Regulations of Shanghai Municipality on Accessibility Construction

(Adopted at the 1st Session of the Standing Committee of the 16th Shanghai Municipal People's Congress on January 15, 2023)

Chapter I  General Provisions

Article 1

With a view to putting into practice the important concept of People's Cities, accelerating the accessibility construction, enhancing the people's well-being, improving the quality of life of the people, promoting all the members of society equally, fully, and conveniently participate in and integrate into social life, letting them share the achievements of economic and social development so as to continuously create new situations in the people's city construction, these Regulations are formulated in accordance with the relevant laws and administrative rules, and in the light of the actual circumstances of this Municipality.

Article 2

These Regulations shall apply to the construction and maintenance, information exchange, social services of accessible facilities, as well as the related social governance, supervision and management of the accessibility construction activities within the administrative areas of this Municipality.

The term “accessibility construction” in these Regulations refers to the relevant activities that provide convenience and conditions for the members of society with accessibility needs to independently and safely enter and exit buildings, use their auxiliary facilities, pass on roads, take public transportation, obtain, use and exchange information, and access social services.

The term "the members of society with accessibility needs" in these Regulations refers to the individuals who, due to disabilities, old age, young age, childbirth, illness, accidental injury, weight bearing, or other reasons, permanently or temporarily lose or lack physical functions and face obstacles in action, perception, or expression, as well as their accompanying persons.

Article 3

For accessibility construction, the leadership of the CPC shall be adhered to, the government shall play the leading role, the enthusiasm of market subjects shall be mobilized, the social organizations and the public shall be guided to participate in it widely, so as to promote the joint construction, governance and sharing of the whole society.

Accessibility construction is the joint responsibilities of the entire society and shall be kept in line with the level of economic and social development. The principles of systematic coordination, universality and easy application, convenience and safety, and widespread benefits shall be followed so as to reflect the humanistic care and social support.

Article 4

The Municipal People's Government shall strengthen its leadership over the accessibility construction in this Municipality, establish a coordination mechanism for the accessibility construction in this Municipality, study and decide on the relevant major matters, and coordinate the deployment and promotion of accessibility construction.

The district people’s governments shall implement the main responsibilities of promoting the accessibility construction in their jurisdictions and establish coordination mechanisms for the accessibility construction in their districts. They shall be responsible for organizing, coordinating, and managing the accessibility construction within their jurisdictions.

The municipal and district Offices of Coordination Mechanism for Accessibility Construction shall be located in the municipal and district administrative departments of housing and urban-rural development.

The town/township people's governments and sub-district offices shall, in accordance with the relevant provisions and integrating with the Sunshine Disabled Assistance Project, elderly friendly communities, children friendly communities, and the creation of civilized urban areas, promote the accessibility construction in their jurisdictions. They shall urge the responsible persons for the management of accessible facilities to strengthen their daily inspections and fulfill their maintenance and management responsibilities, ensuring the normal use of the accessible facilities.

The people's governments at all levels shall include the necessary funds for promoting the accessibility construction in their respective financial budgets.

Article 5

The administrative departments of housing and urban-rural construction shall be responsible for the coordinated promotion of accessibility construction, specifically responsible for the supervision and management of the construction activities of accessible facilities in the public and residential buildings, and shall jointly with the relevant departments, supervise and manage the use of accessible construction projects in public and residential buildings.

The transportation departments shall be responsible for supervising and managing the construction activities and use of the accessible facilities for roads and transportation facilities.

The economy and information technology departments shall be responsible for guiding, promoting, and supervising the management of information accessibility construction, and promoting the dissemination and exchange of accessible information.

The civil affairs departments shall be responsible for guiding, promoting, and supervising accessibility construction such as elderly care service institutions, child welfare institutions, and disabled care institutions, and organizing and promoting the renovation of aging adaptation for the elderly families.

The health departments shall be responsible for organizing, formulating and coordinating the policies and measures to address population aging to promote accessibility construction. They shall be responsible for guiding, promoting, and supervising the accessibility construction of the medical and health institutions.

The education and sports departments shall be responsible for guiding, promoting, and supervising the accessibility construction of the schools and sports and fitness venues.

The departments of commerce, culture and tourism, and landscaping and city appearance shall be responsible for guiding, promoting, and supervising the accessibility construction of commerce, culture, tourism, parks, and green spaces.

The departments of development and reform, finance, planning and resources, housing management, agriculture and rural areas, technology, market regulation, public security, ethnic and religious affairs, judicial administration, financial management, govenment affairs management, urban management and law enforcement shall be responsible for the accessibility construction within their respective scopes of responsibilities.

Article 6

The trade unions, Communist Youth League, Women's Federation, Disabled Persons' Federation, legally established organizations for the elderly, and other organizations shall assist the people's governments at all levels and their relevant departments in carrying out accessibility construction in accordance with laws, rules and their respective articles of association.

