Regulations of Shanghai Municipality on Sports Development

Chapter I General Provisions

Article 1

With a view to promoting the sports cause in this Municipality, developing sports, enhancing the citizens' physique, and improving the soft power of this Municipality, these Regulation are formulated in accordance with the Sports Law of the People's Republic of China and the relevant laws and administrative rules, and in the light of actual circumstances of this Municipality.

Article 2

As for the sports work, this Municipality shall adhere to the leadership of the Communist Party of China, practice the important concept of "people's city", implement the national fitness strategies, give priority to the development of the youth and school sports, promote the high-quality development of the competitive sports, sports events and sports industry, improve the citizens' physical quality and health level, enhance the comprehensive sports strength and international influence, and build a world famous sports city.

Article 3

The municipal and district people's governments shall strengthen their leadership over the sports work, incorporate sports into the national economic and social development plans, improve the departmental coordination mechanisms, and coordinate and arrange the sports development work.

The town/township people's governments and the sub-district offices shall coordinate and promote the construction, opening, and management of the community public sports facilities within their jurisdictions, provide community sports staff, and promote and organize regular and mass sports activities.

Article 4

The municipal and district sports departments shall be in charge of the sports work within their respective administrative areas, formulate and organize the implementation of the relevant plans and standards for sports development, and implement the relevant supervision and management work in accordance with the law.

The education departments shall be responsible for managing the school physical education work, and promote in a collaborative way the development and popularization of the youth sports activities.

The health departments shall be responsible for incorporating sports and fitness into the health education, disease prevention, and health management.

The development and reform, finance, human resources and social security, civil servant management, science and technology, planning and resources, housing and urban-rural construction management, housing management, greening and city appearance, culture and tourism, market regulation, commerce, state-owned assets, civil affairs, agriculture and rural areas, public security, emergency management, and the other departments and fire and rescue institutions shall jointly do a good job in sports development according to their respective responsibilities.

Article 5

This Municipality shall guarantee the equal rights of the citizens to participate in sports activities in accordance with the law, and provide the special protection for the rights of the minors, women, the elderly, and the disabled to participate in sports activities.

Article 6

The trade unions, Communist Youth Leagues, Women's Federations and the other mass organizations shall organize and carry out the targeted sports activities based on the characteristics of the service groups they contact with.

The Disabled Persons Federations shall organize and carry out sports activities for the disabled, hold sports games for the disabled, and strengthen the training and management of the disabled athletes.

The natural persons, legal persons, and unincorporated organizations shall be encouraged to support the development of sports via donations, sponsorships, volunteer services, and other means.

Article 7

This Municipality shall cultivate and develop sports culture, promote the spirit of Chinese sports, inherit and promote the traditional sports projects, support the construction of sports culture brands, so as to create a good atmosphere to guide and encourage the citizens to participate in sports activities regularly.

Article 8

This Municipality shall promote the integrated development of sports in the Yangtze River Delta region, improve the regional cooperation mechanisms, and strengthen the planning linkage, policy coordination, resource sharing, and business cooperation of the regional sports development.

This Municipality shall encourage foreign sports exchanges, spread the Chinese sports culture, promote the Olympic spirit, and actively participate in the international sports.

Article 9

The organizations and individuals with outstanding contributions to the development of sports shall be commended and rewarded in accordance with the relevant provisions.

Chapter II National Fitness

Article 10

This Municipality shall promote the construction of a higher-level public service system for national fitness, encourage and support the citizens to participate in physical fitness activities, and promote the deep integration of the national fitness and national health.

Article 11

The municipal and district people's governments shall formulate the implementation plans for national fitness in their respective administrative areas, improve and implement the basic public service standards for national fitness.

The municipal and district sports departments shall promote the national sports exercise standards, improve the service system for monitoring the citizens' physique, and regularly organize surveys on the citizens' physique and the status of the national fitness activities.

The municipal sports department shall regularly evaluate the sports facilities, fitness organizations, fitness activities, fitness guidance, citizen participation, and physique and health conditions in each district, and release the national fitness development index.

Article 12

The sports, health, civil affairs departments, and the trade unions shall strengthen the collaborative mechanism for the work of promoting health through exercises, improve policy support, optimize the facility layout, strengthen talent cultivation, support social participation, and establish and perfect the service systems for promoting health through exercises that can meet the needs of the various groups of people.

