Regulations of Shanghai Municipality on Promoting the Building of

Shanghai as an International Trade Center

(Adopted at the 37th Session of the Standing Committee of the 13th Shanghai People's Congress on November 21, 2012 and amended at the 9th Session of the Standing Committee of the 16th Shanghai People's Congress on December 28, 2023)

Chapter I General Provisions

Article 1

With a view to promoting the building of Shanghai as an international trade center (hereinafter referred to as "Shanghai International Trade Center"), facilitating trade transformation and upgrading, serving the establishment of a new development pattern, and achieving high-quality trade development, these Regulations are formulated in accordance with the relevant laws and administrative rules, and in the light of the actual circumstances of this Municipality.

Article 2

This Municipality promotes the building of an international trade center to align with the high-standard international trade rules, upgrade the trade in goods, innovate the trade in services, develop the digital trade, and promote the digitization and greening of trade, so as to elevate the level of trade liberalization and facilitation, promote the integration of domestic and foreign trade, and coordinately consider development and security, with a view to creating a fair, non-discriminatory, and predictable trade environment, and building Shanghai International Trade Center into a crucial hub in the global industrial chain, supply chain, and value chain.

Article 3

The Municipal People's Government shall strengthen its leadership over the promotion of the building of Shanghai International Trade Center, organize the formulation of the plan for building Shanghai International Trade Center, deepen its cooperation with the commerce authorities of the State, reinforce the systematic advancement and facilitation of the Municipality as an international trade center and as international economic, financial, shipping, and technological innovation centers, upgrade its resource allocation ability, and enhance its leading role therein.

The Municipal People's Government shall enhance the coordination mechanism for promoting the building of Shanghai International Trade Center, strengthen the overall planning therefor, and coordinately work on the major issues thereof.

The district people's governments shall, in accordance with the overall requirements and arrangements of the Municipality, carry out the relevant work related to the promotion of the building of Shanghai International Trade Center within the administrative district.

Article 4

The municipal and district people's governments, as well as their relevant departments, shall take measures to support the building of the trade and investment innovation highlands in the functional areas such as the Pudong New Area, China (Shanghai) Pilot Free Trade Zone, the Lin-Gang Special Area, and the Hongqiao International Central Business District.

The Pudong New Area, China (Shanghai) Pilot Free Trade Zone, the Lin-Gang Special Area, the Hongqiao International Central Business District, and other similar functional areas shall, in accordance with the State's arrangements and in light of their regional functions and industrial characteristics, implement a higher-level institutionalized opening-up policy, and upgrade the capacity of Shanghai International Trade Center.

Article 5

The municipal department of commerce shall be responsible for coordinating the promotion of the relevant work related to the building of Shanghai International Trade Center, and formulating and implementing the phased goals and various measures.

The municipal departments of development and reform, economy and informatization, finance, transport, market regulation, human resources and social security, financial regulation, science and technology, statistics, culture and tourism, sports, public security, intellectual property, and cyberspace affairs, and other relevant departments shall, in light of their respective responsibilities, strengthen the coordination and cooperation to implement the various work related to the building of Shanghai International Trade Center.

The branches and dispatched offices of the State's financial administration department established in Shanghai, the departments in charge of customs, maritime affairs, border inspection, or communication administration, and other relevant departments shall perform the related responsibilities in accordance with law, jointly promoting the work related to the building of Shanghai International Trade Center.

Article 6

This Municipality adheres to the concept of sustainable trade development, prioritizing ecological protection and promoting green and low-carbon development, so as to establish the green and low-carbon trade standards and certification systems, strengthen the application of the green and low-carbon supply chain management, support international cooperation in the green and low-carbon areas, and promote the green transformation of trade.

Article 7

The industrial associations shall, in accordance with the laws, rules, regulations, and their respective bylaws, strengthen self-discipline, timely understand the demands of each industry, and provide services to the enterprises in terms of information consultation, publicity and training, market expansion, and protection of their legal rights and interests.

The relevant departments shall encourage the industry associations to provide guidance, coordination, and assistance to the enterprises in resolving the overseas disputes and trade disputes, and handling the emergencies.