The relevant industry organizations shall play a role in industry self-discipline and assist the industries in carrying out the work related to accessibility construction.

Article 7

The relevant units engaged in accessibility construction shall fulfill their respective responsibilities in accordance with laws, rules, standards, and contract agreements, strengthen the training of their staff, and enhance their abilities to serve the members of society with accessibility needs.

Article 8

The municipal and district people's governments shall be responsible for organizing and compiling the development plans for the accessibility construction in their respective administrative areas, incorporating them into the national economic and social development plans as well as land space plans, and organizing their implementation.

The relevant special plans in the fields of housing and urban construction management, transportation, urban digital transformation, the disabled people's undertakings, the aging undertakings, the elderly care services, etc. shall include the relevant contents of accessibility construction.

For compiling the development plans for accessibility construction and the related specialized plans, opinions shall be solicited from various sectors of society such as the Disabled Persons' Federation and the legally established organizations for the elderly, and the opinions of the public shall be listened to via methods such as soliciting opinions from the people.

Article 9

This Municipality shall promote the concepts of universal design, establish and improve the standard systems for accessible facilities, information exchange, and social services, and strengthen the connection and cooperation between such standards. The relevant departments and units shall implement the accessibility construction standards in accordance with the law. The municipal market regulation department shall, jointly with the departments such as housing and urban-rural construction management, transportation, and economy information technology, organize and compile the local standards for accessibility construction. The relevant departments shall formulate norms and guidelines as needed. The social organizations and enterprises shall be encouraged to develop and improve the leading group and enterprise standards for accessibility construction.

This Municipality shall establish a system for evaluating accessible information, promote the adoption and application of the evaluation results, and encourage the promotion and use in the fields such as market procurement, industry management, and social governance.

Article 10

This Municipality shall support and encourage the higher education institutions, scientific research institutions, enterprises, institutions, social organizations, and individuals to research and develop technologies and products for accessibility construction, strengthen the protection of intellectual property rights such as patents, copyrights, trademarks, and accelerate the transformation, promotion, and application of the achievements.

This Municipality shall rely on the platform of "Government Online-Offline Shanghai” for government services and the platform of "Integrated Online Management” for urban operation to promote the data interconnection of accessibility construction and expand the application scenarios and services of accessible digitization.

Article 11

This Municipality shall encourage the promotion and application of green and low-carbon technologies, products, and services in accessibility construction, and promote the green development of accessibility construction.

Article 12

The relevant key units and areas in this Municipality shall play a leading and exemplary role in accessibility construction.

The state organs and organizations with the function of managing public affairs authorized by laws and rules shall take the lead in promoting the accessibility construction in their public service venues, accelerate the construction and renovation of accessible facilities, and improve the refinement level of accessible services.

The key areas such as the Huangpu River and Suzhou River waterfront public space, the Five New Cities, the Ling-ang New Area, and the Hongqiao International Central Business District shall strengthen their systematic planning, adopt universal designs, and build open, innovative, and inclusive accessibility in accordance with the requirements of high standard construction and high-level management by creating demonstration projects for accessibility and other means.

Article 13

This Municipality shall, on the basis of the characteristics and actual situations of the rural areas, coordinate and promote the construction and renovation of accessible facilities in the rural areas, develop basic accessible public services in the rural areas, and improve the level of rural accessibility construction. The relevant departments such as agriculture and rural areas, housing and urban-rural construction management, transportation, and economy and information technology shall carry out the relevant work in accordance with their respective responsibilities.

Article 14

This Municipality shall establish an accessibility construction expert committee composed of the professionals in the field of accessibility construction to provide professional support for promoting accessibility construction.

Article 15

This Municipality shall establish a system for the statistics and publication of information on accessibility construction. The administrative department of housing and urban-rural construction shall, jointly with transportation, economy and information technology, civil affairs and other departments, as well as the Disabled Persons' Federation, conduct statistical analysis of the implementation of mandatory standards and other accessibility construction situations, and regularly publish a white paper on the accessibility construction in this Municipality.

Article 16

This Municipality shall incorporate the accessibility construction into the creation and evaluation activities of civilized urban areas, civilized communities, civilized villages and towns, civilized units, civilized campuses, and civilized industries.

Article 17

The municipal and district people's governments shall establish and improve the responsibility systems and assessment and evaluation systems for the goals of accessibility construction in this Municipality, and include the completion of the goals of accessibility construction in the assessment and evaluation of their respective departments, the lower level people's governments, and sub-district offices. The specific assessment methods shall be formulated separately by the municipal and district people's governments.

The units and individuals who have made significant achievements in accessibility construction shall be commended and rewarded in accordance with the relevant national and municipal provisions.

Chapter II  Construction and Maintenance of Accessible Facilities

Article 18

The newly built, renovated, or expanded residential buildings, residential areas, public buildings, public places, transportation facilities, roads, etc. shall meet the standards for the construction of accessible facilities.