The sports, civil affairs and the other departments shall promote the construction of the multifunctional sports venues for the elderly in the communities, integrate the functions of the sports facilities and elderly-care service facilities, and provide sports and healthy elderly-care services such as fitness counseling, physical function training, and exercise intervention for the elderly.

The qualified medical and health institutions shall be encouraged to explore and establish special outpatient service related to scientific fitness. When carrying out the relevant medical service activities, they shall provide scientific fitness guidance, evaluation diagnosis and treatment, exercise intervention, and the other services for those in need.

The sports departments and trade unions shall strengthen the construction of fitness service stations for the citizens and employees, providing convenience and services for the national fitness activities.

Article 13

The district and town/township people's governments and the sub-district offices shall incorporate the public services for national fitness into the construction of the 15-minute community life circle and rural community life circle, support the development of community fitness organizations and teams, and carry out scientific, civilized, and healthy national fitness activities.

The residents committees shall organize community fitness activities according to the local conditions while considering the characteristics of the residential areas. The village committees shall consider the characteristics of the rural areas and organize the villagers to carry out the national fitness activities that are suitable for the rural production, labor, and cultural life.

Article 14

The sports departments shall organize and carry out scientific fitness guidance and publicity, advocate that the citizens establish and practice scientific fitness concepts, and help the citizens acquire scientific fitness knowledge and skills about sports injury protection, sports rehabilitation, sports nutrition, and sports psychology.

The sports departments shall strengthen the construction of the social sports instructor teams, give full play to the role of the social sports instructors in organizing sports and fitness activities, teaching sports and fitness skills, popularizing scientific fitness knowledge, and promoting civilized and scientific fitness among the citizens.

Chapter III Youth and School Physical Education

Article 15

The education and sports departments shall implement in a collaborative way the national plans for promoting the sports activities for the youth and schools, improve and perfect the mechanism for integrating sports and education, adhere to the combination of popularization and improvement, so as to promote the physical and mental health and physical fitness of the youngsters.

Article 16

The schools shall, in accordance with the relevant national provisions, provide comprehensive and excellent physical education classes, carry out diversified and high-quality physical education projects, cultivate the students' interests in sports, and enhance their physical health. The primary and secondary schools shall help the students master at least two sports skills during the elementary education stage.

The schools shall incorporate the students' extracurricular sports activities conducted on campus into their teaching plans, connect them with the contents of the physical education classes, and ensure that the students participate in no less than one hour of physical exercise every day during their school years. It shall be advocated that the students participate in the extracurricular physical exercises for one hour every day, and the families and schools shall create conditions to support and guarantee them to do so. Those who are in charge of the public sports facilities shall be encouraged to provide convenient periods of time, venues, and other facilities for the student physical exercises.

The kindergartens and childcare institutions shall provide suitable indoor and outdoor activity areas, sports equipment, etc. For the young children in the kindergarten, they shall carry out the sports activities that meet the characteristics of the young children, and ensure the time, effectiveness, and quality of outdoor activities for the young children.

The education and sports departments shall promote the sharing of the high-quality physical education courses, teachers, venues, and the other resources between schools.

Article 17

The education departments and schools shall do a good job in the safety management of the school sports activities and the prevention and control of the sports injury risks.

The schools shall purchase school liability insurance in accordance with the relevant provisions. The students shall be encouraged to voluntarily participate in the accidental injury insurance.

Article 18

The schools shall hold at least one school-wide sports meet every academic year, and set up the basic sports such as track and field and swimming, the collective ball games such as football, basketball and volleyball, the fun sports projects, and school sports featured projects according to the actual situations, so as to guide the students to participate widely.

The sports and education departments shall take measures to encourage the public sports facilities to provide free access to schools, and provide service guarantees for the schools to hold sports events.

The sports and education departments shall integrate the youngsters and school sports competition activities in this Municipality on the basis of the actual situations, regularly release the competition plans, improve the registration management of the young athletes, and promote the coordinated development of the sports competition activities in the city, districts, and schools.

Article 19

The education departments and schools shall include the physical education in the scopes of the students' comprehensive quality evaluation, and make meeting the requirements of the national student physical health standards an important part of the education and teaching assessment, guiding the students to develop physical exercise habits and improving their sports attainment.

The education departments shall include the physical education subjects in the scopes of the middle and high school academic level examinations, and improve and perfect the assessment mechanisms that conform to the characteristics of the subjects. As for the assessment of physical education subjects for the students with special physical conditions such as the sick and the disabled, their physical conditions shall be fully considered and the assessment shall be carried out in accordance with the relevant provisions of the State and this Municipality.

