Several Provisions of Shanghai Municipality on Fire Safety Administration of Workshops and Warehouses
(Promulgated by Decree No. 25 of Shanghai Municipal People's Government on December 29, 2025; effective from March 1, 2026)
Article 1 (Purpose and Basis)
With a view to strengthening the fire safety administration of workshops and warehouses within this Municipality, implementing fire safety responsibilities, preventing fires and reducing fire hazards, and protecting personal and property safety, these Provisions are formulated in accordance with the Fire Protection Law of the People's Republic of China, the Regulations of Shanghai Municipality on Fire Protection, and other relevant laws and regulations, and in light of the actual circumstances of this Municipality.
Article 2 (Scope of Application)
These Provisions shall apply to fire safety and its supervisory and management activities concerning workshops and warehouses within the administrative area of this Municipality.
The term workshops as used in these Provisions refers to industrial buildings used for production and business operation activities.
The term warehouses as used in these Provisions refers to industrial buildings used for storing goods.
Workshops and warehouses are classified into five categories: Class A, B, C, D, and E, based on fire hazard classification for production and storage buildings as defined by the Code for Fire Protection Design of Buildings.
Where the State has other provisions on fire safety and its supervision and management of workshops and warehouses, such provisions shall prevail.
Article 3 (Government Responsibilities)
District people's governments shall strengthen the leadership over fire protection work within their jurisdictions, and coordinate the important matters concerning fire safety management in workshops and warehouses.
Town/township people's governments, sub-district offices, and dispatched agencies of people's governments at various levels such as development zone management agencies and industrial park management agencies shall, according to their responsibilities, organize fire safety inspections of workshops and warehouses, and assist in the investigation and rectification of fire safety hazards.
Article 4 (Departmental Responsibilities)
Fire and rescue departments shall be responsible for the supervision and management of fire safety work in workshops and warehouses, and shall lawfully organize activities such as fire safety inspections, special fire safety rectification, fire prevention publicity and education, and investigation and handling of fire accident.
Emergency management departments shall be responsible for the supervision and management of the implementation of production safety responsibilities, safety risk graded control, and the establishment of mechanisms for investigating and rectifying potential hazards in industrial, trade, and hazardous chemical enterprises involving workshops and warehouses, in accordance with the law.
Housing and urban-rural development management departments shall be responsible for conducting fire protection design review, fire protection acceptance, filing and spot checks for construction projects involving newly built, renovated, and expanded workshops and warehouses, and shall carry out supervision and management in accordance with the law.
Departments of planning and resources, public security, market regulation, urban management and law enforcement, ecology and environment, economy and informatization, transportation, State-owned assets, postal management, data, among others, shall, according to their respective duties and responsibilities, jointly carry out work related to the fire safety management of workshops and warehouses.
Article 5 (Comprehensive Supervision)
This Municipality shall carry out cross-departmental comprehensive supervision over workshops and warehouses, clarifying key fire safety matters in aspects such as planning, construction, usage, and leasing. It shall conduct classified and graded supervision and management according to provisions, organize joint law enforcement inspections, and strengthen the joint handling and application of problem clues and results.
Article 6 (Digital and Intelligent Supervision)
This Municipality shall rely on the urban operation "Integrated Online Administration" platform and the big data resource platform to establish and improve a fire safety risk monitoring and early warning mechanism for workshops and warehouses. Departments of fire and rescue, housing and urban-rural development management, emergency management, planning and resources, State-owned assets, and urban management and law enforcement shall strengthen the sharing of basic information, regulatory information, and other data concerning workshops and warehouses, thereby improving the efficiency of fire safety hazard investigation and rectification work in workshops and warehouses.
Article 7 (Industry Self-discipline)
Relevant industry associations, such as those for warehousing and fire protection, shall strengthen industry self-discipline, provide training, technical consultation, and guiding services for fire safety, research and promote advanced fire safety technologies, and enhance the fire safety management level of the industry.
Article 8 (Unit Fire Safety Responsibilities)
The property owners, users, and managers of workshops and warehouses shall, in accordance with the law, fulfill their fire safety duties, and improve fire safety management and implement fire safety work requirements in light of the characteristics of their business activities and the needs of fire safety work.
Article 9 (General Requirements for Development, Construction, and Use)
The development, construction, and use of workshops and warehouses shall comply with the national engineering construction fire protection technical standards and relevant state and municipal provisions.
Article 10 (Requirements for Installation and Use of Production and Storage Facilities and Equipment)
The installation and use of production and storage facilities and equipment shall not affect the normal operation of fire protection facilities such as automatic fire extinguishing systems, automatic fire alarm systems, fire compartment facilities, and safe evacuation facilities in workshops and warehouses.
