Regulations of Shanghai Municipality on the Guarantee of Grain Security

Chapter I General Provisions
Article 1
With a view to guaranteeing effective grain supply, ensuring grain security of this Municipality, enhancing the capacity to prevent and withstand grain security risks, promoting high-quality development in grain industry and maintaining economic and social stability, these Regulations are formulated according to the Grain Security Guarantee Law of the People's Republic of China and Regulation on the Administration of Grain Circulation and other relevant laws and administrative rules, and in the light of the actual circumstances of this Municipality.
Article 2
These Regulations shall apply to grain production, reserve, circulation, processing, emergency response, conservation, and related supervision and management within the administrative region of this Municipality.
Article 3
This Municipality's grain security guarantee work shall adhere to the leadership of the Communist Party of China, implement the holistic approach to national security, balance development and security, execute the national grain security strategy, coordinate the utilization of both international and domestic grain markets and resources, insist on the food crop production strategy based on farmland management and application of technology, enhance capabilities in grain production, reserve, circulation, processing, and emergency response to consolidate the foundations of grain security in all respects.
In ensuring grain security, this Municipality shall adopt a comprehensive approach to food, leverage the advantages of agricultural scientific and technological innovation, develop urban modern agriculture, expand grain production space, establish a diversified food supply system, and develop food resources in an all-around and multi-channel way to meet the public's consumption demand for food that is in rich variety, of high quality, abundant in nutrition and good for health.
Article 4
This Municipality shall establish a responsibility system for grain security, ensuring that both Party committees and governments assume their responsibilities for grain security. It shall establish a working mechanism to strengthen organizational leadership over grain security guarantee work and coordinate to resolve major issues in the grain security guarantee work.
The municipal and district people's governments shall assume the specific responsibility for grain security guarantee in their respective administrative regions. The town/township people's governments and the sub-district offices shall conduct relevant grain security guarantee work in the areas within their jurisdictions in accordance with their duties.
Article 5
The department of food and strategic reserves shall, in accordance with its duties, be responsible for the guidance, supervision and management of grain storage, circulation, processing, emergency response and other fields.
The department of agriculture and rural affairs shall be responsible for the guidance, supervision and management of grain production.
The departments of development and reform, finance, planning and resources, market regulation, commerce, state-owned assets, housing and urban-rural development, housing management, emergency response, economy and information technology, science and technology, transport, education, ecology and environment, water affairs shall, in accordance with their respective responsibilities, collaborate and coordinate to perform the work related to grain security guarantee in accordance with the law.
Article 6
The municipal and district people's governments shall incorporate grain security guarantee into their national economic and social development plans. The departments of development and reform, food and strategic reserves shall, in conjunction with the departments of agriculture and rural affairs, finance and other relevant departments, in accordance with the actual circumstances including objectives and tasks of grain security guarantee, organize to formulate special plans related to grain security guarantee and implement them upon approval in accordance with prescribed procedures.
The departments of food and strategic reserves, planning and resources and development and reform shall, in accordance with the scale and regional distribution of grain storage in respective administrative regions, organize to formulate special plans of the territorial space for grain storage, logistics, processing and other grain circulation infrastructure and implement them upon approval in accordance with prescribed procedures.
Article 7
This Municipality shall establish and improve the funding mechanism for grain security guarantee, adopt fiscal, financial and other supporting policies to strengthen grain security guarantee, improve the coordination and guarantee mechanism for grain production, purchase, storage, transportation, processing and sale to enhance the capacity for grain security guarantee.
This Municipality shall guide social capital to invest in grain production, storage, circulation, processing and other fields, and protect their legitimate rights and interests in accordance with the law.
This Municipality shall guide financial institutions to reasonably introduce financial products and services to support grain production, reserve, circulation and processing. This Municipality shall implement the policy-based agricultural insurance system and encourage the development of commercial insurance operations.
