Regulations of Shanghai Municipality on Promoting High-quality Development of the Yangtze River Delta Ecological and Green Integrative Development Demonstration Zone

Chapter I General Provisions
Article 1
These Regulations are formulated in accordance with the relevant laws and administrative rules, the Outline of the Development Planning for the Yangtze River Delta Region, and the Overall Plan for the Yangtze River Delta Ecological and Green Integrative Development Demonstration Zone (hereinafter referred to as "the Demonstration Zon" or "the Zone"), with a view to further implementing the national strategy of integrative development of the Yangtze River Delta (hereinafter referred to as the YRD), making the Demonstration Zone play a leading role with breakthrough effect, and setting a YRD example of the Chinese path to modernization.
Article 2
These Regulations shall apply to the activities conducted within this Municipality that are relevant to promoting the integrative and high-quality development of the Demonstration Zone.
The Demonstration Zone covers Qingpu District of Shanghai Municipality, Wujiang District of Suzhou City, Jiangsu Province, and Jiashan County of Jiaxing City, Zhejiang Province (hereinafter collectively referred to as "the Two Districts and One County").
Article 3
The construction of the Demonstration Zone shall be done through practicing new development philosophy, leading in innovations, developing new productivity by adapting to local conditions, promoting innovation of policies on and modes of high-quality development, accelerating the progress leap from form development to function development, and taking the lead to achieve quality upgrade, efficiency increase, and motivation change, to transform the advantages in ecology into the advantages in economic and social development, and to lead the exploration of the path from regional project synergy to regional integration system innovation, featuring an eco-friendly development mode without breaking administrative subordination but beyond administrative boundaries, and thus forming the organic unity of green economy, high-quality life, and sustainable development.
Article 4
The Municipal People's Government shall implement the national policies and decisions relevant to the construction of the Demonstration Zone, increase effort in supporting for such construction, strengthen coordination and cooperation with the people's governments of Jiangsu and Zhejiang Provinces, conduct regular communication therewith to study and resolve major problems in the construction of the Zone, and reinforce such work as reform integration, capital investment, project arrangement, and resource allocation, to guarantee the integrative and high-quality development of the Demonstration Zone.
The municipal development and reform department is responsible for overall planning and coordination of the integrative and high-quality development of the Demonstration Zone.
The people's government of Qingpu District shall implement the work arrangements made by the State and this Municipality regarding construction of the Demonstration Zone, and progress its construction in an orderly manner.
The relevant departments of the Municipality and the people's government of Qingpu District shall, according to their respective responsibilities and duties, ensure successful completion of the construction of the Demonstration Zone.
Article 5
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, through such methods as making overall planning, setting unified standards, jointly constructing platforms, sharing resources, mutually recognizing qualifications, and exchanging data, smooth the flow of production factors, promote cross-regional co-construction and sharing, and accelerate integrative institutional innovation and project construction in the Demonstration Zone.
Article 6
It is encouraged that innovative explorations and trials are firstly made in the Demonstration Zone in important fields and critical phases of the reform and opening-up, to accumulate experiences that can be replicated and popularized and provide a model for the integrative and higher-quality development of the YRD.
The reformation methods specified by the State and this Municipality are encouraged to be firstly tried and implemented in a centralized manner in the Development Zone and to make breakthrough thereof. The demonstrative achievements of pilot reform and innovation implemented in this Municipality are encouraged to be replicated and popularized in the Demonstration Zone.
Article 7
Enterprises, public institutions, social organizations, and other social forces are encouraged to participate in the construction of the Demonstration Zone, and play a role in fields such as scientific and technological innovation, ecological and environmental protection, industrial development, and rural revitalization, in order to promote the formation of a development mechanism with multi-party participation and coordinated advancement.
Article 8
Organizations and individuals that have made significant contributions to the integrative and high-quality development of the Demonstration Zone are to be commended and rewarded according to the relevant provisions of the State and this Municipality.
Chapter II Governance System
Article 9
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, establish a Council of the Demonstration Zone (hereinafter referred to as "the Council") to serve as a decision-making body for important matters concerning the construction of the Demonstration Zone.