Article 8

The municipal departments of commerce, and statistics, and other relevant departments, shall optimize the methods for monitoring the statistics of the trade in goods, the trade in services, and the digital trade, and, in accordance with the relevant provisions, carry out the collection, compilation, sharing, application, and secure management of the relevant data, and provide references for the formulation of trade policies.

Article 9

This Municipality strengthens the collaborative development of the "Belt and Road" economic and trade cooperation, enhances exchanges and cooperation in the international trade field with the friendly cities in the world, as well as other overseas cities and regions, and expands the bilateral trades therewith.

This Municipality establishes the eastern hub international business cooperation zone, exploring and implementing facilitation measures according to the national deployment, with the cross-border movement of overseas goods and persons as the core, promoting high-level international business exchanges and cooperation, and creating a symbolically significant region as an international open gateway hub.

This Municipality promotes the integrated and high-quality development of the Yangtze River Delta Region, strengthens exchanges and cooperation in the trade field with Hong Kong, Macao, Taiwan, and the other domestic regions, facilitating the smooth flow of the key resources on a larger scale, and pushing forward the construction of a unified national market.

Chapter II Trade in Goods

Article 10

This Municipality develops various forms of trade in goods, optimizing the layout of an international market.

The municipal and district departments of commerce shall, jointly with the relevant departments, encourage the enterprises to strengthen the general trade and enhance brand and channel building, promote processing trade and extend it to both ends of the industrial chain, and expand the logistics in the bonded areas, develop international trade distribution businesses, and optimize the modes of trade.

The municipal and district departments of commerce shall, jointly with the relevant departments, encourage the enterprises to consolidate the traditional markets, expand the emerging markets, focusing on exploring the markets of the countries that are members of the relevant international agreements and the countries participating in the "Belt and Road" initiative, so as to promote the market diversification.

Article 11

The municipal and district departments of commerce shall, jointly with the relevant departments, take the role of policy-guidance, encouraging the trade entities to improve the quality of exported products, expand the export of high-tech, high value-added and competitive products, and promoting the structural optimization of the exported commodities.

The municipal department of commerce shall, jointly with other relevant departments, promote the building of the national foreign trade transformation and upgrades demonstration bases, optimize the supporting public service systems, encourage the agglomeration of the trade entities, and strengthen the coordinated development of trade and the various industries.

Article 12

The municipal departments of commerce, and finance, and other relevant departments, shall encourage the trade entities to expand the scope of importation of the products with advanced technology, important equipment, the key components, and the like products, encouraging the importation of the products such as high-quality consumer goods, energy and resource products, and agricultural products, and promoting the structural optimization of the imported commodities.

The municipal and district departments of commerce shall encourage the regions and areas where conditions permit to establish the national creative demonstration zones for the promotion of importation, and encourage the agglomeration of the importing entities in the demonstration zones, integrating the functions such as commodity importation, bonded warehousing, distribution, exhibition, and trading, to enhance the spillover effect of trade.

This Municipality promotes the pilot work of importing remanufactured products under the guidance of the relevant departments of the State.

Article 13

The port inspection administrations, such as those in charge of customs, maritime affairs, and frontier inspection (hereinafter collectively referred to as "the port inspection administrations") and the municipal department of transport optimize the functions of the Municipality as an entrepot trade hub, promote its ports and airports to elevate the international transport capacity and hub capabilities, and facilitate the flow of goods.

The port inspection administrations, and the municipal departments of port administration, and transport shall coordinately cooperate with each other to optimize the operating model of the international transit and less-than-container-load (LCL) services, encouraging the enterprises to develop international transit businesses.

Article 14

With the support of the relevant departments of the State, this Municipality shall improve the pilot work of free trade accounts for offshore trade businesses, encouraging the financial institutions to provide facilitation in international settlement, trade financing, and other cross-border financial services via free trade accounts in accordance with the internationally accepted rules for offshore trade businesses.

With the support of the department of foreign exchange, this Municipality shall promote the commercial banks to innovatively develop authenticity verification methods for offshore trade. The administrations of China (Shanghai) Pilot Free Trade Zone, the Lin-Gang Special Area, the Hongqiao International Central Business District, and the like areas shall strengthen the development of offshore trade information platforms to improve information collection, interaction, sharing, and the like functions.