The accessible facilities shall be designed, constructed, inspected, and delivered simultaneously with the main projects. The newly built, renovated, and expanded accessible facilities shall be connected to the surrounding accessible facilities.

The accessible facilities shall be equipped with the accessibility signs that meet the standards and incorporated into the surrounding environment or the guidance sign system inside the building. The accessibility signs shall be prominently located, with clear and standardized contents, indicating the direction and location of the accessible facilities.

Article 19

The engineering development units shall include the funds for the construction of accessible facilities in their estimated budgets of the engineering construction projects. When they organize the completion acceptance of the construction projects, the accessibility facilities shall be inspected at the same time, and the acceptance status of the accessibility facilities shall be explained in the project completion acceptance reports, and the completion acceptance filing procedures shall be handled in accordance with the law.

Article 20

The engineering design units shall design accessible facilities in accordance with the construction standards for accessible facilities. The design contents of accessible facilities shall be specifically explained in the general description of the construction engineering designs.

Where the review of construction drawing design documents is required by law, the construction units shall construct accessible facilities in accordance with the approved construction drawing design documents and the relevant technical standards, and be responsible for the construction quality.

Where supervision is entrusted, the engineering supervision units shall supervise the construction of the accessible facilities in accordance with the relevant provisions and contract agreements, and in accordance with the approved construction drawing design documents and the relevant technical standards.

Article 21

When reviewing the design schemes of construction projects, the planning and resource departments shall consult with the relevant departments such as housing and urban-rural construction management, transportation, etc. about the requirements for the construction of supporting accessible facilities.

When reviewing the construction drawing design documents of the construction projects, the construction drawing review institutions shall review the design contents of the accessible facilities in accordance with laws, rules, and standards for the construction of accessible facilities. Those failing to meet the relevant technical requirements of mandatory standards shall not be reviewed and approved.

The construction project quality supervision reports submitted by the construction project quality supervision institutions entrusted by the relevant departments such as housing and urban-rural construction management and transportation shall include the contents of the construction of accessible facilities.

Article 22

The persons responsible for the management of accessible facilities shall strengthen their daily inspections of the accessible facilities, fulfill the following maintenance and management responsibilities, and ensure the normal and safe use of the accessible facilities:

1. regularly maintaining and keeping up the accessible facilities;

2. timely repairing the accessible facilities and signs that are destroyed or damaged;

3. promptly correcting any unauthorized occupation of the accessible facilities; and

4. fulfilling the responsibilities of renovation for the accessible facilities that truly require renovation.

The management responsible persons mentioned in the preceding Paragraph refer to the owners of the residential buildings, residential areas, public buildings, public places, transportation facilities, roads, etc. Where the owners, managers, and users have agreements on maintenance and management responsibilities, they shall follow the agreements. Where there are other provisions in laws and rules, such provisions shall prevail.

Article 23

For the residential buildings, residential areas, public buildings, public places, transportation facilities, roads, etc. that fail to meet the standards for the construction of accessible facilities, the relevant departments of urban and rural housing construction management, transportation, housing management, and the district people's governments shall, within their respective responsibilities, promote the renovation of the accessible facilities, formulate plans, and organize their implementation.

The relevant departments of the municipal and district people's governments shall, in accordance with the requirements of the "streamline the government, delegate power, and improve government services" reform, simplify the approval materials, reduce the approval time limit, optimize the approval process, and improve the approval efficiency for the accessible facility construction and renovation projects.

The renovation of the accessible facilities is the responsibilities of the management responsible persons. Where there are no conditions for the renovation of the accessible facilities, the persons in charge of management shall take necessary alternative measures to provide assistance or services to the members of society with accessibility needs.

Article 24

In the process of carrying out urban renewal activities, this Municipality shall incorporate the requirements for accessibility construction into the renewal plans, and continuously improve and enhance the level of accessibility construction.

Article 25

For the newly built, renovated or expanded pedestrian overpasses and pedestrian underpasses of the urban roads, commercial and residential areas, accessible facilities shall be built or renovated in accordance with the relevant technical requirements of the mandatory standards for the construction of accessible facilities. Accessible renovation for the existing pedestrian overpasses over the roads shall be completed within the specified periods.

Where there are height differences at various intersections, entrances and exits, and pedestrian crossings at urban roads, in commercial areas, curb ramps shall be set up. The traffic signal facilities of the pedestrian crossings at major commercial streets, pedestrian streets, and at the surrounding roads of the areas with high concentration of visually impaired persons shall be equipped with pedestrian crossing warning devices in accordance with standards and maintained in normal use.

The tactile pavements shall be set up in accordance with the construction standards for accessible facilities, and shall be connected with the accessible facilities of the surrounding pedestrian overpasses, pedestrian underpasses, public buildings and transportation facilities.