Article 8
Operators engaging in grain production, purchase, storage, transportation, processing and sale shall comply with relevant laws, rules, and regulations, assume primary responsibility for grain quality safety and fulfill the requirements for grain quality safety.
Article 9
This Municipality shall strengthen grain security publicity and education. The departments of food and strategic reserves, agriculture and rural affairs, education and others shall organize concentrated publicity and education on grain security by relying on World Food Day, the Chinese Farmers' Harvest Festival, and the National Food Security Publicity Week to enhance social consciousness of grain security and guide the formation of the good social norm of cherishing and conserving grain.
This Municipality shall support the adaptive reuse of historical grain storage facilities, establish grain security education bases that showcase the evolution of grain development and promote the publicity of grain security knowledge and grain culture.
Article 10
This Municipality shall leverage the critical role of farms outside Shanghai city as important grain supply bases, expand scaled production, optimize the structure of crop varieties, develop modern seed industries, smart agriculture and green agriculture, establish modernized farm operations, support the infrastructure construction of farms outside Shanghai city, form an integrated supply system with production, processing, storage and logistics to enhance the capacity of stable production and supply.
The municipal department of agriculture and rural affairs shall, in conjunction with the municipal departments of development and reform, food and strategic reserves and others, enhance the collaboration with relevant departments in the regions where farms outside Shanghai city are located to support the coordinated construction of grain-related green bases, cross-regional processing cooperation, coordinated utilization of storage facilities, marketing channel sharing and joint development between farms outside Shanghai city and local business entities, and thereby improve the supply level of high-quality grain.
Article 11
This Municipality shall enhance the coordination with relevant provinces and cities in the Yangtze River Delta region on the integrated grain security guarantee work and carry out collaboration and communication production and marketing partnerships, regulatory enforcement, emergency supply guarantees and talent development to improve comprehensive regional grain security capability.
The department of food and strategic reserves shall promote the production and marketing collaboration with major grain producing regions and support grain operators in establishing stable grain supply bases in these regions to expand supply channels.
This Municipality shall expand international cooperation and exchange channels for grain security and strengthen international grain trades and grain security collaborations.
Article 12
Units and individuals that make outstanding contributions to grain security guarantee work shall be commended and rewarded in accordance with relevant state and municipal provisions.
Chapter II Grain Production
Article 13
This Municipality shall, in accordance with state requirements, implement the system of the protection of cultivated land and permanent basic farmland. The municipal and district people's governments shall, in accordance with the objectives and tasks of ensuring the supply of grain and important agricultural products, strengthen the control over the use of cultivated land for planting. Cultivated land shall mainly be used for the production of grain, cotton, oil, sugar, vegetables, and other agricultural products, as well as forage and feed, and permanent basic farmland shall be primarily used for the production of grain.
This Municipality shall implement a strict system for the protection of cultivated land quality, strengthen the construction of high-standard farmland, improve the diversified funding guarantee mechanism, and gradually develop all permanent basic farmland with the necessary conditions into high-standard farmland.
Article 14
Rural collective economic organizations shall, in accordance with the law, contract out cultivated land and supervise the contractor in the rational utilization and protection of such cultivated land as stipulated in the contract. Where the contractor lawfully transfers the land management right, the transferee shall abide by the terms of land management right transfer contract and protect the cultivated land in accordance with the law.
The agriculture and rural affairs department shall strengthen daily supervision over the control of cultivated land use purposes through on-site inspections, remote sensing image monitoring, and other methods. Where village committees or rural collective economic organizations discover acts that contravene the requirements for such control, they shall promptly report to the town/township people's government or the district department of agriculture and rural affairs concerned.
Article 15
The municipal and district people's governments shall promote the improvement and comprehensive utilization of saline-alkali land in light of local conditions and take measures including irrigation and drainage for salt leaching, organic matter enhancement, agronomic improvement, and biochemical remediation to exploit the agricultural production potential of saline-alkali land and improve both ecological utilization value and grain production capacity.
