageous agricultural product producing areas and well-known brands with obvious characteristics and strong competitiveness.
Support agricultural product producers to apply for the use of green food labels and geographical indications of agricultural products in accordance with the provisions, and carry out the organic agricultural product certification.
Article 24 This Municipality shall guide agricultural enterprises, farmers' professional cooperatives, family farms, agricultural socialization service organizations and other agricultural business entities and service entities to improve the quality of development, and support them to establish a close interest linkage mechanism with farmers by means of contract farming, shareholding cooperation, dividends and rewards, service collaboration, etc., so as for farmers to share the value-added benefits of the entire industry chain.
This Municipality shall support all kinds of agricultural business entities to expand the market functions of agricultural product origins, and develop central kitchens, clean vegetable processing, and staple food processing nearby, so as to achieve efficient connection between production and processing, and logistics and distribution.
Article 25 The municipal and relevant district people's governments shall develop rural leisure tourism, explore the multiple functions of agriculture and the multiple values of the countryside, carry out leisure tourism activities with rural characteristics according to local conditions, and coordinate the development of rural home-stays, leisure parks, ecological parks, and rural leisure tourism gathering villages and other formats.
The municipal and relevant district people's governments shall establish and improve the promotion mechanism for the development of rural home-stays, take the promotion of the development of rural home-stays as an important part of the rural revitalization work, and support the development of the rural home-stay industry and the construction of supporting infrastructure. The relevant district people's government shall formulate a development plan for the country home-stay, cultivate regional characteristic brands, and promote the integrated development of the country home-stay industry and related industries.
Relevant municipal departments shall formulate standards for country home-stay building, fire protection, food, sanitation, environmental protection (water source protection area), etc., clarify responsible departments and work processes, optimize approval procedures, establish a country house management information exchange and sharing mechanism, and strengthen interim and post-event supervision.
Encourage farmers, rural collective economic organizations and other individuals and organizations with professional management capabilities to participate in the construction, operation and management of rural leisure tourism projects by means of self-operation, leasing, joint operation, and shareholding.
Article 26 The municipal and relevant district people's governments shall, according to the endowment of agricultural resources and industrial foundation, create areas for modern green agricultural industries such as characteristic fruits and vegetables, integration of agriculture and tourism, modern livestock and poultry breeding, high-end facility agriculture, and unmanned farms, as well as rural health and well-being areas. urban pastoral and other rural industries characteristic areas.
Article 27 The municipal and relevant district people's governments shall strengthen the guarantee of factors such as science and technology, talents, and land use, strengthen the planning and construction of modern agricultural industrial parks such as Hengsha Dongtan, and promote the concentration into industrial parks of scientific and technological research and development, agricultural production, processing logistics, and marketing services, and improve the modernization level of the industrial chain and supply chain.
Chapter IV Ecological Livability
Article 28 The relevant district people's governments shall, in accordance with the overall planning of national land and space, organize the preparation of the overall planning of national land and space at the town level, coordinate the development of towns and villages, and clarify the overall development goals, core indicators and spatial layout.
The town/township people's government shall scientifically formulate and adjust the rural unit village planning, optimize the village layout, and report it to the district people's government for examination and approval according to the overall planning of land and space and in combination with the rural revitalization plan. The rural unit village planning shall serve as the legal basis for issuing planning permits for rural construction projects and for the implementation of various rural construction projects, and guide the design of villages.
When compiling rural unit village planning, comprehensive consideration shall be given to the characteristics of the population, industry, function, scale, and space of the village, as well as the requirements of land use, industrial development, infrastructure layout, ecological protection, and historical and cultural inheritance, and the village construction shall be promoted in a classified and orderly manner.
Strictly regulate the withdrawal and merge of villages, and strictly prohibit the withdrawal and merge of villages against the wishes of farmers and legal procedures.
Article 29 This Municipality shall, in accordance with the steps of scheming, planning, design and implementation, follow the requirements for the control of land and space use and relevant construction standards, implement the whole-process planning and construction management of rural construction projects, promote rural construction in an orderly manner, and improve the overall rural landscape, highlighting the rural characteristics.
Relevant district and town/township people's governments shall carry out village design, strengthen the guidance of village style and features, highlight local characteristics and regional characteristics, preserve the natural texture of the countryside, excavate traditional elements, promote the coordination of village forms with the natural environment and traditional culture, and promote the construction of beautiful villages.
Explore the establishment of a rural responsible planner system to improve the quality of rural construction.
Article 30 This Municipality shall advocate moderate saving, green and low-carbon, civilized and healthy production, living and consumption patterns, carry out the improvement of rural production and living environment, and promote the optimization and improvement of rural living environment. It is prohibited to illegally transfer industries and enterprises that pollute the environment and damage the ecology to rural areas.
People's governments at all levels shall increase their investment in coordinating the construction, operation, maintenance and management of rural domestic waste treatment and recycling and domestic sewage treatment facilities, promote the segregation and reduction of domestic waste, standardized disposal of construction waste, and centralized treatment of domestic sewage, and continue to promote rural sanitation and toilet upgrading transformation.
The villagers committee shall strengthen the improvement of the village appearance and environment, carry out greening and beautification on both sides of rivers and roads, in front of and behind houses and in courtyards, and keep the public space of the village clean, orderly and pleasing to the eye.