Article 15

The Yangshan Special Comprehensive Bonded Zone, Waigaoqiao Bonded Zone, and other comprehensive bonded zones shall, in accordance with the deployment requirements of the State and this Municipality, expand new business forms such as research and development, manufacturing, and maintenance in the bonded areas, enhance the functions of trade, promote industrial transformation and upgrading, and achieve differentiated and specialized development. The municipal departments of development and reform, and commerce shall provide guidance and support in this regard.

Article 16

The municipal and district departments of commerce shall, jointly with other relevant departments, strengthen the establishment of integrated pilot zones for cross-border e-commerce, promote the coordinated development of various entities such as the cross-border e-commerce platforms and the entities engaging in payment, logistics, and third-party services, encourage the enterprises to innovate the development models, and promote the scaled development of cross-border e-commerce.

The municipal and district departments of commerce shall, jointly with the relevant departments, encourage the enterprises to build overseas warehouses by themselves or together with other enterprises, or share overseas warehouses with each other. The enterprises are encouraged to utilize their overseas warehouses to establish an international marketing network and a public service warehouse, integrating product display, storage and logistics, after-sales services, and other functions. The departments shall promote the establishment of a comprehensive platform serving the overseas warehouses, which, through applying the big data and blockchain technology, provides support for the digital and intelligent supervision of the overseas warehouses of cross-border e-commerce.

Article 17

The municipal departments of commerce, and financial regulation, and other relevant departments shall support the development of business coordination of spot markets and futures markets and the connection between domestic and foreign markets in bulk commodity trade, encourage the operation of a national warehouse receipt registration center for registering bulk commodities' warehouse receipts, enhance the functions of over-the-counter (OTC) derivatives trading platforms for bulk commodities, and establish the indices of the price of the important bulk commodities, so as to increase the influence thereof.

Chapter III Trade in Services

Article 18

In accordance with the provisions of the State, this Municipality shall deepen the opening-up of the service industry, implement a negative list management system for cross-border trade in services, and strengthen international cooperation in the service sector.

The competent departments of all industries shall, in accordance with their respective responsibilities, implement the negative list for cross-border trade in services, increase policy transparency, and manage the industries, sectors, and businesses beyond the negative list in accordance with the principle of equal treatment of domestic and foreign investments.

Article 19

The municipal department of commerce shall, jointly with the departments of press and publication, film, culture and tourism, transport, financial regulation, judicial administration, and finance, promote the development of the traditional trade in services such as tourism and transportation, as well as the knowledge-intensive trade in services, including the trade involving intellectual property rights, finance and insurance, and other professional services, with a view to promoting the integration and coordinative development of the trade in services with the modern service industries.

The municipal department of commerce shall, jointly with the departments such as the department of economy and informatization, formulate and release a guiding catalog for promoting the municipal-wide trade in services, and provide support to the operators and the projects of trade in services that meet the corresponding standards listed in the catalog.

Article 20

This Municipality accelerates the innovative development of the trade in services, improves the policies supporting the development of the trade in services, and establishes the national demonstration zones for the innovative development of the trade in services.

The municipal and district departments of commerce shall, jointly with the competent departments of relevant industries, promote the establishment of export bases for the trade in services with the national characteristics in areas such as human resources, intellectual property rights, traditional Chinese medicine, culture, and language services, cultivating the competitive advantages of the trade in services.

Article 21

The municipal department of commerce shall, jointly with the relevant departments, improve the policies promoting technology trade, encourage the introduction of advanced technologies, diversify the sources of importation of technologies, and support the exportation of matured industrialized technologies.

The municipal departments of commerce, and science and technology, and other relevant departments shall strengthen the development of the China (Shanghai) International Technology Import and Export Fair and the International Trading Center of the Shanghai Technology Exchange to promote the exchange, cooperation, and development in technology trade.

Article 22

The municipal departments of commerce, press and publication, film, culture and tourism, and sports, and other relevant departments, shall strengthen the development of this Municipality’s international communication capabilities, enhance the overseas promotion of the films, television programs, sports events, and publications, promote the excellent traditional Chinese culture and Shanghai cultural brands, and expand the scope of exportation of high-quality cultural products and services.

