Shanghai offers home-grown solution to international business disputes

As Shanghai-based companies expand into international markets, disputes with overseas partners can present significant challenges, particularly when contracts lack pre-agreed arbitration clauses. To address this, the Shanghai International Arbitration Center offers a local solution, providing an efficient and confidential mechanism for resolving cross-border commercial disputes.

Arbitration, a process where disputes are resolved outside of court by appointed experts, is gaining traction among businesses for its efficiency and confidentiality. Unlike traditional litigation, arbitration allows parties to select arbitrators who are experts in specific fields relevant to their dispute, ensuring a more informed resolution process. Moreover, arbitration proceedings are private, safeguarding sensitive commercial information from public disclosure.

In recent years, Shanghai's arbitration sector has witnessed a boom, with the total value involved in cases exceeding 100 billion yuan ($14.49 billion) for three consecutive years. The proportion of foreign-related cases is also on the rise, reflecting the global reach of Shanghai-based enterprises.

The SHIAC has established a global network of arbitrators, with 1,463 professionals from 81 countries and regions. These arbitrators are not only legal authorities but also specialists in over 20 fields, including engineering, new energy, and finance. This diverse expertise ensures that no matter the industry or country involved, there is an arbitrator with the necessary knowledge to handle the case.

In addition to its Shanghai base, the SHIAC is expanding its presence internationally. It has already set up a center in Hong Kong and plans to establish a new center in Singapore this year. This expansion allows businesses to choose arbitration venues that best suit their needs, offering flexibility and convenience.

Experts advise companies to include an arbitration clause in their contracts from the outset. The SHIAC provides a sample arbitration clause that can be customized to specify the arbitration location, language, applicable rules, and governing laws, helping businesses prevent future jurisdictional disputes and ensure smooth resolution of potential conflicts.

With its expanding global network and growing caseload, Shanghai is steadily strengthening its role in cross-border dispute resolution, offering businesses greater certainty in an increasingly complex international environment.