Article 31 On the premise of respecting the wishes of farmers, this Municipality shall adopt the modes of concentration in cities and towns as the principal as well as translation concentration and monetization exit, etc., to promote the relatively concentrated living of farmers, and encourage the promotion of the whole system with the streets and towns as units.
The people's governments of relevant districts and town/townships shall give priority to the protection of relatively concentrated residential land for farmers; among them, those who live concentrated in cities and towns shall be preferentially arranged in large residential communities and surrounding plots that are currently used for construction purposes. Adjust and optimize the layout and land use scale of rural translation concentrated residential sites, and where the occupation of cultivated land is involved, implement measures such as land use compensation balance in accordance with relevant provisions.
The space vacated by farmers in this Municipality’s relatively concentrated living is given priority to the development of rural industries, the construction of public infrastructure and the construction of beautiful villages, to promote the development of rural collective economy and the improvement of rural living environment.
Article 32 The people's governments of the relevant districts shall strengthen policies and fund guarantees, and adopt various modes to meet the residential needs of rural villagers. Adhere to the guidance of planning and implement policies by category, and protect the rights of rural villagers to build, rebuild, expand and renovate houses in accordance with the law.
The people's governments of the relevant districts are responsible for coordinating the construction of rural villagers' houses within their respective jurisdictions, formulating and improving specific plans for rural villagers' house building, encouraging the improvement of villagers' living conditions and environment by means of unified construction and joint construction, etc., and guiding rural villagers to save the use of land resources.
The town/township people's government shall implement the rural unit village planning and implement specific plans for building houses.This Municipality shall establish a whole-process construction management system including the design, construction, and acceptance of rural housing. The people's governments of relevant districts and town/townships shall strengthen the management of the style and quality and safety of rural houses, implement the rural architect system, improve the inspection and acceptance system of rural houses, improve the normal inspection and grid-based dynamic management system for the safe use of houses, and explore the establishment of regular housing physical examinations and housing insurance system. Encourage the use of new construction technologies and green building materials in rural housing construction.
The town/township people's government shall provide convenient services for rural villagers to handle the examination and approval of house building.
Article 33 This Municipality shall continue to promote the reduction of inefficient construction land. In accordance with the principle of “the cultivatable, cultivated, and land suitable to forest. forested”, continue to promote the reduction and of existing inefficient construction land outside the planning and development boundary, effectively increase the area of cultivated land, and carry out later management and protection. Formulate and implement the annual inefficient construction land reduction plan, carry out soil testing, and safely utilize the land resources formed by the reduction.
This Municipality shall coordinate the promotion of the integrated protection and restoration of mountains, rivers, forests, fields, grasses and sands. Adhere to giving priority to conservation, protection, and natural restoration, formulate and implement specialized plans for ecological restoration of land and space, promote the integrated development of green spaces, woodlands, wetlands, and sea areas, improve biodiversity maintenance capabilities and carbon sequestration potential, and ensure the safety of rural ecosystems .
Chapter V Cultural Prosperity
Article 34 The people's governments at all levels shall encourage the creation of various excellent works reflecting the themes of rural life and rural revitalization practices in accordance with the rural cultural traditions and the cultural needs of farmers, and promote the incorporation of rural culture with local characteristics into the construction of the "Shanghai Culture" brand , inherit and carry forward the red culture, Shanghai-style culture, Jiangnan culture and other characteristic cultures.
Article 35 The people's governments at all levels shall improve the rural public cultural and sports facilities network and service operation mechanism, increase the construction and resource distribution of rural cultural and sports facilities, optimize the layout of rural comprehensive service facilities, and enrich rural cultural and sports life.
This Municipality shall encourage the development of various forms of mass cultural and sports activities, festivals and folklore and other activities, and expand rural cultural service channels by means of media such as radio, television and the Internet.
Article 36 The people's governments at all levels shall take measures to protect and inherit agricultural cultural heritage and intangible cultural heritage, explore the profound connotation of excellent agricultural culture, and develop and expand excellent traditional culture.
The municipal and district people's governments shall strengthen the protection of famous historical and cultural towns and villages in China, traditional villages and rural features, immovable cultural relics, agricultural relics, and agricultural cultural display areas, and promote the overall protection of rural cultural ecology.
The Municipality shall encourage and support qualified villages to build village history museums and compile village chronicles relying on characteristic culture and characteristic industries.
Article 37 The people's governments at all levels shall strengthen the construction of rural characteristic cultural industries, promote the orderly integration of rural characteristic cultural industries, rural sports industries and rural tourism, and support the inheritance and development of rural traditional crafts and local specialties.
This Municipality shall promote the introduction of agricultural culture education into campuses, make overall use of existing resources to build labor education and student social practice bases, and guide primary and secondary school students to participate in agricultural science popularization, agricultural experience and rural social practice.
Chapter VI Rural Governance

Article 73 If the people's governments at all levels and their relevant departments fail to perform or incorrectly perform their duties in the promotion of rural revitalization, they shall be accountable according to law, and the persons in direct charge and other persons held responsible shall be punished according to law. Chapter XII Supplementary Provisions