Article 16
This Municipality shall support the development of grain crop seed industry by strengthening the collection, conservation and utilization of germplasm resources, advancing basic research, breeding, production, renewal and promotion of high-quality, high-yield grain crop varieties, establishing demonstration bases for scientific research experiments, production and publicity, and achievement exhibition of grain crop seeds, and establishing and improving a disaster-relief grain crop seed reserve system to enhance seed supply guarantee capability.
The department of agriculture and rural affairs shall provide quality seed information services to guide grain producers in planting high-quality, high-yielding grain varieties, thereby increasing per-unit yield and production efficiency.
Article 17
This Municipality shall support the use of green, smart and efficient agricultural machinery, promote the application of intelligent agricultural equipment, advance the integration of agricultural machinery with agronomic practices and mechanization with informatization, and promote mechanization throughout the whole grain production process to enhance the efficiency of grain production.
The department of agriculture and rural affairs shall, in conjunction with the departments of economy and information technology, science and technology and other relevant departments, promote smart agriculture development and improve information-based services including agricultural machinery operation monitoring, maintenance diagnostics and remote dispatching.
Article 18
The municipal and district people's governments shall strengthen disaster prevention, mitigation and relief capabilities in grain production by improving information sharing among departments of agriculture and rural affairs, food and strategic reserves, meteorology, water affairs and emergency response, as well as enhancing scientific research support for disaster prevention, mitigation and relief. This Municipality shall encourage and support green prevention control, and unified prevention and governance of grain crop diseases and pests. The department of agriculture and rural affairs shall organize the monitoring and early warning of such diseases and pests and strengthen their prevention and control.
Article 19
This Municipality shall take measures to stabilize grain planting acreage, rationally distribute grain production, and maintain and improve grain self-sufficiency rate.
The Municipality shall enhance income protection mechanisms for grain producers and optimize fiscal and other supportive policies to sustain production incentives.
The municipal and relevant district people's governments shall allocate budgetary funds in support of grain production.
Chapter III Grain Reserves
Article 20
This Municipality shall establish a government grain reserve system primarily consisting of municipal-level reserves, supplemented by district-level reserves and implement a hierarchical responsibility system with categorized reserves. Government grain reserves shall be utilized to regulate grain supply and demand, stabilize the grain market, and respond to emergencies.
The total scale of government grain reserves in this Municipality shall be determined and dynamically adjusted in accordance with the total scale determined by the State Council.
The municipal department of development and reform and food and strategic reserves shall, in conjunction with the municipal departments of finance and planning and resources, allocate the total scale of government grain reserves in this Municipality in accordance with relevant provisions of the State Council, and formulate plans for the reserve variety structure and regional distribution, and implement them upon approval by the Municipal People's Government.
Article 21
Municipal-level government grain reserves shall be stored primarily within the administrative region of this Municipality. Provided that grain security and regulatory requirements are met, and factors such as grain sourcing, storage facilities, processing capacity, and logistics conditions are taken into consideration, a certain quantity of reserves may be stored in place outside the administrative region of this Municipality, provided that the amount of such off-site reserves does not exceed the limits set by the State.
District-level government grain reserves shall be stored within their respective administrative regions. In special circumstances requiring temporary cross-district storage within this Municipality for reasons of increases of reserve quantity, construction and innovation of storage facility, etc., the district department of food and strategic reserves shall report in advance to the municipal department of food and strategic reserves.
Article 22
Enterprises or other organizations undertaking storage of government grain reserves shall separate reserve operations from commercial business activities in accordance with state provisions.
Enterprises undertaking storage of municipal-level government grain reserves shall divest their commercial business operations.
Enterprises or other organizations undertaking storage of district-level government grain reserves shall establish rigorous risk isolation systems to ensure the separation of personnel, physical assets, finances, and accounting between reserve and commercial operations.
Article 23
Enterprises or other organizations undertaking storage of government grain reserves shall comply with laws, rules, regulations, and relevant state and municipal provisions, and ensure the true quantity, good quality and secure storage of grains.