Article 20

The education departments and schools shall, in accordance with the relevant provisions of the State and this Municipality, provide sufficient qualified physical education teachers, and include the student physical health tests, guidance for the mass organizations, extracurricular physical training, and the competition results in the performance evaluation of the physical education teachers, and ensure that the physical education teachers enjoy the same treatment as the other subject teachers.

The sports school coaches, retired sports teachers, social sports instructors, and the coaches from social sports clubs shall be encouraged to participate in the after-school services of school sports, and provide subsidies in accordance with the relevant provisions on after-school services.

Article 21

The schools shall set up sports coach positions on the basis of the actual work, establish and improve the relevant evaluation standards and performance evaluation mechanisms. The schools shall be encouraged to give priority to hiring the qualified retired outstanding athletes as the sports coaches under equal conditions, or to cooperate with the relevant professional institutions and the other social forces to cultivate the sports reserve talents.

The sports and education departments shall establish the comprehensive training mechanisms for the sports reserve talents, improve the layout of the featured sports projects, explore the flexible enrollment systems for the outstanding sports reserve talents in the compulsory education, and strengthen the recruitment, introduction, and training of the sports reserve talents.

Article 22

The municipal and district people's governments shall strengthen the construction of sports schools and provide support in terms of facilities, funds, personnel, etc.

The education departments shall support sports schools in selecting the outstanding sports reserve talents in the corresponding administrative areas, and strengthen the support and guarantee for the cultural education of the sports reserve talents.

Article 23

The sports departments shall, together with the education, market regulation, civil affairs and the other departments, guide and regulate the youth off-campus sports training, the organization of the related event activities and the other services, so as to promote the standardized and orderly development of the off-campus sports training markets.

Chapter IV Competitive Sports

Article 24

This Municipality shall adhere to the combination of government and market, innovate the development models of the competitive sports, optimize the layout of the competitive sports projects, support the social forces to conduct training, and enhance the comprehensive competitiveness of the competitive sports.

Article 25

The sports departments shall support the market-oriented and professional development of football, basketball, volleyball, and the other competitive sports projects with favourable conditions, support the professional development of the athletes and coaches, cultivate and stimulate the development of the professional sports clubs, and support the establishment of the sports reserve talent teams.

Article 26

This Municipality shall strengthen the training and management of the athletes, follow the principles of openness, fairness, and impartiality in accordance with the relevant national provisions, publicly disclose the selection standards and procedures, select the athletes on the basis of merit and form the sports teams, and publicize the selection results.

Article 27

This Municipality shall guarantee the rights of the athletes to choose registration and exchange in accordance with the law.

The sports and education departments shall rely on the educational resources of this Municipality to provide guarantees for the athletes to receive cultural education and promote the comprehensive development of the athletes.

The outstanding athletes shall be given the preferential treatment in accordance with the provisions for their settlement, further education, employment, and medical treatment in this Municipality. The trial athletes shall enjoy social insurance, medical treatment and the other guarantees in accordance with the relevant provisions of this Municipality.

The athletes participating in commercial activities such as advertising and endorsement shall be encouraged and supported to agree on the rights and obligations of both parties via contracts with the management units.

Article 28

The municipal sports, human resources and social security, and civil servant management departments shall be responsible for the resettlement of the retired outstanding athletes. The retired outstanding athletes who meet the resettlement requirements shall be resettled in accordance with the relevant provisions of the State and this Municipality.

The retired outstanding athletes who independently choose their professions shall be given economic compensation in accordance with the provisions. The compensation standards shall be formulated and dynamically adjusted by the municipal sports department together with the municipal human resources and social security and finance departments. The retired outstanding athletes who start their own businesses shall be provided with policy and financial support in accordance with the provisions.

The municipal sports department shall, together with the municipal human resources and social security departments, strengthen the vocational skills training and social security for the retired athletes, and provide guidance and services for their employment and entrepreneurship.

Article 29

This Municipality shall implement the system of athlete sports level grades, coach and sports protection professional qualifications, and referee technical levels, promoting the opening of the evaluation of professional titles such as coaches and sports protection professionals to the public.

The sports departments shall guide the single sports associations to establish and improve the society-oriented registration systems for the coaches and referees, establish practice records, and strengthen the professional ability training and assessment.