Article 11 (Management of Oil, Gas, and Electricity Use)
The property owners, users, and managers of workshops and warehouses shall, in accordance with the provisions of laws and regulations and the fire safety responsibilities clearly defined by all parties, formulate safety management systems for oil, gas, and electricity use, as well as emergency response plans for accidents. They shall conduct fire prevention inspections on the safe usage of fuel gas equipment and pipelines, as well as electrical devices and lines. Upon discovering fire safety hazards, they shall promptly handle them according to law or report them to the relevant units.
Property owners, users, and managers of workshops and warehouses are encouraged to adopt electrical fire monitoring technologies to enhance the monitoring, early warning, and handling capabilities regarding the operational status of electrical products and their circuits.
Article 12 (Charging and Storage Management)
For auxiliary equipment such as battery-powered electric forklifts and robots that support production and storage operations and are charged and stored within workshops or warehouses,fire separation measures such as fire-resistant walls and doors shall be installed between the charging/storage areas and the production/storage areas.
Electric vehicles, electric bicycles, and their batteries unrelated to production or storage operations shall not be charged, parked, or stored inside workshops or warehouses.
Article 13 (Loading/Unloading Management)
Loading and unloading equipment entering Class A or B workshops and warehouses shall be explosion-proof. For loading and unloading equipment entering Class C workshops and warehouses that may generate sparks, safety devices to prevent sparks from splashing out shall be installed.
Article 14 (Open Flame and Hot Work Management)
Where open flame operations are required for construction, repairs, maintenance, etc., or where fire safety hazardous operations such as electric welding, gas welding, gas cutting, or abrasive wheel cutting are conducted within workshops or warehouses, the following provisions shall be observed:
1. implement internal approval procedures in accordance with provisions;
2. conduct relevant fire safety training for operators and on-site supervisors, and urge them to implement on-site fire safety measures; and
3. confirm that relevant operators hold valid certificates for their work.
Operators shall carry out their work in accordance with standard specifications and operating procedures. On-site supervisors shall ensure that operators comply with the operating procedures and implement fire safety measures.
Article 15 (Requirements for Classified Storage in Warehouses)
Goods stored in warehouses shall be stored in categories according to their fire safety hazard classification, and information boards indicating the name, nature, and fire extinguishing methods of the stored goods shall be placed in conspicuous positions.
Flammable and explosive dangerous goods shall not be mixed with general goods, goods that may chemically react with them, or goods requiring different fire extinguishing methods.
Article 16 (Warehouse Stacking Requirements)
Main evacuation passages shall be pre-reserved inside warehouses, the stacking area shall be reasonably controlled, and clear boundary markings shall be set up.
Warehouse users shall assign dedicated personnel to inspect incoming goods. If potential fire safety hazards are discovered, measures shall be taken to eliminate them.
Article 17 (Management Requirements for External Construction and Operating Personnel)
Warehouse users shall strengthen the management of external construction and operating personnel, conducting fire safety education and training including fire risk identification and emergency evacuation. Prior to commencing construction or operations, external construction and operating personnel shall acquaint themselves with the on-site working environment, master relevant safety precautions and emergency response measures, and enhance their capabilities for self-rescue and mutual rescue.
Article 18 (Management Requirements for Cold Stores and High-Rack Warehouses)
The use of cold stores shall comply with the following fire safety management requirements:
1. the anteroom area within the cold store shall not be used for storing goods;
2. stacking combustible materials beneath electrical equipment such as fans in the cold store is prohibited;
3. information boards installed on the exterior wall shall also indicate the name and characteristics of the refrigerant, and the combustion performance of the insulation material; and
4. other fire safety management requirements prescribed by laws, regulations, and rules.
Pallets used in Class D and E high-rack warehouses shall be made of non-combustible or difficult-to-combust materials.
Article 19 (Risk Prevention and Control for "Four New" Items)
Where users of workshops or warehouses adopt new processes, new technologies, new materials, or use new equipment, they shall take effective measures to prevent fire safety risks; where a safety assessment is legally required, such assessment shall include fire safety content. Relevant administrative departments shall provide services and guidance based on the needs of the users of workshops and warehouses.
Article 20 (Management Requirements for Photovoltaic Power Generation Equipment)
Where photovoltaic power generation equipment is installed on the roofs of workshops or warehouses, it shall not damage fire compartments, smoke control and exhaust facilities, or other fire protection facilities; accessible roofs shall be provided with pathways to meet the needs of firefighting and rescue operations. If the photovoltaic power generation equipment uses energy storage devices with fire risks such as lithium-ion batteries, these storage devices shall be installed independently outside the workshops or warehouses.