Enterprises or other organizations undertaking storage of government grain reserves shall, in accordance with state and municipal provisions, promptly, completely, and accurately record all information generated during the entire reserve process, enabling the real-time collection, processing, transmission, and sharing of government grain reserve data to ensure whole-process query and traceability.
Enterprises or other organizations undertaking storage of government grain reserves shall implement quality safety inspection and monitoring systems for reserve grains in accordance with state and municipal provisions, guaranteeing the quality of reserve grains compliance with the prescribed safety standards and meeting specified quality grades. Grains failing to satisfy the requirements shall not be put into storage. Where grains are found unsuitable for storage during the period of storage, they shall be promptly rotated out through replacement measures. Grains failing to meet food safety standards shall not be sold or released for consumption purposes. Those that do not meet the safety standards for feed shall not be sold as feed or feed raw materials for releasing.
Article 24
The scale of this Municipality's processed grain reserves shall comply with the requirements prescribed by the State. District-level government grain reserves shall prioritize fulfilling processed grain reserve requirements as prescribed by the State. Enterprises or organizations undertaking storage of government grain reserves shall be encouraged to increase their proportion of small-packaged processed grain reserves.
Rotated processed grain reserves shall be processed from newly harvested grain of the current year. Before new harvests are available, reserves may be processed from the new grain of the previous year.
Article 25
Government grain reserves shall undergo balanced rotation to ensure optimal grain quality. The department of food and strategic reserves shall, in conjunction with the department of finance, to formulate annual rotation plans based on grain characteristics, storage quality indicators, and storage duration.
Enterprises or organizations undertaking storage of government grain reserves shall consider grain macro-control requirements and market supply and demand situation to specifically organize the implementation of rotation according to annual rotation plans.
Government grain reserve rotation shall be conducted through public bidding on grain trading platforms, unless otherwise specified by state provisions on the way of rotating government grain reserves.
Article 26
The municipal and district people's governments shall, in light of actual conditions of their respective administrative regions, guide grain processing enterprises above designated scale to establish corporate social responsibility reserves.
Enterprises undertaking social responsibility reserves shall ensure that the quantity, variety, and quality safety of their reserve grains meet requirements and shall comply with government regulation in accordance with the law.
This Municipality shall encourage major grain producers, family farms, specialized farmer cooperatives, and leading agricultural industrialization enterprises to construct storage facilities for independent grain storage and encourage qualified business entities to provide commissioned grain storage services for farmers.
Chapter IV Grain Circulation
Article 27
The municipal and district people's governments shall implement state grain macro-control policies, strengthen grain circulation management, and standardize grain circulation order.
Article 28
The municipal and district people's governments shall enhance the construction and protection of grain circulation infrastructure including storage, logistics, and processing facilities and others, and shall organize the construction of grain circulation infrastructure that matches the scale of grain storage and the requirements for ensuring supply within their administrative regions and has a reasonable layout and complete and comprehensive functions.
No unit or individual may encroach upon, damage, unauthorizedly dismantle or relocate the grain circulation infrastructure constructed with government investment or alter the designated purpose of such grain circulation infrastructure without authorization.
Article 29
When performing duties such as formulating territorial space planning or determining land and housing expropriation boundaries, the departments of planning and resources, housing and urban-rural development, housing management and other relevant departments shall solicit opinions from the municipal department of food and strategic reserves, if such actions involve grain circulation infrastructure constructed with government investment or other grain circulation infrastructure with policy-oriented functions. The municipal department of food and strategic reserves shall provide relevant facility information to these departments in advance.
Where demolition, relocation, or re-purposing of grain circulation infrastructure is genuinely required for urban construction or the optimization and adjustment to the grain circulation pattern, functional replacement or reconstruction of such infrastructure shall be conducted in accordance with laws, rules and regulations to ensure that the total quantity, layout, and structure of such infrastructure meet grain security requirements.
