Provisions of Pudong New Area of Shanghai Municipality on Recycling Solid Wastes as Resources

Article 1

With a view to promoting the building of a “zero-waste city” in Pudong New Area, accelerating the formation of a solid waste treatment mode suitable for urban green development, taking the lead in realizing the whole-process solid waste treatment from source classification to resource recycling, and comprehensively improving the efficiency and level of resource recycling, these Provisions are formulated in accordance with the basic principles of relevant laws and administrative rules, and in the light of the actual circumstances of Pudong New Area.

Article 2

These Provisions shall apply to the activities related to the recycling of solid wastes as resources within the administrative area of Pudong New Area.

Article 3

Pudong New Area shall, in accordance with the principles of overall planning, rational layout, government guidance and pluralistic co-governance, create a model of solid waste resource recycling which features smooth circulation, efficient utilization, ecological friendliness and intelligent innovation, and take the lead in achieving near-zero landfill of solid wastes on the basis of achieving zero landfill of raw household wastes.

Article 4

The Municipal People’s Government shall strengthen its leadership over solid waste resource recycling, deepen its cooperation with the relevant departments of the State, and coordinate the major issues in solid waste resource recycling in Pudong New Area.

Pudong New Area People’s Government shall strengthen its leadership over solid waste resource recycling in its administrative area, establish a comprehensive management system and mechanism with definite work division, clear powers and responsibilities, and synergistic efficiency, and promote the implementation of relevant work.

Article 5

The municipal departments of development & reform, landscaping and city appearance, planning and resources, ecology and environment, housing and urban-rural development administration, economy and informatization, commerce, agriculture and rural affairs, transportation, finance, etc. shall perform their respective functions and duties according to the provisions, improve policies and measures, deepen institutional innovation, and support and guarantee the solid waste resource recycling work in Pudong New Area.

The Pudong New Area’s departments of development and reform, landscaping and city appearance, planning and resources, ecological environment, construction?and transportation, technology and economy, commerce, agriculture and rural affairs, finance, etc. shall, in accordance with their respective functions and duties, do a good job in the relevant work.

Article 6

Pudong New Area shall establish a system for solid waste resource recycling, establish and improve the methods for solid waste resource recycling, define the responsibilities of various entities such as the government, enterprises and individuals, and promote the green, low-carbon and circular development of all links of the system including production, circulation, consumption and treatment.

Article 7

Pudong New Area People’s Government shall organize the implementation of investigation and assessment of the capacity of recycling solid waste resources, and, in accordance with the requirements of utilizing everything that should and can be utilized, formulate a special plan for solid waste resource recycling to define such contents as the development objectives, indicator system, main tasks, key fields, project layout, safeguard measures, etc.

Article 8

Pudong New Area People’s Government shall establish and improve an indicator system for solid waste resource recycling with the rate of resource productivity and the rate of resource recycling as the core indicators, and link this system with the indicator system for green development and the indicator system for building a “zero-waste city”.

Article 9

Pudong New Area shall take measures to support enterprises in adopting advanced production technology and equipment so as to reduce the output of industrial solid wastes; improve the efficiency of comprehensive utilization of industrial solid wastes, promote green design, and ensure more products can be disassembled and recycled; and, in the light of the actual conditions of the industry, identify key sectors and areas, implement the system of the producer’s extended responsibilities and establish a reverse recycling system for waste products.

Pudong New Area shall support the development of high-end and intelligent remanufacturing industries.

Article 10

Pudong New Area shall promote the full utilization of main agricultural solid wastes, increase diversified utilization of crop straws, vegetable wastes and green forest wastes, strengthen the recycling of discarded agricultural films and pesticide packaging wastes, and expand the utilization of livestock and poultry feces as resources.

Article 11

Pudong New Area shall gradually achieve comprehensive recycling of construction wastes as resources. Decoration wastes, house demolition wastes and construction waste concrete shall be collected in full quantity and treated in resource recycling facilities. In accordance with relevant provisions, the system of compulsory use of products made from recycled resources shall be implemented.