The municipal departments of commerce, press and publication, film, and culture and tourism, and other relevant departments shall orderly promote the importation of high-quality cultural products and services in the fields of publications, films, television dramas, online audio-visual products, sports, performing arts, and cultural arts.

Article 23

The municipal department of commerce shall strengthen the innovation of policies for the trade in tourism service and promote the development of it. The municipal department of culture and tourism shall cultivate world-class tourist attractions, resorts, and tourism enterprise brands, enrich the supply of high-quality tourism products, and establish and improve an overseas network for promoting tourism.

The municipal departments of commerce, transport, culture and tourism, and border inspection, and other relevant departments shall advance the construction of first-class international hub ports for cruise ships, develop the economy by encouraging the cruise companies to establish their headquarters herein, encourage the development of new cruise operation models, optimize cruise support services and management systems, and create a cruise economy center in the Asia-Pacific region.

Article 24

In accordance with the State's deployment, this Municipality shall enhance the opening-up of professional services to the outside world, and, under the policy guidance and support, promote the financial, legal, accounting, consulting, and other professional service institutions to improve the level and quality of their services. The professional service institutions with necessary conditions are encouraged to establish overseas branches, offices, and service networks, expand cross-border services, strengthen brand building, and provide professional services to the enterprises for their overseas trade and investment.

Article 25

The municipal departments of commerce, and economy and informatization, and other relevant departments shall encourage the enterprises to develop outsourcing services in the fields of research and development, design, testing and maintenance, management consulting, and information technology, so as to promote the development of the productive service industries.

This Municipality enhances the development of a demonstration city for national service outsourcing. The municipal department of commerce shall formulate policy measures, cultivate and develop new service outsourcing models such as cloud outsourcing, and promote the transformation and upgrading of the service outsourcing industry towards the medium and high end of the value chain.

Article 26

The Pudong New Area, China (Shanghai) Pilot Free Trade Zone, the Lin-Gang Special Area, and other relevant areas shall, in accordance with the provisions of the State and this Municipality, formulate a list of professional services that the overseas professionals are encouraged to provide, and permit qualified professionals with overseas professional qualifications to provide professional services.

Chapter IV Digital Trade

Article 27

This Municipality establishes and improves a mechanism to promote digital trade in line with the international rules and standards for digital trade, enhances the policies to promote the digital trade, and accelerates the development of the trade in digital products, services, and technologies.

The municipal departments of commerce, and economy and informatization, and other relevant departments shall encourage the digital trade entities to expand the supply of digital technologies and products such as artificial intelligence, cloud computing, big data, industrial internet, blockchain, metaverse, online gaming, and digital animation to enhance the competitiveness of the digital trade.

Article 28

This Municipality supports the development of the digital trade entities and cultivates the benchmark enterprises in digital trade.

The domestic and foreign digital trade enterprises are encouraged to establish headquarters or regional headquarters in this Municipality.

Article 29

This Municipality establishes a pilot zone for "Silk Road e-commerce" cooperation, creates central functional areas in the zones under special supervision of the customs in China (Shanghai) Pilot Free Trade Zone and the Lin-Gang Special Area so as to align with the international high-standard rules on e-commerce, and thus to promote international cooperation in digital economy.

This Municipality accelerates the development of the Lin-gang demonstration zone of Shanghai digital trade international hub port and the global digital trade port in the Hongqiao International Central Business District, and supports the development of the national bases for export of digital services and geographic information services.

The municipal departments of economy and informatization, development and reform, cyberspace affairs, and commerce, and other relevant departments shall support the development of the international board of Shanghai Data Exchange.

Article 30

The municipal departments of cyberspace affairs, development and reform, economy and informatization, communication administration, public security, and commerce, and other relevant departments shall, under the guidance of the relevant departments of the State, carry out classified and graded management of cross-border data flow, explore and establish a lawful, secure, and convenient mechanism for cross-border data flow, promote the application of digital identity authentication in digital trade, facilitate secure and free flow of cross-border data, and encourage domestic and foreign enterprises and organizations to carry out cooperation in cross-border data flow business in accordance with law.