Article 26

The public transportation vehicles such as passenger ships, buses and trams, and rail transit vehicles shall meet the accessibility technical standards. Transportation hubs, public transport stations and passenger terminals shall be accessible from the ground to the station halls and between the transfer stations.

The buses, trams, and rail transit vehicles shall be equipped with voice and text station announcement systems and their normal use shall be maintained. The operating units of public transportation vehicles shall accelerate the provision of the accessible buses and trams. Rail transit vehicles shall gradually be equipped with accessible carriages.

The taxi operators shall allocate a certain proportion of accessible taxis for the members of society with accessibility needs, and provide reservation services.

Article 27

In the urban public parking lots and large residential parking lots, accessible parking spaces shall be set up and labeled in accordance with the construction standards for accessible facilities.

The accessible parking spaces shall be used for the motor vehicles driven or ridden by the physically disabled persons. For motor vehicles using accessible parking spaces, special vehicle signs for the disabled persons shall be placed in prominent positions or the physical disability certificates shall be provided. If the law provides otherwise, such provisions shall prevail.

The parking lot managers shall dissuade those who illegally occupy the accessible parking spaces. Those who refuse to leave or forcibly park, disrupting public order in the parking lots, shall be promptly reported to the public security organs.

The preferential treatment for accessible parking fees shall be implemented in accordance with the relevant provisions of this Municipality.

Article 28

The guesthouses, hotels, etc. shall gradually provide a certain proportion of accessible guest rooms in accordance with the construction standards for accessible facilities.

For the newly built and renovated public buildings, public places, transportation facilities, etc. accessible restrooms shall be constructed or renovated in accordance with the construction standards for accessible facilities.

Article 29

This Municipality shall encourage and support the employing units to carry out the construction and renovation of accessible facilities in their employment places, and provide necessary labor conditions and convenience for their employees with accessibility needs.

The units concentrated with disabled employees shall construct and renovate accessible facilities, provide the relevant accessible services, and provide employee training in accordance with the relevant standards and needs

Article 30

The newly built public service facilities in residential areas shall be equipped with accessible facilities in accordance with the standards for the construction of accessible facilities. Where the existing public service facilities fail to meet the relevant technical requirements of the mandatory standards for the construction of accessible facilities, necessary and reasonable renovation shall be carried out.

This Municipality shall promote the installation of elevators in the existing multi-story residential buildings, and the accessibility design standards shall be first used for the added elevators.

Article 31

This Municipality shall support the promotion of the accessibility renovation for the disabled families and the renovation of aging adaptation for the elderly families, and give appropriate subsidies to those who meet the conditions in accordance with the relevant provisions of this Municipality.

The residents' committees, villagers' committees, residential property service enterprises, and property owners' committees shall support and cooperate with the accessibility renovation for the disabled families and the renovation of aging adaptation for the elderly families.

This Municipality shall strengthen the connection between the accessibility renovation of the residential areas and residential buildings, and the accessibility renovation for the disabled families and the renovation of aging adaptation for the elderly families.

Article 32

The following acts that affect the normal use of the accessible facilities shall be prohibited:

1. damaging or occupying the accessible facilities without authorization;

2. changing the use of the accessible facilities without authorization; or

3. other prohibited acts prescribed by laws and rules.

Article 33

Where temporary accessible facilities are installed due to special circumstances, they shall meet the relevant technical requirements of the mandatory standards for the construction of accessible facilities.

The temporary occupation of the accessible facilities due to special circumstances shall meet the relevant provisions of this Municipality, and guardrails, warning signs or signal facilities shall be installed, and necessary alternative measures shall be taken for such occupation. Upon the expiration of the temporary occupation periods, they shall be promptly restored to their original state.

Article 34

This Municipality shall incorporate the qualified accessibility construction projects into “the projects in the public interest” and “the practical projects for the people” in accordance with the relevant provisions.

For the commercial and office construction projects that provide the public elements of accessible facility construction such as rehabilitation medical facilities for the disabled people and special education facilities for the disabled people that meet practical needs and have been recognized by the relevant regulatory authorities, planning incentives may be applicable in accordance with the relevant provisions. Among them, the construction areas of the relevant public elements provided by the new projects may not be included in the plot ratio of the land. The urban renewal projects may increase the operational construction volume in accordance with the relevant provisions.

The enterprises and social organizations shall be encouraged to raise funds on their own to complete the maintenance, renovation, and transformation of the accessible facilities in large and medium-sized shopping malls, as well as the commercial service venues such as catering, hotels, and tourism. Subsidies shall be provided for those that meet the fiscal subsidy policies.

Chapter III  Accessibility Information Exchange

Article 35

The municipal and district people's governments shall take the accessibility information exchange as an important part of the construction of digital government, expand the application scenarios, incorporate them into the special plans for urban digital transformation, and organize the implementation.

Article 36

The people's governments at all levels and their relevant departments shall take measures to facilitate the disabled people, elderly people, and others to access the government information. When issuing local rules, government regulations, and normative documents closely related to the disabled and elderly people in this Municipality, accessible reading texts such as audio and large character texts shall be provided in a timely manner.