Chapter V Sports Events

Article 30

The municipal sports department shall plan as a whole the various sports events in accordance with the requirements of the national economic and social development plans and the sports development plans of this Municipality.

This Municipality shall actively bid for (host) major international and domestic sports events, create high-level professional and self-owned brand events, hold citizen sports games, urban amateur leagues and the other national fitness events, so as to meet the diverse needs of the citizens for sports events, and build an international sports event capital.

This Municipality shall develop the emerging sports events in the fields of water and outdoor sports, urban extreme sports, technology sports, virtual sports, etc., create new event development models and sports service formats, and promote the integrated development of the emerging sports events with social entertainment, fitness and leisure, etc.

Article 31

The people's governments at all levels and the relevant departments may encourage and support the social forces to hold sports events and promote the development of sports events by providing public resources, financial support, service guarantees, and the other measures.

Article 32

The sports departments shall, together with the relevant departments and institutions, establish the comprehensive service mechanisms for sports events, report on the holding of the events, coordinate the major events, and ensure the safe and orderly holding of the events.

Article 33

This Municipality shall, in accordance with the law, protect the intellectual property rights such as the trademarks, patents, copyrights, etc. related to the sports events, as well as the name, emblem, flag, mascot, hosting right, broadcasting right, and other intangible asset rights of the sports events.

Article 34

The municipal sports and market regulation departments shall cultivate the brands of Shanghai sports events by improving the relevant standards, optimizing the service guarantees, and strengthening the financial support.

The municipal sports department shall establish and improve the brand indicator systems for the sports events, and regularly release the evaluation reports on the influence of the sports events.

Chapter VI Sports Industry

Article 35

The municipal and district people's governments shall establish the coordination mechanisms for the development of the sports industry, optimize the industrial structure and spatial layout, improve the sports industry systems, cultivate the new forms of sports industry, and promote the integrated development of sports and health, culture, tourism, elderly care, science and technology, agriculture and the other industries.

Article 36

The district people's governments and the relevant departments with favorable conditions shall be encouraged to regulate and guide the construction of sports industry parks, sports themed featured towns, sports professional buildings, etc. in accordance with the national economic and social development plans, national land space plans, and sports industry development plans, and promote the agglomeration development of the sports industry.

Article 37

This Municipality shall encourage the use of urban space and venue facilities such as public sports land, industrial parks, commercial facilities, abandoned factory buildings, warehouses, etc. to build new sports service complexes and promote the integrated development of the sports industry and the related industries.

The construction of new sports service complexes shall confirm to the national spatial planning and the relevant provisions of this Municipality. The departments of planning and resources, housing and urban-rural construction management, housing management, and fire and rescue institutions shall provide guidance in planning approval, land supply, building and housing safety, fire safety, and the other aspects in accordance with their respective responsibilities.

Article 38

This Municipality shall strengthen the financial support for the development of the sports industry, improve the financing support measures, encourage the financial institutions to develop and provide the financial products and services that meet the national financial regulatory requirements, to meet the financing needs of the industrial development. This Municipality shall support the use of the special funds such as the sports development fund, guide and support the development of the sports industry.

Article 39

The sports departments shall, together with the commerce, culture and tourism and the other departments, formulate and implement the policies to promote sports consumption, expand and guide the consumption in sports fitness, sports events, sports tourism and the other fields, stimulate the vitality of sports consumption, and give play to the driving role of the sports consumption.

Chapter VII Sports Organizations

Article 40

The municipal sports department shall, together with the municipal civil affairs and the other departments, improve the relevant standards and operational norms of the sports organizations in this Municipality, establish a comprehensive evaluation mechanism for the sports organizations, and promote the standardized development of the sports organizations.

The sports departments shall take measures to support and ensure the development of the sports organizations.

Article 41

The municipal and district sports federations shall strengthen the guidance and services to the sports organizations, play the pivotal roles, and jointly promote the development of the sports cause.

Article 42

The municipal and district single sports associations shall improve the internal governance mechanisms, strengthen the industry self-discipline and integrity construction, formulate the industry norms, conduct training on the abilities of the practitioners, report the opinions and suggestions of their members to the relevant units, and safeguard the legitimate rights and interests of their members in accordance with the law.

Article 43

This Municipality shall encourage the development of the various self-governing sports organizations such as the youth sports clubs and community fitness organizations, support the development of the sports science social organizations, and promote the standardized construction of the sports foundations.