Article 30
Grain purchasers shall inform the sellers, or publish at the place of purchase, of the varieties, quality standards, and prices of the grains to be purchased, and shall price grains according to quality, make timely payments and not harm the interests of farmers and other grain producers.
Grain purchasers shall not manipulate prices through fraud or hoarding or accept the entrustment of any organization or individual to withhold any tax, fee or other fund.
The departments of food and strategic reserves, agriculture and rural affairs, market regulation, and transport, along with the town/township people's government and the sub-district office shall collaboratively guarantee the production-purchase connection and relevant services and shall maintain market order in the grain purchase market.
To ensure market supply and protect the interests of grain producers, the municipal departments of food and strategic reserves and agriculture and rural affairs may, upon the approval of the Municipal People's Government and in coordination with the municipal department of finance, implement policy-directed purchase and storage operations for key grain varieties when necessary.
Article 31
For grain transportation, national technical standards for grain transportation shall be strictly complied with. Contaminated transportation vehicles or packaging materials shall not be used for the transportation of grain, and grain shall not be transported together with toxic and hazardous substances. The use of informatized measures, such as in-transit grain quality safety monitoring technologies, is encouraged to ensure grain quality safety during transportation.
Article 32
Operators engaged in grain procurement, storage, transportation, or policy-related grain trading shall establish grain quality safety records, accurately documenting quality grades, condition indicators, chemical uses and other relevant quality safety information. Such records shall be retained for no less than three years. The department of food and strategic reserves shall strengthen operational guidance for relevant operators.
Article 33
Where operators engaged in grain production, procurement, storage, transportation, processing, or sale discover contaminated grains, they shall immediately take measures to prevent the expansion of contamination, and promptly report to relevant authorities.
The department of food and strategic reserves shall, in conjunction with the departments of market regulation and agriculture and rural affairs, formulate contaminated grain disposal plans, and take measures including designated-point procurement, acceptance inspection, segregated storage, directional sales, classified utilization and others to prevent contaminated grains from entering staple food markets or being used for food processing.
Article 34
This Municipality shall establish and improve a grain risk fund system. The grain risk funds shall be mainly used for supporting the grain reserves and stabilizing the grain market. The specific measures shall be formulated by the municipal department of finance in conjunction with other relevant departments.
Chapter V Grain Industry
Article 35
This Municipality shall promote the optimization and upgrading of the grain industry structure, cultivate a supply system of green and high-quality grain products, publicize comprehensive utilization technologies for grain by-products, and establish a circular economic industrial chain for grain.
This Municipality shall encourage grain operators to cooperate with various entities along the industrial chain's upstream and downstream sectors to jointly tackle technological bottlenecks, develop markets, achieve complementary advantages and synergistic development, thereby enhancing the market competitiveness of grain operators.
Article 36
This Municipality shall leverage its location advantages, coordinate and integrate transportation infrastructure of road, rail, waterway and others, give full play to the roles of major grain logistics hubs, demonstration parks, and suburban mega-warehouse bases to build an highly efficient and convenient modern grain logistics system.
This Municipality shall support effective connection between suburban mega-warehouse bases and grain operators, logistics enterprises, and other business entities to promote the integrated development of modern logistics and grain circulation.
This Municipality shall promote the effective linkage of grain logistics distribution, retail outlets, community delivery and other links to optimize last-mile distribution services.
Article 37
This Municipality shall guide grain operators in innovating business service models by way of developing experiential consumption, customized services, etc. to broaden sales channels.
This Municipality shall encourage grain operators to adopt methods of designated direct sales and designated distribution to supply schools, medical institutions, elderly care institutions and other institutions with high quality and fresh grain.
Article 38
This Municipality shall encourage and guide the optimization of grain processing structures, promote appropriate processing and comprehensive utilization of grain, support grain processing operators in carrying out technological upgrades, publicize and apply innovative grain processing technologies, techniques, and equipment, and enhance the supply of high quality and nutritious grain products.