Article 31

The municipal departments of cyberspace affairs, economy and informatization, commerce, intellectual property, and communication administration, and other relevant departments shall coordinate in the supervision of digital trade entities, protection of personal information, and outbound transfer of important data, strengthen risk prevention, and regulate the governance of digital trade.

The municipal departments of cyberspace affairs, development and reform, and economy and informatization, and other relevant departments shall implement a certification system for data security management, guiding the enterprises to enhance their data security management capabilities and standard.

Article 32

This Municipality strengthens international exchanges and cooperation in digital trade, encourages the industry organizations and enterprises to participate in the formulation of international rules and standards for digital trade, and supports the establishment and development of the industrial park of international data economy and joint laboratories for international data and computing services, cross-border digital trust, and data governance in the Lin-Gang Special Area of China (Shanghai) Pilot Free Trade Zone.

Chapter V Trade Promotion

Article 33

This Municipality promotes the coordinated development of domestic and foreign trade, facilitates the connection of the supervision measures, business qualifications, quality standards, inspection and testing, certification, and recognition between domestic and foreign trade, encourages the enterprises to explore both domestic and international markets through cross-border e-commerce, and promotes the smooth flow of the key resources between domestic and foreign trade.

The municipal departments of commerce, and market regulation, and other relevant departments shall encourage the export enterprises to collaborate with the enterprises engaging in domestic commercial and trade circulation, encourage the enterprises to produce products sold in international and domestic markets in line with the requirements of "the same line, same standard, and same quality" (hereinafter referred to as the "three-same requirements"), and encourage the enterprises to make self-declarations or entrust a third-party organization to certify that their products are in compliance with the "three-same" requirements.

Article 34

The municipal and district departments of commerce encourage domestic and foreign investors to establish trading companies, and encourage the regional headquarters of multinational companies to strengthen their trade functions to conduct procurement and sales, trade settlement, and other businesses, promote innovation in trade forms, enlarge the trade scale, and promote the development of high-quality trade.

The municipal and district departments of commerce shall encourage the enterprises with necessary conditions to make overseas investment to promote foreign trade, and enhance the competitiveness of their foreign trade products in the international market. The enterprises are encouraged to contract foreign projects and expand the exportation of equipment, services, technology, and standards.

Article 35

This Municipality advances the development of this Municipality as an international consumption center. The municipal department of commerce shall, jointly with other relevant departments, take measures to encourage enterprises to expand the importation of distinctive and high-quality products and services via multiple channels, and encourage the domestic and foreign brand enterprises to launch debut releases, debut shows, and debut exhibitions of new products in this Municipality, creating a global first-launch location and a global consumer destination.

The municipal departments of commerce, finance, tax, and culture and tourism, and other relevant departments shall promote the development of the economy featuring tax exemption and tax refund, encourage qualified enterprises to establish departure tax refund shops, and enhance the facilitation of sales tax refund for overseas tourists upon their leaving China.

The municipal departments of commerce, finance, tax, culture and tourism, and public security, and other relevant departments shall take measures to enhance the inbound consumers' consumption experience, provide multilingual services for the inbound consumers, and elevate the level of services involving foreign elements in areas such as currency exchange, consumption payment, and consumer rights protection.

Article 36

The municipal department of commerce, and trade promotion services shall cultivate renowned brand exhibitions and exhibition groups which are internationally competitive, and introduce internationally well-known exhibition companies, and industrial organizations, and internationally renowned exhibition events, so as to amplify the comprehensive driving effects of the exhibition economy.

The various types of trade promotion services in this Municipality shall organize enterprises to participate in domestic and international exhibitions, optimize the supply-procurement connection of the key exhibition platforms, and provide services for the enterprises to expand their markets.

This Municipality takes advantage of the China International Import Expo's role in trade promotion, strengthens the development of the platform of imported commodity exhibition and trading, diversifies the categories of imported commodities, and facilitates the entry of more commodities displayed in the import exhibition into the domestic market.