Where the municipal and district people’s governments release government information via press conferences or by other means, such information’s synchronized shorthand texts or sign language translations shall be provided.

Article 37

When the people's governments at all levels and their relevant departments release information related to sudden events such as natural disasters, accident disasters, public health events, social security events, etc., they shall synchronously adopt accessible methods such as voice, text, sign language, etc.

This Municipality shall improve the "12345" citizen service hotline and emergency call systems such as call the police for help, fire emergency, traffic accidents, and medical first aid, strengthen the accessibility functions such as text and voice, ensuring that the members of society with accessibility needs receive timely consultation, advice, help, and alarm services.

Article 38

The municipal television stations shall provide synchronous texts when broadcasting television programs. They shall broadcast the news programs with sign language at least once a day, and gradually expand the scope of programs with sign language.

The film and television products that are openly published and distributed shall have accessible features such as the optional texts.

The online video programs shall be encouraged to include texts, sign language, or oral account soundtracks.

The cinemas, community cultural activity centers, and other units that have the conditions shall be encouraged to set up accessible film events and hold accessible film days and other activities.

Article 39

This Municipality shall encourage the provision of audio, electronic, large print, braille, and other versions for the books, newspapers, and magazines openly published and distributed so as to facilitate the reading of the social members with accessibility needs.

The public libraries set up by the municipal or district people's governments shall set up accessible reading rooms or areas to meet the needs of the members of society for accessible reading by providing audio books, Braille books, large print books, information retrieval equipment, etc.

This Municipality shall encourage the producers and operators of food, drugs, and other commodities to provide Braille, large characters, voice instructions, etc. on the external packaging of their products for the convenience of the members of society with accessibility needs.

Article 40

The internet portals and public service platforms of the state organs in this Municipality, as well as the internet websites and service platforms of the organizations with the function of managing public affairs authorized by laws and rules, shall meet the design standards for accessible websites.

This Municipality shall encourage the internet websites, mobile internet applications, and intelligent device operating systems in the fields such as news and information, social communication, daily shopping, healthcare, financial services, learning and education, transportation, etc. to meet the national information accessibility standards and provide accessible information and services.

Article 41

This Municipality shall continuously promote the accessible digital services and support the provision of related hardware and software installation services for the disabled and elderly people.

This Municipality shall encourage the development of accessible applications such as instant messaging, telemedicine, learning and education, map navigation, financial payment, online shopping, and appointment services that meet the needs of the disabled and elderly people.

This Municipality shall support various educational institutions and other social entities to carry out training and provide courses in various forms, helping the disabled and elderly people improve their abilities to use intelligent technology.

Article 42

This Municipality shall encourage the manufacturers of audio and video, multimedia devices, intelligent mobile terminal devices, and telecommunications terminal devices to carry out research and development and transformation of the related equipment, and promote the technology and products to have accessible functions such as voice and large characters.

The banks, hospitals, railway passenger stations, rail transit stations, and civil transportation airport terminal areas shall ensure that a certain proportion of the self-service public service terminal equipment have accessible functions such as voice, large characters, and Braille.

Article 43

When providing telecommunications services, the business operators of basic telecommunications shall create conditions to provide necessary written and voice information services for the members of society with accessibility needs. They shall be encouraged to provide preferential services to the members of society with accessibility needs.

Article 44

This Municipality shall promote and use the national common sign language and national common braille, and support the construction of the relevant training and service institutions.

Those who provide basic public services using sign language and Braille, as well as the schools conducting sign language and Braille education and teaching, shall use the national common sign language and national common Braille.

Chapter IV  Accessible Social Services

Article 45

The state organs and organizations with the function of managing public affairs authorized by laws and rules shall provide necessary accessible equipment and auxiliary devices at their public service places, publicize accessible facility information, and provide accessible services.

The district and town/township people's governments and sub-district offices shall organize and compile accessible information guidelines on the basis of the actual situations of their respective jurisdictions.

The administrative services, community services, as well as the public service institutions such as water supply, power supply, and gas supply, shall set up low-level service desks or accessible service windows, establish accessible service appointment systems, and provide services to the members of society with accessibility needs.

Article 46

The departments and units responsible for organizing elections shall provide convenience and necessary assistance for the voters with accessibility needs to participate in elections, and provide Braille, large characters, or electronic ballots for the visually impaired voters.

Article 47

The judicial organs and legal aid institutions shall provide accessible services for the members of society with accessibility needs to participate in litigation activities and obtain legal aid, and provide sign language interpretation, braille translation, and other services in accordance with the relevant national provisions.

This Municipality shall encourage the arbitration institutions, law firms, notary offices, judicial appraisal institutions, grassroots offices of legal services and other legal service institutions to provide accessible services on the basis of the service contents provided.