Article 39
This Municipality shall strengthen the capacity building for scientific and technological innovation in the grain sector by supporting fundamental research, key technology development, and process improvement in the grain field. It shall improve the cultivation, evaluation and incentives mechanisms for professionals in the grain industry to cultivate innovative grain business operators, and promote the transfer and commercialization of scientific and technological achievements and the promotion and application of advanced technologies and equipment to enhance technological support and application capabilities of grain science and technology.
This Municipality shall enhance support for scientific research and technological innovation in key areas such as grain storage, nutrition and health, grain processing, and quality safety, and give full play to the role of grain industry technology innovation centers and key laboratories to promote the applications of advanced technologies including information technology, biotechnology, low-carbon solutions, etc. in the grain industry, facilitate the connection of research institutions and scientific talents with markets and enterprises, and advance the industrialization of grain science and technology achievements.
Article 40
This Municipality shall improve the socialized service system for agriculture by guiding agricultural socialized service organizations to provide grain producers and operators with whole-chain professional services covering pre-production, production, and post-production stages, including production technology promotion, pest monitoring and control, agricultural machinery operation and maintenance, unified procurement of agricultural inputs, primary grain processing, drying and storage, and production-marketing linkage. The department of agriculture and rural affairs shall be responsible for coordinating and organizing the development of the agricultural socialized service system.
Article 41
This Municipality shall strengthen the protection of geographical indications and exclusive trademark rights for grain products, guide grain operators to enhance brand operation capabilities by leveraging regional culture heritage, traditional resources, and industrial advantages, and develop grain brands with strong market competitiveness, high social reputation, and superior quality and economic returns.
This Municipality shall, in accordance with the law, formulate and improve local standards related to grain, guide relevant grain and food associations to develop group standards that meet market and innovation needs with local characteristics, and support grain operators in formulating enterprise standards with technical requirements exceeding those of the state and industry standards.
Chapter VI Grain Emergency Response
Article 42
The Municipality shall implement a grain emergency management system featuring unified leadership, hierarchical responsibility and territorial management.
The municipal and district people's governments shall strengthen the development of the grain emergency response system by improving the grain storage, transportation, processing and supply networks featuring reasonable layout and efficient and coordinated operation, safeguard the security of grain circulation infrastructure and enhance the resilience of the grain supply system. If necessary, an emergency grain transportation mechanism shall be established to ensure that the grain emergency response capabilities meet actual needs, and emergency drills and training shall also be carried out on a regular basis.
Article 43
The municipal people's government shall organize the formulation of municipal grain emergency response plans, specifying the organizational command system, departmental responsibilities, monitoring and early warning mechanisms, disposal procedures and emergency guarantee measures. The district people's government shall formulate district grain emergency response plans based on the municipal grain emergency response plans and actual local conditions.
Article 44
The department of food and strategic reserves shall, in conjunction with the department of development and reform and other relevant departments, promote the establishment of grain emergency guarantee centers by integrating the functions of grain storage, processing, distribution, supply and other related operators, so as to enhance the grain emergency response efficiency within the administrative region.
The departments of transport and food and strategic reserves shall strengthen the development of grain emergency transportation capacity by scientifically planning transport routes and operations based on the distribution of grain reserves, processing facilities, and supply networks. This Municipality shall leverage social forces in emergency transport support by establishing green channels for grain emergency transportation and improving the capabilities of last-mile emergency logistics.
The departments of food and strategic reserves, economy and informatization and other departments shall scientifically distribute grain processing facilities to ensure processing capacity meets the actual grain demand during emergency. This Municipality shall support enterprises or organizations undertaking government grain reserves with appropriate conditions in equipping themselves with emergency processing facilities and equipment so as to enhance emergency grain supply capacity and encourage the development of grain processing near grain reserves, logistics parks, and wholesale markets to facilitate local conversion of raw grain into processed grain.