Article 37

This Municipality cultivates and introduces various trading enterprises with high-level capacity and certain scale, which have one or more of the trade functions such as procurement, distribution, marketing, settlement, and logistics.

This Municipality encourages the enterprises to establish trade-oriented headquarters and upgrade their trade-oriented headquarters to Asia-Pacific headquarters or even global headquarters. The municipal department of commerce shall, jointly with other relevant departments, improve policies for the trade-oriented headquarters, and the qualified trade-oriented headquarters may enjoy preferential policies, in accordance with the relevant provisions, in areas such as fund operation and management, trade facilitation, introduction of talents, and entry and exit of personnel.

Article 38

The municipal departments of commerce, and economy and informatization, and other relevant departments shall formulate policy measures to enhance the standard of serving the small and medium-sized enterprises, encourage them to expand their markets and engage in foreign trade, and cultivate "specialized, sophisticated, distinctive, and innovative" small and medium-sized trading enterprises.

Article 39

The municipal departments of commerce, and trade promotion services shall, in light of the actual needs, establish overseas trade promotion institutions and improve the overseas trade promotion network.

The municipal departments of commerce, public security, and civil affairs, and other relevant departments shall encourage the influential international economic and trade organizations, international trade associations and chambers of commerce, and other trade promotion institutions to establish headquarters or resident representative offices in Shanghai, and encourage them to conduct business in accordance with law, expand their functions for external exchange and cooperation, and promote trade development.

Article 40

The municipal and district departments of commerce shall, through providing training, consultation, public services, and the like means, help the enterprises improve their abilities to apply the free trade agreements and expand the scale of their trade with other member countries of the agreements.

This Municipality encourages the relevant industry organizations, trade promotion services, and other institutions to take various forms to enhance the promotion of free trade agreements, and guides the enterprises to reduce the cost of foreign trade through taking the measures such as tariff reduction, rules of origin, market access, and simplified customs cargo clearance procedures.

Chapter VI Trade Facilitation

Article 41

The municipal department of port services shall accelerate the development of digital infrastructure at ports and fully utilize the new technologies such as blockchain, big data, and artificial intelligence, to increase the digitalization of port services.

This Municipality encourages the port inspection services to optimize operation processes and services and innovate facilitation services. The port inspection services shall optimize digitized intelligent supervision at ports, and explore and promote the regional inter-departmental joint credit supervision, so as to upgrade the level of intelligentization.

The municipal departments of port services, and transport, and other relevant departments shall deepen the development of the "Single Window" for China (Shanghai) International Trade, achieving the goal of "one platform, one submission, feedback on results, and data sharing", which provides the declarants with fully electronic services throughout the customs and logistics processes, and enhances the facilitation level of trade financing, credit insurance, export tax rebate, and other business transactions.

Article 42

The municipal departments of port services, and transport, and other relevant departments shall improve the coordination mechanism for customs clearance in the Yangtze River Delta Region, deepen the cooperative development of the "Single Window" for international trade in the Yangtze River Delta Region, and promote the key ports to carry out water-to-water transshipment, river-sea transportation, sea-rail combined transportation, and air-to-air transit services.

The municipal departments of port services, and maritime affairs, and other relevant departments shall optimize and upgrade the declaration system for vessels entering and exiting the deep-water channel of the Yangtze River estuary, improving the efficiency of container ships and cruise ships inward and outward the ports.

The municipal departments of port services shall, through utilizing the Asia-Pacific demonstration E-port network, promote the sharing and exchange of data of international trade-related documents and port logistics via the Single Window for China (Shanghai) International Trade.

Article 43

The member units of the joint meeting for the zones in this Municipality under special supervision of the customs shall promote the replication and expansion of the innovative trade facilitation measures adopted in China (Shanghai) Pilot Free Trade Zone.

The member units of the joint meeting for the zones in this Municipality under special supervision of the customs agree to improve the intelligent, efficient, and comprehensive supervision model in the said zones through the means such as applying electronic accounting books, credit supervision, and risk monitoring, to upgrade the level of trade facilitation.