The main responsibilities of the Council are to implement and coordinate advancement of the Overall Plan for the YRD Ecological and Green Integrative Development Demonstration Zone, study and determine the development planning, matters to be reformed, supporting policies, and annual work arrangement for the construction of the Demonstration Zone, coordinate cross-regional and cross-departmental important matters, coordinatively advance major projects, establish a mechanism of collaborative supervision, as well as urge and inspect the implementation of relevant work.
Article 10
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, establish an Executive Committee of the Demonstration Zone (hereinafter referred to as "the Executive Committee"). As the executive body of the Council and the administrative body for development and construction of the Zone, the Executive Committee shall perform the following responsibilities:
1. being responsible for the research, formulation, advancement and implementation of the development planning, institutional innovation, matters to be reformed, and the supporting policies of the Demonstration Zone;
2. being responsible for administration of the examination, approval, verification, and record-filing of cross-regional investment projects in the Demonstration Zone unless otherwise provided by the State;
3. jointly with the people’s governments of the Two Districts and One County, exercising the power of examining and approving the detailed national spatial planning (other than village planning) within the Pilot Area in the Demonstration Zone;
4. and performing other responsibilities determined by the State and this Municipality.
The Executive Committee may formulate administrative normative documents within the scope of its responsibilities and powers.
The Executive Committee shall strengthen overall coordination, and, through means such as regular meetings and consultations, and jointly with the relevant departments of Jiangsu Province, Zhejiang Province, and this Municipality, as well as the people's governments of the Two Districts and One County, promote implementation of relevant policies and measures for the construction of the Demonstration Zone.
Article 11
The relevant administrative departments of this Municipality may sign cooperative agreements with the relevant administrative departments of Jiangsu Province and Zhejiang Province concerning such matters as overall planning, standard unification, project cooperation, facility co-building, platform interoperability, and information sharing. The Executive Committee may make suggestions on the signing and the content of such agreements.
Article 12
The relevant administrative departments of this Municipality may establish regional cooperation mechanisms with the relevant administrative departments of Jiangsu Province and Zhejiang Province and, as needed, coordinate collaborative administration of matters concerning the development and construction, ecology and environmental protection, market regulation, urban management, fishery industry and administration, and the like matters in the Demonstration Zone.
Article 13
The Municipal People’s Government and its relevant departments may, in light of the actual progress of the construction of the Demonstration Zone, authorize or delegate the relevant administrative authorities belonging to this Municipality to the Executive Committee in accordance with law.
The Executive Committee may, in light of the actual progress of the construction of the Demonstration Zone, propose the matters that it needs authorization or delegation to do, and report it to the competent departments for determination according to the legal procedures.
Article 14
In the construction of cross-regional projects, where the administrative licensing can be implemented separately by the administrative departments of this Municipality, Jiangsu Province, and Zhejiang Province respectively, this Municipality may, jointly with Jiangsu Province and Zhejiang Province, determine an administrative department to accept applications for such administrative licensing, and jointly implement a centralized processing therefor.
In the construction of cross-regional projects, the administrative departments of this Municipality with administrative licensing power may, within the scope of their statutory responsibilities and powers and in accordance with law, entrust the administrative departments of Jiangsu Province or Zhejiang Province to process the administrative licensing applications.
Article 15
It is encouraged to explore the possibility and establish within the Demonstration Zone a fiscal and tax sharing mechanism for sharing cross-regional investment and benefits, and a common account management mechanism for the Water Town Living Room region, seeking cross-regional overall allocation and use of financial funds.
Article 16
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, establish a statistical system and a cooperation mechanism for the statistical work in the Demonstration Zone.
The Executive Committee shall, jointly with the statistical departments of the people's governments of Jiangsu Province, Zhejiang Province, and this Municipality, focus on the core development indicators such as high-quality, integration, eco-friendliness, and social evaluation, formulate an integrative and high-quality development index system in the Demonstration Zone, and release the development index which reflects the overall development status and trend of the Zone.
Chapter III Planning and Construction
Article 17
The people's government of Qingpu District is responsible for preparing the outline of the national economic and social development plan, which shall reflect the requirements for integrative and high-quality development of the Demonstration Zone, and take advice from the Executive Committee.