Article 45
The department of development and reform and food and strategic reserves shall, in conjunction with relevant departments, improve the grain security monitoring and early warning system to strengthen the monitoring and analysis of market dynamics, including grain production, demand, inventories, and prices.
This Municipality shall implement a reporting system for abnormal fluctuations in the grain market. In the event of an emergency that causes abnormal fluctuations in grain market supply-demand relations and prices, the departments of development and reform, agriculture and rural affairs, food and strategic reserves, market regulation and other departments shall take measures in accordance with the law to regulate the grain market and promptly report relevant situations to the people's governments at the same level and the competent departments of the people's governments at next higher levels.
Article 46
The municipal and district people's government confirming the occurrence of a grain emergency in accordance with their authority shall promptly launch an emergency response and may take the following emergency response measures in accordance with the law:
1. releasing grain market information and organizing the release of reserve grain to regulate the grain market;
2. establishing additional emergency supply outlets;
3. organizing the processing, transport, and supply of grain;
4. requisitioning grain, storage facilities, sites, means of transportation, and other materials for ensuring grain supply; and
5. other necessary response measures.
When a grain emergency occurs, the relevant units and individuals shall obey the unified command and dispatch of the municipal and district people's governments, cooperate in taking emergency response measures, and assist in maintaining the grain market order.
Article 47
Where losses are caused to relevant units or individuals due to the implementation of grain emergency response measures, the municipal and district people's governments shall, in accordance with relevant provisions, make fair and reasonable compensation.
Article 48
After the elimination of the grain emergency status, the municipal and district people's government shall promptly terminate the implementation of emergency response measures and restore the ability to respond to the grain emergency status.
The municipal and district people's governments shall conduct evaluations of emergency response effectiveness and improve grain emergency response plans based on evaluation results.
Chapter VII Grain Conservation
Article 49
This Municipality shall rigorously promote conservation and oppose waste, and promote the grain conservation in grain production, reserves, circulation, processing, consumption and other links.
The municipal and district people's governments shall establish and improve mechanisms combining guidance incentives with disciplinary education to strengthen leadership and supervision of the grain conservation work. The departments of development and reform, agriculture and rural affairs, food and strategic reserves, market regulation, transport, economy and informatization, commerce, and government offices administration shall perform their respective duties in the grain conservation work.
Article 50
This Municipality shall encourage grain producers to adopt technologies such as centralized seedling cultivation and precision seeding to conserve seed grain, utilize high-efficiency, low-loss harvesting equipment, and improve agricultural machinery operation methods to reduce grain loss and waste.
Article 51
The department of food and strategic reserves shall, in conjunction with relevant departments, take measures to advance the construction of smart grain reserves and the modernization of grain storage infrastructure, and to urge grain storage operators to adopt refined and intelligent management practices, and promote the application of green storage technologies, such as temperature control, controlled atmosphere storage, and biological prevention and control, thereby improving storage quality and efficiency and reducing losses and wastage in grain storage.
Article 52
This Municipality shall encourage grain transport enterprises to optimize transportation methods, promote the coordinated development of bulk grain transport, containerized transport, and multi-modal transport, and improve loading/unloading efficiency to reduce transportation losses and waste.
This Municipality shall guide grain processing operators to apply appropriate processing technologies, develop whole-grain food production, and improve finished grain products yield as well as the comprehensive utilization rate of grain by-products
Article 53
Catering service operators shall establish and improve management systems, service procedures, and operating standards for all stages covering ingredient procurement, storage management, food processing, and dining services, and shall formulate and implement anti-waste measures.
Units with canteens shall establish and improve canteen dining management systems, post or display anti-waste signs at conspicuous positions, and guide diners to order and take appropriate portions; those who engage in food waste shall be promptly reminded and corrected.
Article 54
Individuals and households shall cultivate civilized, healthy, rational, and green consumption concepts, enhance awareness of grain conservation, and develop healthy and economical grain consumption habits.
