2.Draft Revisions to the Customs Law under Comment

The General Administration of Customs (GAC) recently released a circular to solicit public opinions on the Customs Law of the People's Republic of China (Draft Revisions). The deadline for feedback is December 10, 2023. The draft revised law has 113 articles in ten chapters, namely General Provisions, Customs Law Enforcement Measures and Supervision, Customs Risk Management, Enterprise Management, Inward and Outward Means of Transport, Inward and Outward Goods, Inward and Outward Articles, Customs Duties and Customs Affairs Guarantee, and Legal Liabilities.

The Plan on the Setup of the Pilot Zone for "Silk Road" E-commerce in Shanghai was recently released. The plan proposes 19 tasks and measures in three aspects, including expanding opening-up of e-commerce, creating a pilot environment, and vigorously promoting international and regional exchanges and cooperation.

2.Shanghai Issues Special Cooperation Plan for High-end Business Service Platforms in Hongqiao International Central Business District

Four units including the Shanghai Branch of the Export-Import Bank of China recently released the Special Cooperation Plan for High-end Business Service Platforms in Hongqiao International Central Business District. 4. Shanghai Issues Guidelines to Clarify Benefits of Work-related Injury Insurance

Shanghai Municipal Human Resources and Social Security Bureau recently issued the Guidelines on Several Issues Concerning the Implementation of the Shanghai Work-related Injury Insurance Measures, which will take effect on December 1, 2023 and remain valid until November 30, 2028. The document sets regulations on the jurisdiction over the acceptance of applications for claiming work-related injury insurance benefits by employees, and on the details of insurance benefits.

A: If a labor dispatch worker is injured in an accident or suffers from an occupational disease, the actual employer shall pay for the floating premium of work-related injury insurance. 

 

When a labor dispatch unit dispatches employees to entities such as foreign business offices in Shanghai that are not qualified as labor employers in this city, and the dispatched personnel are injured in accidents or suffer from occupational diseases that are recognized as work-related injuries, the labor dispatch unit shall bear the cost for the floating premium of work-related injury insurance.