On the basis of the municipal requirements of compulsory use of the products from construction waste recycling, Pudong New Area may further expand the scope of compulsory use and increase the proportion of compulsory use.

Pudong New Area shall promote in municipal construction projects the use of products from construction waste recycling that conform to the requirements.

Article 12

Pudong New Area People’s Government and relevant departments shall take measures to unblock the channels for the recycling of recyclable household wastes, establish standardized and orderly recycling chains, cultivate and support the intensive development of the main enterprises, and encourage standardized and regulated chain management.

Pudong New Area shall promote new recycling technologies and modes, support renewable resource recycling enterprises to establish online trading platforms, so as to realize the integration of online waste delivery and offline recycling.

Pudong New Area shall explore new techniques of recycling wet garbage as resources, expand resource utilization, open up the outlets of the products and increase their utilization value.

Article 13

Pudong New Area shall accelerate the establishment of a system for recycling solid wastes as resources, and, on the principle of environmental friendliness and in accordance with the planning and standards, set up service points, transfer stations and collection and distribution sites for the delivery of recyclables, and shall build facilities for recycling household wastes, construction wastes, industrial solid wastes, etc., and incorporate the classified collection facilities for solid wastes such as household wastes and construction wastes into urban infrastructure and public facilities.

Article 14

Pudong New Area shall encourage and support the development of solid waste resource recycling projects and the steady development of relevant enterprises, and aim to obtain more environmental and social benefits out of its management of the whole life cycle of land.

Article 15

In accordance with the needs of this Municipality and Pudong New Area to develop the recycling of solid wastes as resources, the Laogang, Liming and other solid waste resource recycling parks shall be built in Pudong New Area.

The Laogang Park shall be built into a strategic support base for comprehensive disposal of solid wastes, a demonstration base for the recycling of resources, a pilot base for scientific innovation and popularization of environmental protection, and a base for intelligent green ecology.

The Municipal and Pudong New Area People’s Governments may designate specific entities to be responsible for unified planning, unified development and construction, unified operation and dispatching, and unified management and service of the solid waste resource recycling parks.

Pudong New Area shall give full consideration to the geographical location, target positioning and development needs of the solid waste resource recycling parks, and plan the supporting public facilities and road transportation facilities around the parks.

Article 16

The solid waste resource recycling parks shall establish and improve their ecological and environmental protection indicator systems, and apply advanced technical design and pollution prevention and control technology and low-carbon technology, so as to reduce the total amount of pollutant discharge and carbon emissions.

The solid waste resource recycling parks shall be encouraged to gradually establish recycling systems that cover materials, energy and water by integrating and upgrading all kinds of facilities, resources and energy within the parks, so as to maximize the efficiency of resource and energy utilization.

Efforts shall be made to explore innovative market-based electricity trading modes by resource recycling enterprises in Laogang, Liming and other parks.

Article 17

This Municipality shall establish and improve a system of standards for solid waste resource recycling. The municipal departments of landscaping and city appearance, housing and urban-rural development administration, economy and informatization, agriculture and rural affairs, and transportation shall be responsible for organizing the compilation of relevant standards and norms for solid waste resource recycling within their respective responsibilities.

Pudong New Area shall establish a system for the use of products from recycled solid waste resources. Party and government organs and public institutions shall give priority to the use of such products. Units and individuals shall be encouraged and guided to use various kinds of products from recycled solid waste resources.

Article 18

Pudong New Area shall set aside a certain proportion of the planned industrial land for the development of the industry of solid waste resource recycling.

For the new recycling projects in the resource recycling parks, the construction land quota and the balance quota for farmland occupation compensation shall be arranged in an overall manner at the municipal level.

For solid waste resource recycling projects, land may be supplied by means of grant or lease with government planning. The starting price for the grant of industrial land may be executed in accordance with the lowest price for the grant of industrial land.

Article 19

For solid waste resource recycling projects that really need to be implemented and constructed as a whole, innovation and optimization of land supply shall be encouraged on the premise that the State’s bottom line of the grant scale is not crossed, and the requirements for project commencement and completion are clearly defined.