Article 18
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, improve the unified national spatial planning system in the Demonstration Zone, coordinate the objectives of the planning, unify the foundation basis, base planning period, planning deadlines, and core indicators, implement a hierarchical and classified management system, and strengthen the cross-regional coordination and integrative connection of the preparation for the planning, the use of the land, and the construction of the projects.
Article 19
The master plan for the national land space in the Demonstration Zone shall be formulated by the Municipal People's Government jointly with the people's governments of Jiangsu and Zhejiang Provinces.
The relevant departments of this Municipality shall, jointly with the relevant departments of Jiangsu and Zhejiang provinces, have the relevant special plan for cross-regional national land space formulated, and submit it for approval and jointly release it in accordance with the relevant provisions.
The detailed plan and the relevant special plan for the national land space of Qingpu District shall conform to the master plan for the national land space in the Demonstration Zone.
Article 20
The master plan for the national land space in the Demonstration Zone is incorporated into the plan of this Municipality on the national land space based on the jurisdiction of the administrative divisions, and a system of dynamic monitoring, regular evaluation, and timely maintenance of the implementation of the plan shall be established to implement a whole-process management system.
The flexible quota on the planned land for construction purposes in the Demonstration Zone is to be coordinately applied by the Executive Committee.
The Executive Committee shall explore the possibility and establish a chief planner system in key areas such as the Water Town Living Room, and provide third-party professional advisory opinions and technical support for formulation of the relevant plan and designing of the construction projects.
Article 21
The demarcated red lines for protection of the permanent basic farmland, the red lines for protection of the ecology, the boundaries for development of the urban resources, and the control lines for protection of culture in the Demonstration Zone shall be strictly implemented, and the use of the national land space in the Demonstration Zone shall be controlled by area and by class.
Article 22
This Municipality shall give priority in guaranteeing the land use quotas for construction projects in the Demonstration Zone, and make overall quota arrangements for the projects in key areas such as the Water Town Living Room, as well as for such planned projects as rail transits, expressways, national roads, waterways, general airports, and major infrastructure projects such as water conservancy, water supply, and drainage.
The municipal department of planning and natural resources shall, according to the outlines of the national economic and social development plans of this Municipality and Qingpu District, as well as the national spatial plan, guide Qingpu District to study and formulate its annual land use plan.
Article 23
This Municipality shall, according to the unified arrangements of the State, steadily promote the entry of the collective-owned land in the Demonstration Zone for commercial construction purposes into the market.
It is encouraged that comprehensive improvement of the land is carried out in the whole Demonstration Zone and, on the basis of the national spatial plan and the relevant special plans, and under the premise of no reduction of the total amount of cultivated land while ensuring quality improvement and structure optimization, the optimization of spatial layout, concentration and connection of the permanent basic farmland, upgrading of the ecological functions, and revitalization of the rural resource factors in the inter-provincial adjacent regions are advanced, so that the revitalization of rural areas and integrative development of urban and rural areas are promoted.
Article 24
The Municipal People's Government, jointly with the people's governments of Jiangsu and Zhejiang Provinces and in accordance with the provisions of the State, formulate a catalogue of enterprise investment projects in the Demonstration Zone subject to approval.
The Executive Committee shall, jointly with the relevant departments of Jiangsu Province, Zhejiang Province and this Municipality, establish a mechanism of supervision connection work for cross-regional investment projects and, relying on the national online examination, approval and supervision platform for investment projects, optimize the services for investment examination and approval, strengthen coordination and joint efforts in such aspects as the examination, approval, filing, land use, environmental impact assessment, flood impact assessment, and soil and water conservation scheme for the investment projects.
Article 25
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, promote infrastructure connectivity in the Demonstration Zone, strengthen the construction of infrastructure such as electric power, water conservancy, gas, water supply and drainage, transportation, and communication networks in the Demonstration Zone, and establish a cross-regional integrative infrastructure network system.
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, promote the construction of public transportation in the Demonstration Zone, improve the layout of rail transit, strengthen the construction of public transportation network between and among cities and towns, and transportation systems with characteristics, and achieve cross-regional connectivity of public transportation lines.
Chapter IV Ecology and Environment
Article 26
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, establish a regional cooperative working mechanism for ecology and environmental standards, promote sharing of monitored data and mutual recognition of the monitored results, formulate unified regulations on enforcement of ecological and environmental laws, and unify ecological and environmental standards, the network of monitoring and control of ecology and environment, and supervision and law enforcement thereof in the Demonstration Zone.
