Decision of the Standing Committee of Shanghai Municipal People's Congress on Promoting and Guaranteeing the Construction of the 'Five New Cities'

The new city is an important functional node of the network, multi-center, group and intensive spatial structure determined in the Shanghai Master Plan (2017-2035), an important part of the construction of a new pattern of urban space, and an important strategic space for Shanghai to be invested with the national strategy. With a view to promoting the construction of the five new cities, including Jiading, Qingpu, Songjiang, Fengxian and Nanhui, a decision is made as follows:

I. This Municipality, according to the positioning of an independent comprehensive node city, shall coordinate the economic, living, ecological and security needs of the development of the new cities, and build them into cities of hope and cities of future, an important growth pole of citywide economic development, an innovation practice area for the promotion of construction of a city for the people, a demonstration area of transformation towards a digital city, and a strategic support point for Shanghai to serve and radiate the Yangtze River Delta.

II. In promoting the construction of the five new cities, this Municipality shall adhere to the people-centered philosophy, implement the concept of a city for the people, respond to the people’s aspiration and demand for a better life; stick to high-level positioning, implement the new development concept, enhance the "four functions", build a livable, resilient and smart city for the future; adhere to reform and innovation, enhance the concept of system, continue to strengthen the new cities' development impetus and vitality; stick to development according to the local conditions, identify comparative advantages and shape a pattern of tiered development, complementary advantages and mutual empowerment between the new cities and the central city.

III. In promoting the construction of the new cities, this Municipality shall establish a district-based working mechanism with coordination between the Municipality and the districts, so as to form a joint force. The Municipal People's Government shall strengthen the unified leadership of the construction of the new cities, and establish and improve the promotion and coordination mechanism to comprehensively solve the major problems in the development of the new cities. The relevant departments of the Municipal People's Government shall support and guarantee the construction of the new cities according to their respective functions and duties.

The Municipal People's Government and its relevant departments shall, in accordance with the principle of "efficiency first, serving development" and the law, delegate administrative powers such as the power of administrative examination and approval, which are in line with the functional positioning of the new cities, and conducive to promoting the construction of the new cities and to improving public services and promoting efficient governance, and expand the autonomy of the construction and development of the new cities.

As responsibility subjects for promoting the construction of the new cities, the relevant district people's governments (including the relevant administrative committees, the same below) shall establish and improve the working mechanism for promoting the construction of the new cities, innovate various policies and measures according to local conditions, and undertake the administrative powers delegated by the municipal authorities.

IV. The construction of the new cities shall give full play to the leading role of territorial spatial planning and maintain strategic focus. The territorial spatial planning of the new cities shall meet the requirements of integration of industries and cities, with complete functions, work-residence balance, livable ecology, convenient transportation and efficient governance, strengthen coordination in implementing national major strategic tasks, and enhance the coordinated integration of strategic planning, functional planning and spatial planning.

This Municipality shall establish and improve the evaluation and dynamic maintenance mechanism for the territorial spatial planning of the new cities. The relevant departments of the Municipal People's Government and the relevant district people's governments shall make an annual evaluation of the implementation of the plan and conduct a comprehensive evaluation every five years, and promptly optimize the plan according to the evaluation results.

V. The municipal and relevant district people's governments shall strengthen joint efforts between the central city and the new cities, introduce high-level projects to the new cities, push the new cities to develop multiple functions such as enterprise headquarters, research and development innovation, production factor platforms, and public service, so as to increase their attraction to the population of the central city.

The municipal development & reform department shall, jointly with the relevant departments, strengthen the overall layout of municipal-level resources, and draw up a list of resource supply in light of the needs of the new cities; the relevant district people's governments shall take initiative to cooperate, strengthen services and create conditions to promote the introduction of functions that comply with the development positioning and the relevant development plan of the new cities.

VI. The construction of the new cities shall strengthen industrial support, focus on the leading industries and future industrial layout, and strengthen the deep integration of industry, education, research and application according to their respective industrial foundation, location advantages and resource endowment, so as to realize differentiated, complementary and coordinated development.

The municipal economy and informatization department, shall, jointly with the relevant district people's government, formulate industry guidelines that focus on the key links of the industrial chain and the value chain, upgrade leading industries and orienting towards the establishment of an open industry system featuring respective characteristics and coordinated development, consolidate the development foundation of the manufacturing industry, optimize the industrial park management system and promotion mechanism, and build characteristic industry clusters with competitiveness.

The municipal departments of economy and informatization, and commerce shall, jointly with the relevant district people's governments, actively develop the headquarters economy and promote the development of high-level producer services and high-quality consumer services.

VII. The construction of the new cities shall accelerate the construction of a modern, intensive, fully functional, and intelligent ecological comprehensive transportation system and improve the functions of regional transportation nodes and hub radiation services.

The municipal transportation department shall, jointly with the relevant district people's governments, build a convenient and efficient external transportation system, accelerate the construction of fast transportation passages and rail transit express lines between the new cities and the central city, and the construction of fast transportation passages between the new cities and the cities in the Yangtze River Delta.

The relevant district people's governments shall adhere to green and intensive development, build a well-structured comprehensive internal transportation system, optimize the road network structure, and build a high-quality slow traffic system.