Article 20

The municipal department of planning and resources shall strengthen the overall planning for the utilization of state land resources in the Laogang Park, and, on the premise of complying with the territorial space planning and the general requirements for territorial space use control, give priority to the allocation of planned industrial land quota to the Laogang Park, so as to guarantee the implementation of solid waste resource recycling projects.

In the case of the reserved land in the Laogang Park, a special entity designated by the Municipal People’s Government as entrusted by the land reserve institution may conduct early-stage development, with the expenses therefor included in the costs of land acquisition and reservation.

Article 21

The environmental impact assessment of a construction project for solid waste resource recycling in Pudong New Area shall be submitted to the ecological environment department of Pudong New Area for examination and approval or for record in accordance with the provisions on classified management.

The ecological environment department may accept the environmental impact assessment of the solid waste resource recycling construction projects of the same type at one time and conduct centralized examination and approval thereof.

Where a solid waste resource recycling park in Pudong New Area has completed the planned environmental impact assessment and effectively implemented the relevant measures in the planned assessment, the procedure for the environmental impact assessment of the relevant construction project may be simplified in accordance with the provisions.

Article 22

Pudong New Area shall promote the integration of the procedure for the environmental impact assessment pass permit and that for the pollutant discharge permit for solid waste resource recycling construction projects, realize the processing of the two administrative permits with just one set of materials and at one window, examine and approve them simultaneously, and complete the procedures at one time. The municipal department of ecology and environment may, on the basis of the National Catalogue of Classified Management of Fixed Pollutant Discharge Outlet Permits and the actual situation of regional pollutant discharge reduction and solid waste resource recycling, formulate a detailed management catalogue of pollutant discharge permits of Pudong New Area and make its first trial in Pudong New Area.

Article 23

The solid waste resource recycling parks shall, on the principle of intensive construction and shared pollution control, be encouraged to explore ways to build supporting pollution control facilities or centralized technical facilities that are invested by the government or by government-organized multiple entities which can be shared by multiple market entities, so as to realize unified collection and centralized control of pollutants and their stable and up-to-standard discharge.

Article 24

Pudong New Area shall, through the carbon inclusion and carbon certification systems, encourage and support solid waste resource recycling enterprises to make full use of the benefits of carbon emission reduction, and promote the enterprises to achieve synergistic efficiency of pollution and carbon reduction.

Article 25

The Municipal and Pudong New Area People's Governments shall increase financial support for solid waste resource recycling, and arrange relevant funds to support the construction of resource recycling projects, and the construction of infrastructure and public supporting projects of the relevant parks.

Nonpublic capital shall be encouraged to participate in the construction of resource recycling projects, and financial institutions shall be actively guided to provide financing services for qualified solid waste resource recycling projects through green financial instruments, real estate investment trusts, etc.

Solid waste resource recycling enterprises may enjoy preferential tax policies in accordance with the law.

Article 26

Pudong New Area shall increase input in science and technology to accelerate the research, development and popularization of new technologies, new materials, new processes and new equipment for the recycling of solid wastes as resources.

The Laogang Park shall promote the construction of a scientific innovation center for solid waste environmental protection, achieve the functions of scientific research and development, pilot test before production, research and pilot production, and display and exchange, and develop independent core technology and capability systems.

Article 27

Pudong New Area shall promote intelligent construction, expand intelligent application scenarios, apply big data analysis models, and achieve all-round, whole-process and full-coverage intelligent management of solid waste resource recycling through data collection, storage, application and inquiry.

Pudong New Area shall support solid waste resource recycling parks to build and improve intelligent facilities and systems in light of the industrial function layout, promote the digital transformation of the parks, and improve the efficiency of their production and operation management.

Article 28

Pudong New Area shall establish a credit management mechanism in the field of solid waste resource recycling, develop credit evaluation standards, and give credit incentives or punishments to relevant enterprises according to law.

Article 29

These Provisions shall be effective as of February 1, 2023.