Article 55
Government organs, enterprises, public institutions, and social organizations shall strengthen publicity, education, and scientific popularization of grain conservation by carrying out publicity and mobilization, experience promotion activities, and civilized practice programs to enhance public consciousness of grain conservation.
Schools shall, through study and practice, hands-on labor, volunteer service, and other forms, guide students to develop sound habits of valuing grain, practicing thrift, and eliminating waste.
The news media shall conduct public interest campaigns and public opinion oversight on grain conservation, report on experiences and exemplary models in combating grain waste to guide the public to establish a correct consumption concept.
Chapter VIII Supervision and Management
Article 56
The departments of development and reform, agriculture and rural affairs, food and strategic reserves, planning and resources, water affairs, ecology and environment, market regulation, economy and information technology, commerce, and other relevant departments shall, according to their duties, supervise and inspect grain production, reserves, circulation and processing, establish a grain security supervision and coordination mechanism and an information sharing mechanism to strengthen coordination and cooperation.
Article 57
The department of food and strategic reserves shall, by means of the grain information management platform, exercise whole-process supervision of the varieties, quantities, quality, and storage conditions of government grain reserves, and promptly identify, warn against, and address security risks in grain reserves to ensure the safety of government grain reserves.
Article 58
The municipal and district people's governments shall conduct regular supervision and inspection on the implementation of their responsibilities for protection of cultivated land and grain security in their respective administrative regions, and incorporate the implementation of such responsibilities into the assessment and evaluation of the persons in charge of the relevant departments of the people's governments at the same level and the people's governments at lower levels and their responsible persons.
The Municipal People's Government may, in light of actual circumstances, increase the weight of grain security indicators in the comprehensive socioeconomic development assessment of grain producing areas.
The assessment of the performance of the cultivated land protection and grain security responsibility system shall be carried out in accordance with the relevant provisions of the State and this Municipality.
Article 59
Where the implementation of responsibilities for cultivated land protection and grain security is ineffective, or the problems in cultivated land protection and grain security are prominent, the higher-level people's government may summon the primary responsible person of the lower-level people's government for an accountability interview. The lower-level people's government that has been subjected to the accountability interview shall immediately take measures to carry out rectification.
Where enterprises or other organizations engaged in government grain reserves or enterprises that assume social responsibility reserves fail to perform their reserve duties strictly, the department of food and strategic reserves may summon their primary responsible person for an accountability interview.
Article 60
The municipal and district people's governments shall include government grain reserve status in their annual state-owned asset reports and submit them to the standing committees of people's congresses at corresponding levels.
The standing committees of the municipal and district people's congresses shall strengthen supervision of grain security work within their jurisdictions by listening to and deliberating special work reports and conducting law enforcement inspections.
The standing committees of the municipal and district people's congresses shall give full play to the role of deputies to the People's Congress, organize deputies to carry out special investigation, inspections, and other activities concerning grain security work, collect and reflect the opinions and suggestions of the public, and supervise the relevant departments and units in fulfilling their responsibilities for grain security.
Chapter IX Legal Liability
Article 61
For acts in violation of the provisions of these Regulations, if the laws and administrative rules have provided for the handling, such provisions shall prevail.
Article 62
Where municipal or district people's governments or their relevant departments fail to perform grain security guarantee duties or commit any other acts of abuse of authority, negligence of duty, or malpractice for personal gain in violation of the provisions of these Regulations, the responsible leaders and directly responsible personnel shall be subject to disciplinary sanctions in accordance with the law.
Article 63
Where any operators engaged in grain procurement, storage, transportation, or policy-directed grain trading, in violation of Article 32 of these Regulations, fail to establish or maintain grain quality safety records as required, the department of food and strategic reserves shall order corrections and issue a warning; where the circumstances are serious, a fine of not more than RMB 200,000 may concurrently be imposed.
Chapter X Supplementary Provisions
Article 64
The security guarantee for oil and edible vegetable oil shall be governed by reference to these Regulations.
Article 65
These Regulations shall be effective as of September 1, 2025.