Article 27
The municipal department of ecology and environment shall, jointly with the Executive Committee, promote the application of an area-specific ecological and environmental control system in the Demonstration Zone.
It is encouraged that the relevant pilot reforms relating to such matters as environmental impact assessment, emission permission, and the paid use and trading of emission rights are carried out in the Demonstration Zone in accordance with the provisions of the State.
Article 28
It is encouraged that a united system for naming a chief for each river or lake is implemented in the Demonstration Zone to coordinate and unify the functional objectives of environmental elements, pollution prevention and control mechanisms, and assessment systems of the major water bodies such as Taipu River, Dianshan Lake, Yuandang and Fen Lake, strengthen the co-protection and joint treatment of transboundary water bodies, and promote comprehensive improvement and ecological protection and restoration in their surrounding areas and riverbanks.
Article 29
It is encouraged that a joint mechanism is established in the Demonstration Zone for prevention and control of environmental pollution from solid waste, which coordinates such work as formulation of planning, construction of facilities, and transfer of solid waste, to improve the source reduction and comprehensive utilization of such waste as industrial solid waste, household waste, construction waste, and agricultural solid waste.
Article 30
It is encouraged that a diversified fund investment mechanism is established in the Demonstration Zone for ecological and environmental protection and governance, so as to promote the innovation of green financial products and services.
It is encouraged to establish a mechanism in the Demonstration Zone for realizing the value of ecological products and improving a sustainable path for such value realization, which features the leading role of the government, the participation of enterprises and all sectors of the society, and market-oriented operation, to explore the possibility and advance such work as the ecological products’ value assessment, business development, protective compensation, and supply and demand docking, and build a demonstration base for such value realization mechanism.
Article 31
It is encouraged that coordinated development of a green certification system is promoted in the Demonstration Zone according to the standards for green products and in compliance with the requirements for certification and labeling of green products as prescribed by the State to accelerate the development of the YRD pilot zone for green certification.
Article 32
It is encouraged to actively and steadily advance the work of carbon peak and carbon neutrality in the Demonstration Zone, lead the transformation from the control of the amount and intensity of energy consumption to the control of the amount and intensity of carbon emission, and carry out pilot demonstration of the synergy effect of pollution reduction and carbon reduction, and pilot demonstration of certification of carbon labeling of products. It is also encouraged to build a carbon inclusion system, gradually promoting the joint establishment of carbon inclusion rules, the mutual recognition of standards, the sharing of information, and the mutual recognition of projects.
Article 33
It is encouraged to strengthen the background investigation, monitoring, evaluation, protection and restoration of biodiversity as well as wild animal and plant resources and their habitats in the Demonstration Zone, regulate the proliferation and release thereof, prevent and control the invasion of alien species, and promote the pilot demonstration of regional biodiversity conservation.
It is encouraged to conduct integrative protection and restoration of the ecosystem to improve the quality and stability of the regional ecosystem.
Article 34
It is encouraged that the Demonstration Zone is to become the first to be built as a beautiful and harmonious countryside for people to live and work by focusing on the key fields such as improving rural living environment, reforming the rural land system, establishing a modern rural industrial system, developing new rural collective economy, and enriching rural intellectual and cultural lives.
Chapter V Innovative Development
Article 35
The Executive Committee shall, jointly with the relevant departments of the people's governments of Jiangsu Province, Zhejiang Province and this Municipality, formulate a unified catalogue guiding the industrial development of the Demonstration Zone in accordance with law, focusing on the development of strategic emerging industries and high-end modern service industries such as new-generation information technology, new energy, new materials, high-end equipment, and life and health services.
It is encouraged to transform and upgrade, in the Demonstration Zone, the traditional industries that are in line with the direction of industrial development, and advance high-end, intelligent, and green development of industries.
Article 36
The Executive Committee shall, jointly with the relevant departments of Jiangsu Province, Zhejiang Province and this Municipality, formulate special planning for industrial development of the Demonstration Zone, strengthen communication among the investment promotion platforms within the Zone, improve key industrial chains, guide the rational layout and agglomerated development of industries, and promote the formation of regional industrial clusters featuring win-win cooperation.