Chapter VIII Sports Facilities

Article 44

The municipal and district people's governments shall plan and construct the public sports facilities in accordance with the relevant national provisions, and improve the spatial layout and supporting construction of the public sports facilities in combination with the urban renewal work.

The planning and resources, housing and urban-rural construction management departments shall solicit opinions from the sports departments at the same level in accordance with the provisions when preparing the detailed control plans and conducting the reviews of the public sports facility planning and design, as well as the completion acceptance and filing.

The design and construction of the public sports facilities shall meet the relevant construction standards of the State and this Municipality, and shall be equipped with the accessible facilities and the public facilities for the mothers and babies in accordance with the requirements.

The municipal and district people's governments shall coordinate the construction and functional setting of the public sports venues and emergency shelters, strengthen the response and disaster avoidance of the natural disasters, public health and the other emergencies.

Article 45

The managers of the public sports facilities shall make public the methods of opening up to the society, strengthen the socialized and professional operations, improve their social service functions and operational efficiency, and facilitate the citizens to carry out sports activities.

The public sports facilities that are open to the public and do not require additional investment or specialized services shall be opened for free. For those which need to increase investment or provide specialized services, fees may be charged appropriately on the basis of the operating costs. The public sports venues constructed mainly with the fiscal funds shall implement the government guided pricing, and the charging items and standards shall be approved by the pricing and sports departments of the people's governments at the same level.

For the public sports facilities charging fees for their opening or service projects, free of charge or preferential treatment shall be provided to the minors, the elderly people, the disabled, military personnel on active service, and firefighting and rescue personnel.

The public sports facilities shall be open to the public for free on the National Fitness Day, and public sports facilities shall be encouraged to be open to the public for free or at discounted prices during the sports promotion period.

Article 46

No unit or individual shall dismantle the public sports facilities without authorization, change the function, use, or hinder their normal use without authorization. For those to be demolished or those with their functions or uses to be changed by approval, they shall be rebuilt on the selected sites in accordance with the provisions of the relevant laws and administrative rules. The rebuilt public sports facilities shall generally not be smaller than the original scales.

The public sports venues shall mainly be used for the sports activities. For the ancillary parts that may be rented out, the services provided by the renters shall be related to the sports activities such as fitness and sports events, and shall not affect the functions and uses of the main parts of the venues.

Article 47

When constructing, renovating, or expanding the residential areas, the supporting sports facilities for the daily fitness of the residents shall be planned, designed, and constructed in accordance with the relevant provisions of the State and this Municipality, and they shall be checked and accepted, and put into use simultaneously. The planning and resources, housing and urban-rural construction management departments shall, in accordance with the provisions, include the sports facilities for the supporting construction in the planning and design schemes, construction drawing reviews, and completion acceptance and filing.

The district and town/township people's governments, as well as the sub-district offices, shall optimize the allocation of the community public sports facilities, fully consider the fitness needs of the different groups such as the minors and the elderly, and strengthen the co-construction, sharing, and integrated development of the community public sports facilities and the other community public service facilities.

Article 48

The education departments and schools shall, in accordance with the relevant national standards, provide school sports facilities, conduct regular inspections and maintenance, and update them in a timely manner.

The publicly maintained schools shall open the sports facilities to the public in accordance with the provisions, while ensuring the educational and teaching needs of the school and campus safety. The non-governmental schools shall be encouraged to open their sports facilities to the public.

The schools that open their sports facilities to the society shall be supported and guaranteed by the district and town/township people's governments and the sub-district offices where they are located.

Article 49

The natural persons, legal persons, and unincorporated organizations shall be encouraged to construct commercial sports facilities via sole proprietorship, joint venture, cooperation, and the other means. The operating entities with favourable conditions shall be encouraged to carry out the digital transformation of their sports facilities.

The governments at all levels and the relevant departments may support the opening of the commercial sports facilities as public welfare to the society via project subsidies and the other means.

Article 50

The public sports venues and commercial sports facilities shall strengthen the emergency safety protection, be equipped with the necessary emergency equipment, medicines, and the staff with emergency skills.

The public sports venues shall be equipped with the automatic external defibrillators, and the commercial sports facilities with the favourable conditions shall be encouraged to be equipped with the automatic external defibrillators.

Article 51

The public shall abide by the public order and take good care of the public sports facilities when using them.

The owners or managers of the sports facilities shall be responsible for their maintenance and management. When the owners, managers, and users have agreements on the maintenance and management responsibilities, such matters shall be dealt with in accordance with the agreements. Where there are other provisions in laws and rules, these provisions shall prevail.

