State Council approves temporary adjustment to administrative provisions in Shanghai
The State Council agreed to temporarily adjust certain relevant provisions of the Regulations on Administration of Foreign Law Firms' Representative Offices in China in Shanghai in a reply released on May 8.
For representatives of foreign law firms' representative offices in Shanghai who change their practicing institutions among the representative offices in Shanghai, the adjustment will be approved by the Shanghai Municipal Justice Bureau instead of the Ministry of Justice, and the former should report to the latter for record.
When representatives of foreign law firms' representative offices in Shanghai change their practice institutions among foreign law firms' representative offices in Shanghai, they are required to provide a certificate stating that the proposed chief representative has practiced outside China for no fewer than three years, and that the other proposed representatives have practiced outside China for no fewer than two years. This certificate is subject to the Notification and Promise system, according to the adjustments.