Article 37
Higher education institutions, scientific research institutions, enterprises and other innovation entities are supported to deepen the industry-institution-research cooperative mechanism, and promote the deep integration of scientific and technological innovation with industrial innovation in the Demonstration Zone. It is encouraged to focus on key industries and key sectors in the Demonstration Zone, to advance the implementation of joint research projects, make breakthroughs in key technologies, and promote the application of scientific and technological advancements.
This Municipality shall increase support for the innovation by the enterprises in the Demonstration Zone, encourage higher education institutions, scientific research institutions, and enterprises in the Demonstration Zone to apply for the YRD projects for technology breakthroughs, support the Demonstration Zone to build platforms and service networks that efficiently dock scientific and technological advancements with industrial demands, and guide small and medium-sized enterprises, in ways such as through science and technology innovation vouchers, to advance the integrated allocation of science and technology innovation resources through utilizing such services as technology research and development, technology transfer, testing, personnel training, resources opening, and the like services provided in the whole YRD.
Article 38
It is encouraged to establish scientific and technological innovation carriers in the Demonstration Zone to expand the cultivation and construction of knowledge-innovation-type headquarters and bases. It is also encouraged to introduce well-known higher education institutions and scientific research institutions from home and abroad into the Demonstration Zone and encourage the higher education institutions to establish research institutions in the Zone.
Article 39
It is encouraged that Qingpu District, Wujiang District and Jiashan County build cross-regional high-tech industrial development areas in the model of "one-area-multiple-parks", to create a nationally high-tech industrial development area.
Article 40
It is encouraged that a financial information sharing and cooperation mechanism is established in the Demonstration Zone. Financial institutions are encouraged to provide intracity-like facilitation services in the Demonstration Zone and, in accordance with law, carry out cross-regional joint credit granting.
Article 41
It is encouraged that cross-regional joint protection of intellectual property rights and integration of public services are advanced in the Demonstration Zone.
Intellectual property related service institutions are encouraged to provide such services as patent cultivation, infringement monitoring, risk warning, value assessment, and commercialization and transaction of intellectual property for the enterprises in the Demonstration Zone.
Article 42
It is encouraged that a unified industrial talent evaluation system and high-end talent evaluation standards are established in the Demonstration Zone to carry out joint evaluation of professional titles within the Zone.
The relevant departments of this Municipality will, jointly with the relevant departments of Jiangsu Province and Zhejiang Province, establish a mechanism under which the relevant vocational qualifications, professional titles, and continuing education credits are mutually recognized in the Demonstration Zone to smooth the flow of talents.
Article 43
It is encouraged that the YRD node in the national hub of the nationwide unified integrated computing network is built in the Demonstration Zone to accelerate the construction of data center clusters in the Zone, optimize the layout of data centers and storage and computing resources, and promote intensification and service innovation of computing power, data, and application resources.
Chapter VI Jiangnan Water Town Culture
Article 44
It is encouraged that historical and cultural belts, such as the Jiangnan Canal, Taihu Lake-Huangpu River, and Jiaxing-Wusong River, are built up in the Demonstration Zone according to water town clustering feature where towns and water are adjacent to each other, as well as the historical and cultural characteristics of the ancient Wu and Yue Kingdoms, shaping the new Jiangnan water town style, and creating a cultural symbol that reflects the characteristics of the Jiangnan water towns.
The Executive Committee shall, jointly with the people's governments of the Two Districts and One County, establish a regional coordinated operation mechanism for protection of Jiangnan water town culture, and promote such works as the integrative preservation of the Jiangnan water towns in the Demonstration Zone and joint application for world cultural heritage thereof.
Article 45
Organizations and individuals are encouraged and supported to hold traditional opera and music performance activities such as Kunqu opera, Jiashan traditional folk songs, Jiangnan traditional music, Luxu folk songs, engage in business of traditional crafts and characteristic food, research and discover the historical and cultural value of the famous towns and villages and traditional villages, display the unique cultural connotation of Jiangnan water towns, and inherit and protect the Jiangnan water town culture.
Through providing employment guidance, skill training, financial subsidies, and other means in the Demonstration Zone, people are encouraged to live, work or start businesses in the Jiangnan water towns, to display the local traditional cultural and living style such as folk customs, traditional etiquette, and food culture.