Article 52

This Municipality shall reasonably reserve the spaces for the construction of sports parks according to the needs, develop sports parks according to the local conditions, promote the free opening of the sports parks, so as to meet the sports and fitness needs of the citizens.

Article 53

On the premise of ensuring the building safety and fire safety, the spaces under the elevated bridges, idle land, rooftop spaces and the other venue resources may be utilized, with the nature of the land not changed for the moment or the use function of the buildings temporarily changed, to construct the public sports facilities.

For the construction of the public sports facilities in accordance with the provisions of the preceding paragraph, the suggestions shall be made by the town/township people's governments, the sub-district offices or the district sports departments. The district people's governments shall coordinate the plan and resources, housing and urban-rural construction management, housing management, public security and the other departments, as well as the fire and rescue institutions, to provide the support and guarantee.

Chapter IX Guarantee Measures

Article 54

The municipal and district people's governments shall include the sports funds in their respective fiscal budgets and establish the investment mechanisms that are suitable for the national economic and social development.

This Municipality shall establish a multi-channel funding investment mechanism that combines the public finance and social capital, and increase the support for the key fields, weak links, and key areas of the sports industry.

According to the relevant national provisions, this Municipality shall use the lottery public welfare funds to implement the national fitness strategies, enhance the comprehensive strength of the competitive sports, and promote the youth and school sports.

Article 55

This Municipality shall develop the sports professional education and encourage the higher education institutions with favourable conditions to cultivate the various sports professionals such as coaches, referees, and sports teachers. The social forces shall be encouraged to carry out the sports professional education and vocational skills training, or to cultivate sports professionals via collaboration with the high-level foreign institutions.

This Municipality shall encourage the introduction of the high-level domestic and foreign athletes, coaches, referees and the other sports professionals, as well as the professionals in sports brokerage, event operation, sports research, sports medicine and the other fields.

The athletes and their training units or individuals who have achieved outstanding results in the major international and domestic competitions representing the country and this Municipality shall be rewarded in accordance with the relevant provisions.

Article 56

The municipal science and technology departments shall, together with the municipal sports department, establish a sports science and technology innovation system that deeply integrates industry, education and research, strengthen the scientific and technological innovation and achievement transformation, and promote the development and application of the new technologies, materials, and equipment in the field of sports.

This Municipality shall strengthen the construction of sports informatization, relying on the Integrated Online Management platform of the government services to provide the convenient services such as public sports facility inquiry and reservation, events information services, and applications for the government supported projects.

The operators with the favourable conditions shall be encouraged to access the government service of the Integrated Online Management platform according to the unified data standards, providing the citizens with the information inquiry, reservation and the other services.

Article 57

The municipal sports department shall strengthen the construction of sports standardization, organize the drafting of the local standards for the sports public services, competitive sports, venue operation, and event activities.

The enterprises, social organizations, institutions of higher learning, and research institutions shall be encouraged and supported to carry out or participate in the sports standardization work, actively participate in the formulation of the national and international standards, and carry out the standardization cooperation and exchange.

Article 58

The sports departments shall, together with the judicial administration and the other departments, promote the establishment of the diversified mechanisms for resolving the sports disputes, strengthen the prevention and governance of the sports dispute sources, and optimize the sports business environment.

It shall be encouraged to rely on the diverse mechanisms for resolving the sports disputes to solve the disputes within the sports organizations, and the sports disputes shall also be solved by mediation, arbitration, and the other means.

Chapter X Supervision and Management

Article 59

The sports, market regulation, culture and tourism and the other departments shall fulfill their supervisory and management responsibilities in accordance with the law, rely on the urban operation of the Integrated Online Management platform, strengthen the sharing of the regulatory information and law enforcement cooperation in the high-risk sports projects, sports events, sports markets and the other areas.

Article 60

When carrying out the high-risk sports projects, the safety facilities and equipment, as well as the sports guidance personnel and rescue personnel, shall be provided in accordance with the Provisions of the State and this Municipality.

Those who engage in the high-risk sports activities shall apply for permission from the local sports departments in accordance with the law. The others who carry out the high-risk sports activities shall be registered with the local district sports departments within 10 working days after providing the services. The specific measures shall be formulated separately by the municipal sports department.

