What are you entitled to during work stoppage leave?
If you're injured at work or diagnosed with an occupational disease, you may qualify for work stoppage leave, a paid break from work to focus on medical treatment and recovery.
This leave generally lasts up to 12 months. In severe or exceptional cases, it can be extended for another 12 months, provided the extension is approved by a municipal-level labor assessment committee.
How is the leave determined?
The leave typically begins on the date of the work-related injury. The exact duration is determined on your healthcare provider's recommendations and must be confirmed by the labor authority.
What will you be paid?
During this period, your salary and benefits remain unchanged. Your employer must continue paying your full regular earnings each month, not just your basic wages.
What if you've worked for less than a year?
If you have worked at your job for less than 12 months, your pay will be calculated based on the average monthly earnings from the months you have actually worked. For example, if you have worked six months, the calculation will be based on the average of those six months.
One important rule is that your pay cannot fall below the local minimum wage. If your average earnings are lower, you will receive the minimum wage instead.
