Frequently Asked Questions (FAQs)

Q1: What are the requirements for registering a portrait as a trademark?

  • Registering someone else's portrait: You must make a formal statement and attach an authorization letter from the person depicted. The authorization letter must include the portrait to be used as the trademark drawing and a copy of that person's ID. If the person depicted is deceased, provide documentation showing that the applicant has the right to use or otherwise dispose of the portrait. The documentation must include the portrait to be used as the trademark drawing.
  • Registering your own portrait: You must make a formal statement; no authorization letter is required.
  • Registering a fictional character/image: If the image in the trademark drawing is fictional rather than a portrait of a real person, this must be stated in the trademark description field.

Q2: Can I use the trademark after receiving the Acceptance Notice?

No. The Acceptance Notice only confirms that the Trademark Office has accepted the trademark registration application; it does not mean the trademark has been approved for registration.

Before official approval, the trademark remains unregistered and must be used in compliance with the rules governing unregistered trademarks. Any infringement of another party's exclusive trademark rights during this period may still be investigated and dealt with by the relevant authorities.

Q3: How can I check the registration status of an existing trademark?

The China Trademark Website provides free inquiry services. You can visit the "Trademark Search" section to check the status by entering the application/registration number, or conduct a comprehensive search by class, application/registration number, applicant name, and other criteria.

Q4: How do I check if a trademark is available for registration in advance?

You can use the "Trademark Similarity Inquiry" function on the China Trademark Website. The platform supports six search methods: Chinese characters, pinyin, English, numbers, one- or two-letter combinations, and graphics. The official trademark examination standards are also published on the website for your reference.

Note: The English version is for reference only. In case of any discrepancies, the Chinese version shall prevail.