Article 44

This Municipality launches a pilot program for importing goods for biopharmaceutical research and development. The municipal department of commerce shall, jointly with other relevant departments, establish a joint promotion mechanism for the importation of goods for biopharmaceutical research and development, improve the supervision through information technology, and promote facilitation of customs clearance for the biopharmaceutical enterprises or research institutions to import the goods.

The municipal department of economy and informatization shall, jointly with other relevant departments, implement a municipal pilot joint mechanism for monitoring the flow inbound and outbound of the special biopharmaceutical goods to facilitate customs clearance for such goods of biopharmaceutical enterprises.

Article 45

Under the guidance of the branches and dispatched offices of the State's financial administrative departments established in Shanghai, this Municipality deepens the pilot reform of high-level opening-up of foreign exchange management for cross-border trade and investment to improve the facilitation of cross-border fund receipts and payments. The municipal departments of financial regulation, and commerce encourage the commercial banks to utilize the infrastructures such as the Cross-border Interbank Payment System (CIPS) to implement measures that facilitate the cross-border RMB settlement, encourage the prioritization of RMB settlement in cross-border trade, and expand the application of digital RMB in foreign trade.

Article 46

The municipal tax department shall utilize the information systems such as the e-tax service system to provide electronic services such as electronic tax payment for the declarants, facilitate export tax rebate, and improve the efficiency of tax rebate examination and verification.

This Municipality encourages qualified enterprises to adopt diversified tax payment guarantee methods to improve the efficiency of fund utilization and cargo clearance.

Article 47

In accordance with the internationally accepted standards, this Municipality utilizes the blockchain technology to promote the digitization of trade documents such as bills of lading, waybills, and letters of credit, and upgrades its level of facilitation of international trade.

Article 48

This Municipality supports the development of infrastructures related to cross-border electronic invoices, promotes international cooperation in electronic invoicing, enhances the cross-border interactivity of electronic invoices, and promotes the application of electronic invoices in international trade.

Article 49

The municipal and district departments of commerce shall guide a qualified enterprise to apply for being an Advanced Enterprise Certified by the Customs to improve the credit level of import and export enterprises, and promote the relevant departments to implement joint incentives for such Enterprises.

Chapter VII The Order of Trade

Article 50

The municipal department of commerce shall, jointly with other relevant municipal departments, carry out the compliance work in international trade through guiding the industrial organizations to strengthen compliance training and organizing exchange activities regarding compliance, encourage the enterprises to establish internal compliance management systems, conduct compliance risk assessments, and upgrade the level of legal compliance of their operations and the level of digital and informatization management.

The municipal department of commerce shall establish a network platform for international trade compliance service, regularly release international trade compliance information, compile specialized compliance guidelines, improve the information query systems for export control, economic sanctions, etc., and provide services for the enterprises to conduct in-compliance international operations.

Article 51

This Municipality establishes and improves a system of trade adjustment assistance. The municipal department of commerce shall, jointly with the municipal departments of economy and informatization, human resources and social security, and finance, and other relevant departments, provide such assistance as consultation, training, and technical guidance to the enterprises affected by changes of the trade environment, supporting and guiding them to independently adjust their trade.

Where an enterprise is severely affected by the changes of the trade environment and thus has encountered difficulties in production and operation and high employee turnover, it may, in accordance with the relevant provisions, submit an application to the municipal department of commerce for assistance in trade adjustment. For a qualified enterprise, the municipal department of commerce shall, jointly with other relevant departments, provide such assistance thereto as product technology improvement, new product development, marketing channel optimization, and market risk management.

Article 52

The municipal department of commerce shall conduct regular impact analyses and assessments on the industrial trade policies of the key countries and key markets, and release the results thereof. For the risks identified in the assessment, the department shall issue a warning via the industrial security warning platform, and guide the relevant enterprises to conduct risk prevention. The relevant departments and units in this Municipality shall assist the municipal department of commerce in providing the relevant data thereof.

Article 53

The municipal department of commerce shall, jointly with the relevant municipal departments, formulate policy measures to address trade frictions, and, based on the international trade standards and practices, guide the enterprises to respond in cases involving anti-dumping, countervailing, technical trade measures, intellectual property rights, and economic sanctions, and in other trade friction cases, release information of the trade friction cases and the guidance of response, and guide the industrial organizations and enterprises to apply for trade remedies in accordance with the relevant provisions of the State.