Article 48

The education departments and various educational institutions shall take measures to strengthen the construction, renovation, and equipment allocation of accessible facilities in educational venues, and provide services for the teachers and students with accessibility needs.

The relevant departments and examination organizing units shall, in accordance with national provisions, provide convenience for the members of society with accessibility needs to participate in education exams, vocational qualification exams, technical skills exams, and recruitment exams, etc.

The public security organs and transportation departments shall provide convenience for the physically disabled, hearing impaired, and elderly people who meet the requirements to participate in the motor vehicle driving qualification exams.

Article 49

The medical and health institutions shall provide the relevant accessible facilities, equipment, and services on the basis of the actual medical services, and provide convenience for the members of society with accessibility needs to seek medical treatment. The medical and health institutions shall be encouraged to provide sign language translation, medical treatment guidance for the blind, and other services for the people with hearing, speech, and visual impairments when seeking medical treatment.

The disabled and elderly service institutions shall be equipped with accessible facilities and equipment to provide accessible services in daily care, rehabilitation care, and other aspects.

Article 50

The elderly care institutions, home-based community services for the aged, and other institutions and places providing elderly care services shall meet the accessibility standards, and provide services such as installation of age-friendly products, preparation of rehabilitation aids, and use guidance on the basis of the physical functions, action characteristics, and living needs of the elderly people. They shall promote age-friendly transformation and meet the elderly people’s requirements for the safety, hygiene, and convenience of their living and activity places.

Article 51

This Municipality shall encourage the cultural, tourism, greening, sports, finance, postal, telecommunications, commercial, exhibition, catering, hotels and other service venues to provide assistive devices, consultation and guidance services to the members of society with accessibility needs on the basis of the service contents provided. The relevant service venues shall not refuse the entry of those who use rehabilitation assistive devices such as wheelchairs.

This Municipality shall encourage the postal and express delivery enterprises to provide door-to-door delivery services for the disabled and elderly people with limited mobility. The postal enterprises shall provide free mailing and delivery of reading materials for the blind people.

This Municipality shall encourage higher education institutions, social organizations, and cultural enterprises to participate in the production of accessible cultural works on the basis of the characteristics and needs of the disabled and the elderly people, and to expand the supply of accessible cultural works.

Article 52

The operating units of transportation facilities and public transportation vehicles shall, on the basis of the service characteristics of various transportation modes, together with the facilities and equipment conditions and the service contents provided, set up accessible windows, dedicated waiting areas, green channels, and priority seats for the members of society with accessibility needs, and provide accessible services such as assistive devices, consultation guidance, text stop announcement, voice prompts, reservation and customization.

The transportation facilities and public transportation vehicle operating units shall gradually establish accessible public transportation guidance systems, provide detailed maps of public transportation routes and stations, and set up accessible facilities to serve the members of society with accessibility needs for independent travel.

Article 53

This Municipality shall support the development of accessible travel service software, accessible public transportation guidance systems, and intelligent blind aids by using artificial intelligence, the Internet of Things, big data, cloud computing, biomimetic and other technologies.

This Municipality shall encourage the map navigation and other travel service software to gradually improve the accessible facility signs and the navigation function of accessible travel routes, and strengthen the integration and application with the relevant websites and mobile internet applications.

The operation and management units of public place, transportation facilities, and the operation units of public transportation vehicle shall provide convenience for the disabled persons to carry guide dogs, hearing dogs, auxiliary dogs, and other service dogs.

The disabled persons who bring service dogs into and out of public places, use transportation facilities and public transportation tools, shall take necessary protective measures.

Article 54

This Municipality shall encourage and support the construction of accessible information service platforms for the disabled and the elderly and other people with hearing, speech, and visual impairments, so as to provide remote real-time accessible information services for the members of society with accessibility needs.

This Municipality shall support the use of technologies such as the Internet and the Internet of Things to provide "Push-to-talk" services for the disabled and the elderly people, creating and promoting demonstration application scenarios, and instantly receiving and responding to the needs of the disabled, the elderly and other people for medical treatment, travel, emergency rescue, policy consultation, and other needs.

Article 55

When formulating and implementing the work plans for emergency shelters, the maintenance and management units shall consider the accessibility needs of the members of society, set up voice, text, flashing and other warning devices according to the situations, set up accessibility signs, and improve the safety guarantee, emergency services, and fire safety functions of the concentrated places and service institutions, and strengthen the protection of the disabled and elderly people in emergencies.

Article 56

The people's governments at all levels and their relevant departments, as well as the places providing public services, shall provide assistance to the disabled, elderly people and the other members of society in using the relevant information technology services on the basis of their accessibility needs. For the services related to healthcare, social security, and living expenses, traditional service methods such as on-site manual handling shall be retained to promote the integrated development and complement of online and offline services.

Chapter V  Social Co-governance

Article 57

This Municipality shall promote the Sunshine Disabled Assistance Project, promote the creation of senior-friendly communities, support the construction of children friendly cities, and jointly create an accessible friendly environment.