The sports departments shall publicly disclose the operating permits and venue registration information of the high-risk sports projects to the society, and establish the coordination mechanisms for the supervision of the high-risk sports projects together with the departments such as culture and tourism, education, public security, market regulation, health, as well as the fire and rescue institutions, to strengthen the supervision and management of the high-risk sports projects.

Article 61

When organizing the high-risk sports events, the organizers shall go through the relevant approval procedures in accordance with the law, fulfill the safety protection obligations, provide the safety conditions that meet the requirement, formulate the emergency response plans, take risk prevention measures, and maintain the safety of the events.

The sports, public security, culture and tourism, emergency management and the other departments shall strengthen the supervision of the high-risk sports events in accordance with their respective responsibilities, supervise and urge the event organizers to implement the measures concerning event organization, safety equipment, risk prevention and control, emergency rescue, etc., and prevent and resolve the major safety risks.

Article 62

When the operators of the sports and fitness industry conduct business activities on a prepaid basis, they shall display the information such as the contents of sports and fitness service items, charging standards, and lease terms of the business premises at the prominent positions in the business service venues and on the online business pages, and inform the consumers in writing of the purpose and management methods of the prepayment funds, balance inquiry channels, refund methods, and the other contents, reminding them of the risk of prepayment.

When the consumers request to sign written contracts, the operators shall sign written contracts with them. This Municipality shall recommend the use of the demonstration texts of the sports and fitness service contracts formulated by the municipal sports department together with the municipal market regulation department, the municipal consumer rights protection committee, and the relevant industry associations.

Article 63

When the operators of the sports and fitness industry conduct business activities on a prepaid basis, they shall follow the principles of protecting the legitimate rights and interests of the consumers and strengthening the business risk control, and reasonably set the prepayment amounts and the redeemable service periods and the number of times in accordance with the relevant provisions of this Municipality. The specific provisions shall be formulated by the municipal sports department together with the municipal commerce, culture and tourism, local financial supervision and the other departments.

The depository of the funds for the prepaid business activities in the sports and fitness industry shall be conducted in accordance with the relevant provisions of the State and this Municipality, and the risk warning standards and risk prevention measures for the prepaid funds shall be reasonably determined on the basis of the scales and credit statuses of the sports and fitness industry operators.

The sports and fitness industry associations shall strengthen the industry self-discipline, regulate the acts of the operators and practitioners, promote the transformation and upgrading of the business models, and promote the healthy development of the industry.

Article 64

The use of stimulants in sports shall be prohibited.

The sports departments shall work together with the health, education, public security and other departments to implement the comprehensive management of doping issues.

The sports departments shall organize the anti-doping publicity and education, strengthen the guidance on the anti-doping work for the various sports teams, and improve the anti-doping awareness of the sports participants and the public.

Chapter XI Legal Liability

Article 65

For the acts that violate the provisions of these Regulations, whereas there are already provisions for handling them in laws and administrative rules, those provisions shall prevail.

Article 66

For those who, violating the provisions of Article 60, Paragraph 2 of these Regulations, engage in the high-risk sports activities without filing them as required, the sports departments shall order them to make corrections within the specified time limits and may impose a fine of not less than 1,000 yuan but not more than 10,000 yuan.

Article 67

For the sports and fitness industry operators, who, violating the provisions of Article 62, Paragraph 1 of these Regulations, fail to fulfill the obligation of written notification as required, the sports departments shall order them to make corrections within the specified time limits. Those who fail to make the corrections within the prescribed time limits shall be fined not less than 5,000 yuan but not more than 50,000 yuan.

For the operators of the sports and fitness industry, who, violating the provisions of Article 63, Paragraph 1 of these Regulations, fail to set the prepayment amounts and the redeemable service periods and the number of times in accordance with the provisions, the sports departments shall order them to make corrections within the specified periods of time; those who fail to make the corrections within the prescribed time limits shall be ordered to cease their prepaid business activities.

Article 68

For the sports and the other departments and their staff who, violating the provisions of these Regulations, fail to fulfill their relevant management responsibilities in accordance with the law, they shall be ordered to make corrections by their respective units or the higher-level competent departments. For those who neglect their duties, abuse their power, or engage in favoritism and fraud, the leading persons directly in charge and the other directly responsible persons shall be punished in accordance with the law; if the case constitutes a crime, the criminal responsibilities shall be investigated in accordance with the law.

Chapter XII Supplementary Provision

Article 69

These Regulations shall be effective as of January 1, 2024.