Where photovoltaic power generation systems are installed during the construction, renovation, or expansion of workshops or warehouses, they shall be designed, constructed, and accepted simultaneously with the construction project.
Article 21 (Management of Smart Space)
For intelligent manufacturing space projects constructed in accordance with relevant municipal provisions, their building fire protection design shall comply with the fire prevention technical standards for workshops. Class A and B workshops and Class C liquid workshops shall not be established within the intelligent manufacturing space.
Article 22 (Management Requirements for Multiple Users)
Where two or more users use the same workshop or warehouse, they shall comply with the following management requirements:
1. Where their respective used portions are located within the same fire compartment, the portions shall be separated by fire-resistant walls;
2. It is necessary to install fire alarms with linkage functions in their respective used portions, except where an automatic fire alarm system is already installed; And
3. It is necessary to inform other users in advance when conducting open flame operations or fire safety hazardous operations such as electric welding, gas welding, gas cutting, or abrasive wheel cutting.
Article 23 (Management Requirements for Leased Workshops and Warehouses)
When leasing out workshops or warehouses, the lessor shall specify the fire safety responsibilities of all parties in writing with the lessee, and comply with the following management requirements:
1. Provide workshops or warehouses that meet the corresponding fire safety requirements;
2. Inform the lessee in advance of the fire safety requirements for the workshop or warehouse;
3. Regularly assess the fire safety status of the workshop or warehouse;
4. Upon discovering any violations of fire safety provisions by the lessee, advise and stop them; if advice and stopping are ineffective, promptly report to the local fire and rescue department; and
5. Urge the lessee to strengthen fire safety management and rectify fire safety hazards promptly.
When leasing a workshop or warehouse, the lessee shall inform the lessor such information as the fire safety hazard classification of the goods to be produced or stored, and the main process links, etc.; if there is a need to change the usage nature or function of the workshop or warehouse, it shall comply with the provisions of laws, regulations, and the agreement between both parties.
Article 24 (Lease Information Reporting)
Lessors of workshops and warehouses shall report relevant information, such as the basic information of the lessor and lessee, the written agreement specifying fire safety responsibilities, etc. via the urban operation "Integrated Online Administration" platform. If the information changes, it shall be updated promptly.
Article 25 (Reference Clause)
Where there are provisions in laws or regulations for handling violations of these Provisions, such provisions shall prevail.
Article 26 (Penalties for Illegal Acts)
For violations of these Provisions, in any of the following circumstances, the fire and rescue department shall impose penalties according to the following provisions:
1. Violating Paragraph 1 of Article 12 of these Provisions, by charging, storing, or parking not in accordance with the requirements, a corrective order shall be issued, and a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed.
2. Violating Paragraph 1 of Article 15 or Item 3 of Paragraph 1 of Article 18 of these Provisions, by failing to install information boards as required, a corrective order shall be issued within a specified time limit; if correction is not made within the time limit, a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed.
3. Violating Item 1 or 2 of Paragraph 1 of Article 18 of these Provisions, by storing goods in the anteroom area of a cold store, or stacking combustible materials beneath electrical equipment in a cold store, a corrective order shall be issued within a specified time limit; if correction is not made within the time limit, a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed.
4. Violating Paragraph 2 of Article 18 of these Provisions, where the combustion performance of pallets in Class D or E high-rack warehouses does not comply with provisions, a corrective order shall be issued within a specified time limit; if correction is not made within the time limit, a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed.
5. Violating Item 1 or 2 of Article 22 of these Provisions, by failing to implement fire compartment measures as required or failing to install fire alarms with linkage functions, a corrective order shall be issued within a specified time limit; if correction is not made within the time limit, a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed; if the circumstances are serious, a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed.
6. Violating Article 24 of these Provisions, by failing to report lease information as required, a corrective order shall be issued within a specified time limit; if correction is not made within the time limit, a fine of not less than 1,000 yuan but not more than 5,000 yuan shall be imposed.
Article 27 (Effective Date)
These Provisions shall be effective as of March 1, 2026. The Provisions of Shanghai Municipality on Fire Prevention Administration in Warehouses approved by Shanghai Municipal People's Government on August 23, 1989, and amended and re-promulgated by Decree No. 52 of Shanghai Municipal People's Government on December 20, 2010, shall be simultaneously repealed.