Article 58

This Municipality shall establish and improve a public participation mechanism for accessibility construction, strengthen the public's awareness and understanding of accessibility construction, and safeguard the public's rights to know, participate, express, and supervise in accessibility construction in accordance with the law.

The relevant departments shall solicit views from all the sectors of society and improve accessibility construction.

Article 59

This Municipality shall carry out publicity and education on accessibility construction, promote the concept of building an accessible and friendly environment, popularize accessibility knowledge, disseminate accessibility culture, and enhance the awareness of accessibility in the whole society.

The education departments shall incorporate the concepts of accessibility into the construction of campus culture in various schools, and cultivate the concepts of students respecting and helping the members of society with accessibility needs by conducting accessibility experience activities and other means.

The broadcast, television, newspapers, websites, etc. shall carry out public welfare publicity for accessibility construction in accordance with the relevant provisions.

The relevant service institutions and enterprises shall be encouraged to inform the public of the accessible facilities or services provided by their units in various forms, in order to provide convenience for the members of society with accessibility needs.

Article 60

This Municipality shall encourage volunteers, volunteer service organizations, and other social organizations to provide volunteer services for the disabled, elderly, and other members of society with accessibility needs, such as using accessible facilities, convenient travel, exchanging information, and obtaining social services.

The information platforms related to volunteer services in this Municipality shall include accessibility services in their volunteer service projects and categories, release accessibility demand information for the disabled, elderly, and other members of society with accessibility needs, and provide convenience for the volunteers and volunteer service organizations to carry out corresponding volunteer services.

This Municipality shall encourage and support the enterprises, institutions, social organizations, and individuals to participate in accessibility construction via public welfare sponsorship, charitable donations, and by other means.

Article 61

This Municipality shall establish a talent training mechanism in the field of accessibility construction, strengthen the construction of professional disciplines related to accessibility construction, support higher education institutions, secondary vocational schools, etc. to offer courses related to accessibility construction, and carry out theoretical research and practical activities on accessibility construction.

The relevant disciplines such as urban planning, architectural design, engineering management, transportation, landscape architecture, interior design, computer science and information technology shall include the teaching and practical contents in accessibility construction.

Article 62

This Municipality shall strengthen the construction of the teams in the field of accessibility construction, and strengthen vocational education and training for the professionals such as architects, engineers, and sign language translators in the field of accessibility construction.

The administrative services, community services, public service institutions such as water supply, power supply, and gas supply, as well as the service institutions and enterprises such as education, medical care, elderly care, childcare, public transportation, and property management, shall provide accessible professional ethics education, accessible service professional skills, psychological counseling, and other training for their staff by various methods such as simulated experiences and on-site operations, in order to enhance their awareness and level of accessibility services for the disabled and the elderly and the other people.

The service institutions and enterprises listed in the preceding Paragraph, as well as the relevant industry organizations, shall be encouraged to cooperate with the organizations such as the Disabled Persons' Federation and legally established organizations for the elderly, to improve the level of accessible service education and skill training.

Article 63

This Municipality shall encourage the research and development, production, and promotion of the following accessible technologies, products, and services, in order to provide convenience for the disabled, elderly, and other members of society with accessibility needs:

1. accessible equipment such as rehabilitation aids, emergency rescue equipment, and accessible vehicles, as well as their installation, use, and maintenance services;

2. vision accessible devices such as screen reading software and reading terminals;

3. voice to text software, sign language video software, voice recognition system, real-time texts and other hearing accessibility devices;

4. wearable, portable monitoring and guardian accessible terminal equipment;

5. smart products and services such as safety protection, care and nursing, health promotion, and emotional care; and

6. other accessible technologies, products, and services needed by the society.

This Municipality shall develop services for renting rehabilitation assistive devices in the communities to provide rehabilitation assistive devices for basic security and other diversified products for the groups in need.

Article 64

This Municipality shall strengthen financial support for accessibility construction, improve financing support measures, encourage the financial institutions to develop and provide financial products and services, and promote accessibility construction.

The government financing guarantee institutions shall be encouraged to provide financing and credit enhancement support for the qualified accessibility construction enterprises.

The insurance and financial institutions shall be encouraged to provide product liability insurance, public liability insurance, and other types of insurance to provide protection for the entities related to accessibility construction.

Article 65

This Municipality shall encourage the relevant units to invite the organizations such as the Disabled Persons' Federation, legally established organizations for the elderly, as well as the representatives of the members of society with accessibility needs such as the disabled and elderly people, to conduct opinion consultation and experience in the following activities related to accessibility construction:

1. accessible facility design;

2. completion acceptance of construction projects such as the newly built, renovated, and expanded public service venues, public activity venues, and commercial service venues;

3. information technology project construction;

4. accessible product design and development; and

5. other activities related to accessibility construction.