Article 46
It is encouraged that literary and artistic works are created, cultural products related to the Jiangnan water town culture are developed and brand-themed promotional activities are jointly designed in the Demonstration Zone, so that the brands of Jiangnan water town culture are cultivated in the Zone.
It is encouraged that activation and utilization of intangible cultural heritage are jointly advanced in the Demonstration Zone to strengthen the inheritance and dissemination of the representative projects of intangible cultural heritage.
The Executive Committee shall work with the people's governments of the Two Districts and One County to promote cultural exchanges and project cooperation with international and domestic cultural heritage protection organizations.
Article 47
It is encouraged that folk custom and culture tourism services are expanded in the Demonstration Zone to promote joint development of cultural leisure and tourism resources of the ancient town clusters, and build an area with cultural and tourism services and consumption and industrial agglomeration, which features the integration of culture, business, tourism, and sports, with distinct regional brands and excellent business environment.
It is encouraged that a mechanism of organizing cross-regional joint competitions are established to hold cross-regional brand competition events, and guide high-level top-class competition brands to settle in the Zone.
Chapter VII Public Services
Article 48
The Executive Committee shall, jointly with the people's governments of the Two Districts and One County, compile and update on a rolling basis a list of public services jointly provided and shared in the Demonstration Zone to advance the joint development and sharing of public services in such fields as health, medical security, education, elderly care, and housing security.
It is encouraged that a cross-regional public data sharing mechanism is built in the Demonstration Zone to improve the efficiency of utilization of the public data resources.
Article 49
It is encouraged to introduce high-quality educational resources into the Demonstration Zone to carry out integrative training of teachers, establish think-tank sharing, curriculum co-development, joint training by famous teachers, and joint brand-development, build an online sharing platform for high-quality educational resources, and jointly build a database of high-quality educational resources.
It is encouraged that the integration of vocational education is promoted and cultivation of inter-provincial vocational personnel is developed in the Demonstration Zone.
It is encouraged that mutual recognition of credits and exchange of teachers in higher education institutions are promoted in the Demonstration Zone to develop high-level and open-type higher education.
Article 50
It is encouraged that integrative medical security is advanced in the Demonstration Zone, and medical bills incurred in different administrative areas within the Zone are directly settled in the Zone without being filed first, to advance the unification of government services for medical security, and implement one-code access to electronic health care certificates.
It is encouraged that coordination of medical institutions is promoted, a cross-regional medical resource sharing mechanism is established and cross-regional medical consortia are formed in the Demonstration Zone, to provide facilitation for the doctors to practice cross-regionally in multiple locations, and advance the interconnection and mutual recognition of imaging data and examination reports.
Article 51
It is encouraged that cooperation in elderly care services is strengthened and a wellness base is built for the aged in the Demonstration Zone to promote settlement of cross-regional elderly care service subsidies and long-term care insurance, and to provide facilitation for the aged to enjoy out-of-residence elderly care.
Article 52
It is encouraged that services in transportation, tourism and sightseeing, cultural experience, social security, medication and health care, and financial services in the Demonstration Zone are provided as intracity services to anyone holding a social security card.
Article 53
It is encouraged that a unified standard for public credit information collection is established in the Demonstration Zone to promote cross-regional sharing of public credit information. Market-oriented credit service institutions are encouraged to participate in the establishment of a public credit system in the Demonstration Zone, develop cross-regional integrated credit products, and expand the application of cross-regional credit services.
Chapter VIII Legal Guarantee
Article 54
The Standing Committee of the Municipal People's Congress, and the Municipal People's Government may, in light of the needs for developing the Demonstration Zone, decide to temporarily modify or stop application in the Demonstration Zone of some provisions of the relevant local rules or government regulations on specific matters.
Where it is necessary to temporarily modify or stop application in the Demonstration Zone of some provisions of the relevant local rules or government regulations for implementing institutional innovation, major reform, or other measures, the Executive Committee may make recommendations to the Standing Committee of the Municipal People's Congress, or the Municipal People's Government.
Article 55
It is encouraged that standardization in the fields of ecology and environment, business environment, public services, engineering and services is promoted in the Demonstration Zone to explore the possibility and establish a coordinative group standard adoption system in the Zone.