VIII. The construction of the new cities shall be people-oriented, strengthen the urban designing, and constantly improve the quality of urban construction.

The municipal administrative department of housing and urban-rural development shall, jointly with the relevant departments and the relevant district people's governments, promote with high standards the construction of buildings, public space and infrastructure in the new cities, strengthen the integrity, systematization and coordination of spatial quality; promote the construction of demonstration areas (projects) such as green buildings, new infrastructure and sponge city; implement the concept of a park city, build an open and connected ecological pattern featuring blue interweaved with green; strengthen the organic renewal of the old urban area, and the integrated arrangement and functional coordination of production layout, living environment and ecological space of the new cities and the old urban areas, and shape a new city style blending tradition and modernity.

IX. The construction of the new cities shall be benchmarked against the first-class standards, and upgrade public services. The municipal and relevant district people's governments shall actively introduce education, health, culture, sports, tourism and other public services and improve the supporting services in the new cities, increase the supply of quality education resources, further enhance the allocation of medical resources of various types and at all levels, and support the cooperation and joint construction between cultural and sports venues at the municipal level and those in the new cities, so as to introduce municipal major cultural and sports activities and events to the new cities.

The relevant district people's governments shall build one-stop community service complexes with composite functions, improve the community-level public service configuration and operation guarantee mechanism, and actively create "15-minute community life circles"; promote the coordinated development of the housing planning and construction, rail transit construction, employment distribution and supporting public facilities in the new cities; promote the synchronization of new city development and rural revitalization, so as to narrow the gap between urban and rural areas and promote common prosperity.

X. The relevant departments of the Municipal People's Government shall formulate differentiated policies for population and talent introduction into the new cities, continuously track the implementation effects thereof and promptly adjust and optimize them.

The relevant district people's governments shall meet the special needs of development of the new cities, increase their introduction and training of talents in short supply, outstanding young talents and highly skilled talents, broaden the introduction channels of overseas talents, and improve the supporting policies of education, medical care, pension and other public services involving talents according to local conditions.

XI. The municipal planning and resources department shall, jointly with the relevant district people's governments, strengthen the guarantee of the spatial elements of the new cities, give priority to guaranteeing the demand of land by the construction of the new cities, optimize the land use structure and development intensity, support the secondary development of the stock land of the new cities; improve the land purchase and storage and price determination mechanism, guarantee the effective supply of space resources; optimize the plan implementation mechanism, improve the plan implementation platform, coordinate the plan, construction and operation management, innovate the technical specifications and design standards, and strengthen the resource integration and construction timing arrangement.

XII. The municipal and relevant district people's governments shall increase the financial support for the new cities, strengthen the support for the construction, operation and maintenance of the new cities; implement the special support policy on income from transfer of municipal land that is within the new cities, and increase the support for the issuance of the government bonds by the new cities.

Financial institutions shall be encouraged to innovate financial products and services, to support the construction of major projects and platforms that are in line with the industrial development orientation of the new cities, and to give full play to the role of finance in promoting the construction of the new cities. Innovations shall be made in the development model of the new cities, and the introduction of social capital shall be actively supported in industrial development, urban construction, social programs and other fields, so as to promote the diversification of investment, development and operation entities.

XIII. The relevant district people's governments shall accelerate the building of a market-oriented, law-based and internationalized business environment in the new cities, and promote the reform exploration and system innovation in production factor flow, competition policy, dispute settlement, regulation and law enforcement, and other fields; coordinate the business environment, enterprise services, investment promotion and other work, focus on the key areas and major projects of the new cities, implement the green channel for project approval; optimize the in-process and post-event regulation, establish regulatory standards and norm systems that are in line with international standards, and build a new highland of first-class business environment.

The relevant district people's governments shall innovate the governance model, strengthen the public participation in the whole process of plan, construction and management of the new cities, give full play to the functions of "Government Online-Offline Shanghai" and "Integrated Online Administration" platforms, strengthen the empowerment of science and technology, and raise the fineness and intelligence level of urban management.

The relevant departments of the Municipal People's Government shall establish and improve the indicator and statistical system that objectively reflects the construction of the new cities, carry out regular monitoring over the construction of the new cities and promptly optimize the statistical indicators.

XIIII. The Standing Committee of the Municipal People's Congress shall promptly formulate and revise, or temporarily adjust or stop the implementation of the local rules related to the construction of the new cities; on the premise of following the principle of unification of the national legal system and the basic principles of this Municipality's local rules, the Municipal People's Government may formulate and submit for filing with the Standing Committee of the Municipal People's Congress relevant documents on the promotion of construction of the new cities, of which the implementation may be tried first in the new cities; and the relevant district people's congresses and their standing committees may make relevant resolutions and decisions on the promotion and guarantee of construction of the new cities, and report that to the Standing Committee of the Municipal People's Congress for filing on record.

The Standing Committee of the Municipal People's Congress and the standing committees of the relevant district people's congresses shall give full play to the role of deputies to the people's congresses at all levels, organize them to carry out special research, inspection and other activities around the construction of the new cities, collect and reflect the opinions and suggestions of the people, and urge relevant parties to implement various work on the construction of the new cities.

This Decision shall be effective as of October 28, 2023.