Article 54

The municipal departments of intellectual property, market regulation, culture and tourism, and copyright, and other relevant departments shall, according to their respective responsibilities, improve the mechanism of trade-related intellectual property protection, and investigate and address the illegal acts of intellectual property infringement according to law.

The municipal department of commerce shall, jointly with the municipal department of intellectual property and other relevant departments, promote international cooperation in the trade-related intellectual property protection, support the enterprises in overseas intellectual property registration and purchase of intellectual property-related insurance, and provide guidance and assistance to the enterprises in safeguarding their intellectual property rights overseas.

Article 55

The municipal department of commerce shall, jointly with the relevant departments and all district people's governments, establish and improve a fair trade working mechanism in which the government departments, industrial organizations, professional service institutions, and enterprises all participate, in order to create a fair trade environment, carry out fair trade policy publicity and policy research, and implement the measures for the prevention and coordinated responses to major economic and trade risks.

Chapter VIII Safeguard Measures

Article 56

Where the municipal department of planning and natural resource and the relevant district people's governments are organizing the formulation of detailed planning and the annual plans for land and resource utilization, the demands for the land for construction purposes must be guaranteed in accordance with the overall land use planning of this Municipality and the requirements of building Shanghai into an international trade center.

The municipal department of commerce shall, jointly with the municipal departments of development and reform, transport, and planning and natural resource, other relevant departments, and the relevant district people's governments, reasonably design the layout of logistics facilities to ensure the construction land for facilities such as warehousing, distribution, transportation, and delivery based on the needs of trade development.

Article 57

This Municipality encourages the financial institutions to launch financial innovations based on the needs for trade financing, providing increased credit support for qualified trade enterprises. The governmental financing guarantee institutions are encouraged to provide financing credit support for small and medium-sized trade enterprises.

The municipal departments of commerce, and finance, and other relevant departments encourage the policy-oriented export credit insurance institutions to expand the coverage of export credit insurance, increase the financing capacity of insurance policy underwriting, and optimize the conditions for underwriting and handling claims to improve the quality of their service.

The municipal department of ecology and environment shall, jointly with the relevant departments, expand and improve the functions of the carbon emission trading market and encourage innovations in carbon financial services, such as carbon repurchases, carbon pledges, and carbon indices.

Article 58

The municipal departments of education, human resources and social security, and commerce, and other relevant departments shall strengthen the cultivation of high-level trade talents and collaborate with the higher education institutions and vocational schools to conduct collaborative cultivation of compound and innovative high-end talents in the international business field.

The municipal department of commerce shall, jointly with the municipal department of human resources and social security, and other relevant departments, introduce the urgently needed talents and the high-end talents from home and aboard that are needed for building the international trade center.

The municipal and district people's governments, as well as their relevant departments, shall improve the supporting policies for introducing trade talents, facilitating the high-level talents and the talents urgently needed brought in, by easing their household registration, residence permit application, housing, and medical insurance, and, in accordance with the relevant provisions of the State, providing convenient entry, exit and residence permit for overseas trade talents brought in and those engaged in trade and the related services in China.

Article 59

This Municipality establishes and improves a one-stop multi-dimensional dispute resolution mechanism that integrates mediation, arbitration and litigation, with a view to taking advantage of the diverse dispute resolution methods to promote efficient and convenient resolution of trade disputes.

The municipal department of judicial administration and other relevant departments shall support various professional commercial dispute mediation organizations to resolve trade disputes by taking various ways in accordance with the international practice.

This Municipality promotes the development of this Municipality as an international commercial arbitration center, encourages arbitration institutions to improve the arbitration rules in accordance with the laws, rules and regulations, by reference to international practices, and business customs, and to improve the professional level and internationalization level of arbitration of trade disputes.

The people's courts at all levels in this Municipality shall improve the mechanism of adjudicating commercial disputes in accordance with law and strengthen the enforcement of effective judgments, rulings, and other legal documents.

Chapter IX Supplementary Provision

Article 60

These Regulations shall be effective as of February 1, 2024.
