Trademark owners can apply to have eligible registered trademarks included in the Shanghai Key Trademark Protection List. The application and protection arrangements are carried out in accordance with the Administrative Measures for the Shanghai Key Trademark Protection List.

I. Overview

The Shanghai Key Trademark Protection List is designed to protect registered trademarks that enjoy a relatively high level of recognition in Shanghai, have considerable market influence, and are vulnerable to counterfeiting or infringement.

II. Core benefits of inclusion

Trademarks included in the list receive enhanced administrative protection and related support:

  • Enhanced administrative protection: Listed trademarks are subject to strengthened supervision and inspection. Authorities may carry out targeted trademark protection actions, while infringement cases involving these trademarks may be placed under focused supervision.
  • Cross-regional enforcement cooperation: Through regional cooperation mechanisms, authorities coordinate cross-regional and interprovincial trademark enforcement and provide guidance when listed trademarks are infringed outside Shanghai.
  • Support for international trademark protection: Trademark owners gain access to expert consultation, legal and policy guidance, and relevant information concerning international trademark registration and protection.

III. Eligibility

A registered trademark is eligible for inclusion in the list if it meets any of the following conditions:

  1. It has been recognized as a well-known trademark by the China National Intellectual Property Administration or the former State Administration for Industry and Commerce.
  2. It enjoys a relatively high level of public recognition.
  3. It has been subject to infringement or counterfeiting.
  4. Its legitimate interests have been harmed by malicious trademark squatting by another party.
  5. It meets brand-building requirements and aligns with industrial development priorities.

IV. Required Application Documents

A trademark owner applying for inclusion in the list must submit the following materials to the relevant district intellectual property administration:

  • An application form;
  • Proof of registration of the relevant trademark;
  • Proof of the trademark owner's identity;
  • The trademark owner's contact information; and
  • Supporting documents demonstrating that the trademark meets the eligibility requirements.

V. Filing Instructions

  • Submit all application materials in the order specified in the application materials list for the relevant district.
  • Applicant-prepared documents must be printed on A4 paper; documents issued by government departments or other institutions must be submitted in their original size.
  • All photocopies must be clear.

VI. Application and Handling Procedures

1. Application and preliminary review

A trademark owner applying for inclusion in the list must submit the required application materials to the relevant district intellectual property administration.

Within 30 days of receiving the application, the district intellectual property administration must conduct a preliminary review of the authenticity, legality, and relevance of the supporting materials. If the application passes the preliminary review, the administration must prepare a preliminary review report and submit it, together with the supporting materials provided by the trademark owner, to the Shanghai Intellectual Property Administration. If the application does not pass the preliminary review, the applicant must be notified.

2. Municipal review and inclusion

Following acceptance and preliminary review by the district intellectual property administration, the application is submitted to the Shanghai Intellectual Property Administration. The trademark may be included in the list upon review and approval by the Shanghai Intellectual Property Administration.

3. Public announcement

The Shanghai Intellectual Property Administration must promptly announce additions to and removals from the list.

The list must be published on the official website of the Shanghai Intellectual Property Administration and may also be published through other public platforms and news media.

Note: With the trademark owner's consent, the Shanghai Intellectual Property Administration may also proactively include an eligible trademark in the list.