Article 56
It is encouraged to explore the possibility of cross-regional mutual recognition and general application of production and operation related licenses and qualifications in the Demonstration Zone by such means as information sharing, business coordination, and simplified examination and approval process.
Article 57
The administrative departments of this Municipality are encouraged to strengthen coordination in administrative law enforcement in the Demonstration Zone with the relevant administrative departments of Jiangsu Province and Zhejiang Province, establish a cross-regional and cross-departmental mechanism for jointly responding to administrative law enforcement as well as collaboration, and improve such work as routinized joint supervision, transfer of evidence discovered, transfer of cases, joint law enforcement, law enforcement assistance, and information sharing.
For the evidential materials investigated and collected in accordance with law by the administrative departments of Wujiang District or Jiashan County, the relevant administrative departments of Qingpu District may use them as evidence in administrative law enforcement if, upon examination and approval, they have the required probative value.
Article 58
This Municipality shall, jointly with Jiangsu Province and Zhejiang Province, explore the possibility and promote the unification of the standards for administrative discretion in the Demonstration Zone, to advance general consistency in the Zone of the results of disposition of matters of the same or similar categories, nature and circumstances.
The people's government of Qingpu District and its relevant departments may, according to the needs for integrative and high-quality development of the Demonstration Zone, reasonably refine and quantify, within the scope of law, the conditions, types, ranges, and time limits of the standards of relevant administrative discretion.
Article 59
Qingpu District People's Government shall strengthen coordination in emergency management with the people's governments of Wujiang District and Jiashan County, establish a cross-regional emergency coordination and joint effort mechanism for natural disasters, accidents and disasters, public health incidents, social security incidents, and other emergencies, and ensure successful completion of such work as risk prevention, emergency preparedness, and emergency response.
Article 60
The public security departments of Qingpu District shall, jointly with the public security departments of Wujiang District and Jiashan County, establish a working mechanism of cross-regional joint emergency handling and rapid response for major 110 police phone answering and handling of emergencies, and practice early presence at the scene and coordinated disposition thereof.
Article 61
The municipal department of human resources and social security shall, jointly with the human resources and social security departments of Jiangsu Province and Zhejiang Province, establish a mechanism for joint mediation and coordinated arbitration of labor disputes in the Demonstration Zone, and unify the regional standards for coordinated settlement of labor disputes through mediation or arbitration.
Article 62
It is encouraged that a judicial cooperation mechanism is innovated in the Demonstration Zone, and cross-regional cooperation in such aspects as litigation services, investigation and evidence collection, compliance of the involved enterprises, preservation of assets pending litigation, joint efforts of law enforcement, document service, information sharing, and exchange of experiences in trials is strengthened.
Article 63
It is encouraged that legal service cooperation of the profession of lawyers, notarization, forensic assessment, mediation, arbitration, legal aids, and the like, is promoted in the Demonstration Zone to meet the demand for integrative and high-quality development of legal services in the Zone.
Chapter IX Supplementary Provisions
Article 64
The Pilot Area of the Demonstration Zone covers Jinze Town and Zhujiajiao Town of Qingpu District, Lili Town of Wujiang District, Xitang Town and Yaozhuang Town of Jiashan County.
The Water Town Living Room covers Jinze Town of Qingpu District, Lili Town of Wujiang District, part of Xitang Town and Yaozhuang Town of Jiashan County, reaching Shanghai — Chongqing Expressway in the north, Dingtao Highway-Niukou Road in the south, Fen Lake Avenue in the west, and Jinshang Highway in the east.
Article 65
In the Coordination Area of the Demonstration Zone (the main area of Hongqiao International Central Business District, excluding the area that belongs to Qingpu District) within the administrative area of this Municipality, these Regulations shall apply mutatis mutandis to the relevant activities to promote the high-quality integrative and green development of the YRD.
Article 66
These Regulations shall be effective as of May 1, 2024. The Decision of the Standing Committee of Shanghai Municipal People’s Congress on Several Issues Concerning Promoting and Ensuring the Construction of the Yangtze River Delta Ecological and Green Integrative Development Demonstration Zone shall be repealed simultaneously.