Article 66

The Disabled Persons' Federation, legally established organizations for the elderly, and other organizations shall regularly organize activities to use or experience accessibility facilities, information exchange, and public services, summarize and analyze various information of accessibility demands, form demand lists, and provide reference for improving policies and work, and promoting the supply and demand connection of the related technologies, products, and services.

Chapter VI  Supervision and Management

Article 67

The accessible facilities shall be included in urban grid management. The urban operation and management agencies under the district, town/township people's governments, and sub-district offices shall dispatch orders, supervise and verify the damage, malfunction, and occupation of the accessible facilities discovered during inspections, and command and coordinate the relevant departments or units to carry out maintenance and management in a timely manner.

Article 68

This Municipality shall establish and improve a third-party evaluation mechanism for accessibility construction. The relevant competent departments shall regularly entrust third-party institutions to carry out evaluations, and use the evaluation results as important bases for carrying out accessibility construction, and released them to the society.

When conducting evaluations, the third-party institutions shall invite the Disabled Persons' Federation, legally established elderly organizations, and other organizations to participate, fully listening to the opinions of the disabled, elderly people, and other members of society on accessibility needs, use experiences, and other aspects.

Article 69

Any unit or individual may provide opinions and suggestions, or file complaints and reports, via channels such as the "12345" Citizen Service Hotline, "Suishen Snapshot”, and departmental websites, regarding violations of the relevant provisions on accessibility construction. After receiving the opinions, suggestions, and complaints, the relevant departments shall verify, handle, and respond in time.

The organizations such as the Disabled Persons' Federation and legally established elderly organizations may invite the representatives of the National People's Congress, the members of the Chinese People's Political Consultative Conference, experts and scholars, and the citizens' representatives to participate in supervision activities on accessibility construction.

The news units may conduct public opinion supervision on accessibility construction.

Article 70

The standing committees of the municipal and district people's congresses shall strengthen their supervision over the accessibility construction within their respective administrative areas by listening to and reviewing the special work reports, conducting law enforcement inspections, and by other means.

The standing committees of the municipal and district people's congresses shall bring into fully play the role of the deputies to the people's congresses, organize special research and inspections on accessibility construction, collect and reflect the opinions and suggestions of the people, and urge the relevant parties to implement various work related to accessibility construction.

Article 71

The People's Procuratorate shall exercise legal supervision over accessibility construction via litigation supervision, procuratorial advice, support for prosecution, and by other means.

For those who violate laws and rules related to accessibility construction and harm the public interests, the People's Procuratorate may file public interest lawsuits in accordance with the law.

Chapter VII  Legal Liability

Article 72

Where there are already provisions in laws and administrative rules for handling the acts that violate the provisions of these Regulations, such provisions shall prevail.

Article 73

Where the persons responsible for the management of accessible facilities fail to fulfill their maintenance and management responsibilities, resulting in the inability of the accessible facilities to be used normally and safely, the relevant departments of transportation, urban management and law enforcement shall order them to make corrections within a specified period of time. If they cause personal injury or property loss to the users, they shall be liable for compensation in accordance with the law.

Article 74

Where the use of accessible facilities is changed without authorization or the necessary alternative measures that shall be taken according to law have not been implemented, the transportation and urban management law enforcement and other relevant departments shall order correction within a specified period of time. Those who fail to make corrections within the prescribed time limits or whose cases are serious shall be fined not less than 10,000 yuan but not more than 30,000 yuan. Those who cause personal injury or property loss shall bear compensation liabilities in accordance with the law.

Article 75

Those who illegally occupy the accessible parking spaces and refuse to leave or forcibly park, disrupting public order in parking lots, shall be ordered by the public security organs to make corrections and shall be punished in accordance with the law.

Article 76

Where the subjects who are obligated to provide accessible information fail to do so in accordance with the law, the relevant competent departments of economy and information technology, network information, broadcast and television, press and publications, etc. shall order them to make corrections within a specified period of time.

Article 77

Where the departments or units responsible for public services fail to provide accessible social services in accordance with the law, the people's governments at the same level or the competent departments at a higher level shall order them to make corrections within a specified period of time. If no correction is made within the prescribed time limit, the the leading persons directly in charge and the other directly responsible persons shall be punished in accordance with the law.

Article 78

For the acts that violate the provisions of these Regulations, in addition to pursuing corresponding legal responsibilities in accordance with the law, the relevant departments shall also collect the dishonest information of illegal acts to the municipal public credit information service platform in accordance with the provisions, and punish them in accordance with the relevant provisions.

Article 79

The staff members of the relevant competent departments and organizations who abuse their power, neglect their duties, or engage in favoritism and fraud shall be punished in accordance with the law. Where a crime is constituted, their criminal responsibilities shall be pursued in accordance with the law.

Chapter VIII  Supplementary Provision

Article 80

These Regulations shall be effective as of March 1, 2023
